403 Acting Out of Classification Pay
In accordance with the guidelines set forth in this policy, the City of Grapevine will
provide out of classification pay to regular full-time, regular part-time, part-time,
casual and employees serving their initial probationary period.
.01 Members of the Fire and Police Department, including sworn exempt officers, as
defined in Section 141.009(a) and (b) of the Local Government Code who are
required to perform the duties of a higher classification shall be paid a wage within
the salary range prescribed for that position during the time the member performs
those duties.
(1) The term "required to perform" shall mean that the member was directed or
ordered by a superior to perform the duties.
(2) Employee(s) acting out of classification shall not acquire any status or rights
as a result of the assignment.
.02 All non-exempt full-time employees who are temporarily assigned to do the work of
a classification having a higher minimum or maximum rate, shall be paid for acting
out of classification for more than 24 consecutive hours.
(1) The employee shall be compensated at the lowest step of the temporary
classification which will provide an increase of not less than 5% over that
received in their present classification.
(2) The employee who will be supervising* other employees while in acting status
shall be compensated at the lowest step of the temporary classification which
will provide an increase of not less than 5% over the current salary of the
highest paid employee who will be directly supervised by the acting employee.
(3) When an employee satisfies the 24-hour requirement, they shall be
compensated the out-of-class rate for the total number of hours which they
are assigned.
(4) Employee(s) acting out of classification shall not acquire any status or rights
as a result of the assignment.
(5) A non-exempt employee who is receiving Acting Pay in an exempt position
will continue to be classified as non-exempt and accrue compensatory time
or overtime while in the Acting exempt position.
.03 All non-exempt regular part-time, part-time, and casual employees who are
temporarily assigned to do the work of a classification having a higher minimum or
maximum rate, shall be paid for acting out of classification for more than 24
consecutive hours worked in the higher classification. They must work the out of
class assignment as consecutive hours.

(1) The employee shall be compensated at the lowest step of the temporary
classification which will provide an increase of not less than 5% over that
received in their present classification.
(2) The employee who will be supervising* other employees while in acting status
shall be compensated at the lowest step of the temporary classification which
will provide an increase of not less than 5% over the current salary of the
highest paid employee who will be directly supervised by the acting employee.
(3) When an employee satisfies the 24-hour requirement, they shall be
compensated the out-of-class rate for the total number of hours which they
are assigned to the higher classification.
(4) Regular part-time and part-time employees who act in a higher classification
will not work additional hours beyond those scheduled for their regular, non-
acting position.
(6) Employee(s) acting out of classification shall not acquire any status or rights
as a result of the assignment.
.04 Any exempt employee who is temporarily assigned or authorized in writing by a
Department Head or the City Manager to do work of a classification having a higher
minimum or maximum rate, may be paid for acting out of classification for more than
80 consecutive work period hours.
(1) Human Resources is responsible for determining the exempt/non-exempt
status for positions in accordance with state and federal law.
(2) The employee shall be compensated at the lowest step of the temporary
classification which will provide an increase of not less than 5% over that
received in their present classification.
(3) The employee who will be supervising other employees while in acting status
shall be compensated at the lowest step of the temporary classification which
will provide an increase of not less than 5% over the current salary of the
highest paid employee who will be directly supervised* by the acting
employee, or 10% if acting for Department Head.
(4) When an exempt employee is temporarily assigned to do work of a higher
classification, they will be compensated at the higher rate at the end of the
80 consecutive work period hours or before if appointed and authorized by
the City Manager.
(5) Employee(s) acting out of classification shall not acquire any status or rights
as a result of the assignment.

*NOTE: Supervising another employee involves all of the following: directing the
employee’s day-to-day work activities, training, disciplining, and conducting
performance evaluations.
