BCRA 86-06, ROBERT RFULINC
The next item of new business was for the Building Code Board of Appeals to
conduct a Public Hearing for BCRA 86-66, submitted by Robert Reuling, who
is requesting a variance from Section 7 -128 of the City's Code of ordinance
which disallows fences closer than fifteen (15') feet to the property line
on corner lots with reverse frontage for the property at 625 Berkley
Drive.
Jim VanTreese explained that Mr. Reuling had discussed with him
requirements for front yard fences at the time he was in to obtain a
sprinkler permit. Mr. Reuling went ahead and constructed the fence without
a permit. Mr. VanTreese stated that Staff's recommendation was denial
because if Mr. Reuling had obtained a fence permit, then the error would
have been detected.
Mr. Reuling spoke and explained that Mr. VanTreese had explained to him the
procedures of building a fence but did not mention having to obtain a
permit. Mr. Reuling stated that about four months after he had built the
fence, he was red tagged for not having a permit. When he applied for the
permit Mr. VanTreese approved it, but then realized that he had made a
mistake and told Mr. Reuling that the fence needed to be taken down because
the fence was in violation of the code. Mr. Reuling stated that he had
talked to some of his neighbors and there was no one that disapproved. He
also read a letter of approval from Ryland Homes, and from the neighbor
directly behind him.
John Armistead, of 627 Berkley, Grapevine, Texas, spoke in .favor of the
fence.
Patty Belcher Campos, who also lives in the same subdivision as Mr.
Reuling, spoke and stated that she had looked at that same lot and had
checked with the City about a fence, and that the City had told her because
of the corner lot, the fence could not be constructed within the 15' side
yard setback for reverse frontage lots.
Linda Squires, of 631 Berkley, Grapevine, Texas, explained that she owned
the lot next to Mr. Reuling and was concerned what would be happening with
this case because they were wanting to construct a fence also.
With no one else to speak either for or against the request, Chairman, Joe
Lipscomb, declared the Public Hearing closed.
After further discussion, H. J. Harper made a motion to grant the variance.
Bob Roberson was concerned with the property owners in the future.
After further discussion, John Ferguson seconded the motion which prevailed
by the following vote:
Ayes: Lipscomb, Harper, Roberson
Nays: None
Absent: Gordon
