APPLICANT- Clay Cristy PROPERTY LOCATION AND SIZE - The subject property is located at 440 West State Highway 114 and is proposed to be platted as Lots, platted as Lots 1 R3, Lots 2-3, Block 1 R, Payton - Wright Addition. The addition contains 7.00 acres and has approximately 945 feet of frontage along West State Highway 114. REQUESTED CONDITIONAL USE AND COMMENTS - The applicant is requesting a conditional use permit to allow within a planned commercial center, a restaurant with the possession, storage, retail sale, and on- and off -premise consumption of alcoholic beverages (beer, wine, and mixed beverages), drive -through service, outdoor dining, outdoor speakers, and one. 40-foot pvlon sign. This is the second restaurant requested in conjunction with the establishment of the planned commercial center and the Rock and Brews restaurant (CU21-12) on the seven - acre site that was the former home of the Payton -Wright Ford automotive dealership. With this request the applicant intends to develop a single -story Velvet Taco restaurant that's 2,478 s.f. in size along with a 645 s.f patio area on a 0.96 acre (41,870 s.f.) pad site 0:\ZCU\CU21-13.4 1 July 14, 2021 (9:34AM) with drive -through service along the eastern edge of the planned commercial center. A total of 94 seats will be available to patrons of the restaurant with 60 seats being located indoors and 34 seats in an outdoor patio area along the southern elevation adjacent to the S.H. 114 service road. Required parking for the restaurant is 44 spaces and the applicant has provided 44 spaces. Two outdoor speakers are proposed in the outdoor patio area. Relative to signage the applicant proposes one, 40-foot pylon sign, 286 s.f. in size. PRESENT ZONING AND USE: The property is currently zoned "HC" Highway Commercial District and was previously developed as the Payton -Wright Ford automotive dealership. It was most recently utilized by Northgate Constructors as their offices during the State Highway 114/121 realignment and widening project. HISTORY OF TRACT AND SURROUNDING AREA: The subject property was rezoned from "C-2" Community Business District to "HC" Highway Commercial District in the 1984 Citywide Rezoning. The most recent activity took place during a public hearing at the October 15, 2013 meeting in which the council denied a conditional use permit (CU 13-23) for a new automotive dealership. The Board of Zoning Adjustment approved BZA92-27 to allow variances to the minimum open space requirements, maximum impervious area, front yard setback requirement, landscaping requirements, and nonconforming uses. Variance request BZA94-12 was approved allowing variances to the required minimum open space requirement, maximum impervious area, front yard setback requirement, and allowing a special exception to allow an existing nonconforming use to expand. Variance request BZA96-08 was approved allowing the remodeling or enlargement of a nonconforming use. Conditional Use Application CU96-06 was approved at the April 16, 1996 meeting allowing automotive sales and service to new and used cars and trucks. A conditional use permit for the relocation of an 88-foot flag pole (CU98-16) and a special use permit (SU98-03) to allow for cellular equipment was approved by Council on April 21, 1998. A zone change request (Z01-17) to rezone the property from "HC" Highway Commercial District to "CC" Community Commercial District and a conditional use request (CU01-67) to allow for temporary used car sales for Nissan automobile new and used car dealership was withdrawn by the applicant. A conditional use permit (CU04-17) for a 30-foot pole sign was approved on this site at the May 18, 2004 meeting. A conditional use permit (CU06-40) for the expansion of the dealership to the vacant lot plus a pre -owned vehicle sales building was approved at the October 17, 2006 meeting. At Council's January 16, 2007 meeting conditional use request CU06-64 was approved which eliminated the pre -owned sales building that was previously approved in October, 2006. The Tia's Tex-Mex restaurant to the west of the subject site was demolished and a new restaurant Pappadeaux's Seafood Kitchen (CU10-03) was approved by Council at their March 16, 2010 meeting. The property to the east was rezoned from "C-1" Community Business to "PO" Professional Office District in the 1984 Citywide Rezoning. Zoning Change Request Z95-16 approved the rezoning of this 0:\ZCU\CU21-13.4 2 July 14, 2021 (9:34AM) property to "HC" Highway Commercial District from "PO" Professional Office District. Conditional Use Application CU95-16 allowed automotive sales and service of new and used cars and trucks on the western side of this property. The property to the north was rezoned from "R-1" Single Family District to "R-7.5" Single Family District in the 1984 Citywide Rezoning. It is currently developed as the Bellaire Addition. The property to the west was rezoned from 1-1" Light Industrial District and "R-1" Single Family District to "HC" Highway Commercial District in the 1984 Citywide Rezoning. This property has developed as the Haley Addition Planned Commercial Center. and WHEREAS, the City Council of the City of Grapevine, Texas, does find that the conditional use permit lessens the congestion in the streets, helps secure safety from fire, panic and other dangers, prevents the overcrowding of land, avoids undue concentration of population, facilitates the adequate provisions of transportation, water, sewerage, schools, parks and other public requirements; and WHEREAS, the City Council of the City of Grapevine, Texas, has determined that there is a necessity and need for this conditional use permit and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the property requested for a change since this property was originally classified and, therefore, feels that the issuance of this conditional use permit for the particular piece of property is needed, is called for, and is in the best interest of the public Ordinance No. 2021-034 2 at large, the citizens of the City of Grapevine, Texas, and helps promote the general health, safety and welfare of this community. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That the City does hereby issue a conditional use permit in accordance with Section 48 of Ordinance No. 82-73, the Comprehensive Zoning Ordinance of the City of Grapevine, Texas, same being also known as Appendix "D" of the City Code, by granting Conditional Use Permit CU21-13 to allow within a planned commercial center, a restaurant with the possession, storage, retail sale and on- and off - premise consumption of alcoholic beverages (beer, wine, and mixed beverages), outdoor dining, outdoor speakers, and one, 40-foot pole sign in a district zoned "CC" Community Commercial District within the following described property: Lot 3, Block 1 R, Peyton Wright Addition (440 West State Highway 114) all in accordance with a site plan approved pursuant to Section 47 of Ordinance No. 82-73, attached hereto and made a part hereof as Exhibit "A", and all other conditions, restrictions, and safeguards imposed herein, including but not limited to the following: None. Section 2. That the City Manager is hereby directed to amend the official zoning map of the City of Grapevine, Texas, to reflect the herein conditional use permit. Section 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said City of Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City of Grapevine, Texas. Section 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets, to secure safely from fire, panic, flood and other dangers; provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; facilitate the adequate provisions of transportation, water, sewerage, drainage and surface water, parks and other public requirements, and to make adequate provisions for the normal business, commercial needs and development of the community. They have been made with reasonable consideration, among other things, of the character of the district, and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. Section 5. That this ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances which are in direct conflict with the provisions of this ordinance. Ordinance No. 2021-034 3 Section 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. Section 7. That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 8. That the fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage, and it is accordingly so ordained.
