HomeMy WebLinkAbout0505 Demotions48 505 Demotions A demotion is the assignment of an employee to another job having a lower maximum salary. .01 An employee may be demoted for disciplinary reasons, voluntarily at the employee's request, or administratively, which includes management initiated actions. .02 The employee must meet all qualifications for the position. A drug screen and physical is not required for demotions. If there are different requirements for functional assessment screening, background check, credit check, polygraph, driving record, and/or educational requirements, the employee will need to meet the new job’s requirements. .03 A voluntary demotion is an employee initiated action in which an employee elects to voluntarily demote into a vacant position in a job having a lower maximum salary. The employee must submit an application. This applies to both inter- and intra- department demotions. The employee must give at least two weeks’ notice to the releasing department; however, the releasing supervisor may waive this requirement. Since this is an employee initiated action, the employee acknowledges that this may result in a reduction in pay and therefore does not require the hearing process. .04 An administrative demotion is a management initiated action that can occur from time to time due to growth or a change in demands for service. When an employee is moved from one position to another in a lower pay grade due to management initiated action they may or may not receive a reduction in pay. If the employee receives a reduction in pay, the employee is eligible for the hearing process. However, the employee can choose to waive the hearing process. If there is not a reduction in pay as a result of an administrative demotion, there will not be a hearing. .05 A disciplinary demotion is a management initiated action that can occur as a result of the disciplinary process. A disciplinary demotion will automatically require the hearing process and may result in a reduction in pay. .06 A demotion, whether voluntarily, administratively or through the disciplinary process, may result in a reduction in pay. However, the employee shall be compensated in the salary range of the job to which the employee was demoted. If the employee’s salary prior to demotion is greater than the maximum of the new range, the employee’s salary will be moved to at least the maximum of the new range when the demotion occurs, although a greater reduction in pay may occur. A supervisor shall generally be paid 5% above their highest paid subordinate. 49 .07 There shall be no change in an employee’s anniversary/longevity date whether the demotion is voluntary, disciplinary or administrative; however, regular full-time and regular part-time employees will serve a 6-month probationary period following the date of the demotion.
