406 Overtime
When operating requirements or emergency situations are such that needs cannot
be met during normal working hours, employees may be given the opportunity to
volunteer or may be instructed to work overtime.
.01 Overtime compensation is paid to all non-exempt employees in accordance with
State Law, Federal Law and in compliance with City Policy. Overtime compensation
will be paid to exempt employees in accordance with state law and in compliance
with City policy.
.02 Firefighters will be paid special overtime for all hours worked over 204 during the 27-
day work period which was established September 24, 1985 in accordance with
section 207(k) of the act and 29 C.F.R. Part 553. The following pay types do not
count toward the 204 hours worked in the 27-day work period: administrative leave
with pay, bereavement, comp time earned, overtime, FMLA, holiday, LWOP, military
leave, personal leave, sick, vacation and worker’s compensation. Comp time taken
and witness/jury duty pay do count toward the 204 hours worked in the 27-day work
period.
Biweekly overtime for fire shift employees who are scheduled to work either 120
hours or 96 hours in a biweekly pay period will be paid 1.5 overtime based on the
112-hour rate. The base salary for inclusion in the overtime rate calculation shall
include all remuneration as specified under the Fair Labor Standards Act (FLSA).
.03 Police personnel assigned to 12-hour or 9-hour shifts will be paid one and one-half
times their regular hourly rate for all “compensable hours” recorded over 80 in a pay
period.
.04 All other employees will be paid one and one-half times their regular hourly rate for
all “compensable hours” recorded over 40 in any 7-day work period which begins on
Sunday 12:01 A.M. and ends at midnight on Saturday.
.05 “Compensable hours” shall include regular hours worked, vacation, City designated
holidays, City designated holidays saved and taken later, personal holiday, sick,
canine, FTO, acting out of classification, callback, inclement weather, bereavement,
witness/jury duty, workers’ compensation, compensatory time, Sick Leave Pool,
Workers’ Compensation Pool, and military leave up to 15 days in any one calendar
year (120 hours for general employees and 180 hours for firefighters working 24
hours shifts).
The base salary rate for inclusion in the overtime rate calculation shall include all
remuneration as specified under the Fair Labor Standards Act (FLSA).
.06 Compensable pay for overtime calculation does not include administrative leave with
pay, uniform allowance, nor the lump sum payment of longevity, sick leave buy-back,
reimbursements, or accrued compensatory pay.

.07 All overtime work, including, but not limited to, beginning work early, staying late,
working through lunch or working from home must be authorized or approved by the
appropriate supervisor. All overtime hours must be submitted to the appropriate
supervisor and recorded on the timesheet for the pay period in which it is worked.
.08 Non-exempt employees who are asked by their supervisor to work overtime but not
record the hours worked should immediately report this to his/her Department Head
or the Human Resources Director. Failing to accurately record all hours worked is a
violation of this policy.
.09 Overtime assignments will be distributed as equitably as practical to all employees
who are qualified to perform the work.
.10 Non-exempt employees who are required to attend local meetings scheduled by the
City of Grapevine (i.e. Court, City Council, Planning and Zoning, Park Board) outside
their normal duty hours shall be compensated for the actual hours in attendance but
never less than two hours. Overtime will be paid for all compensable hours recorded
over 40 in the seven-day work period.
