PROPERTY LOCATION AND SIZE:
The subject property is located at 2850 State
Highway 121 North, and is platted as Lot 2, Block 1,
Northpoint. The subject property contains 3.69 acres
and has approximately 619 feet of frontage along
State Highway 121 North.
REQUESTED CONDITIONAL USE, PLANNED DEVELOPMENT OVERYLAY AND
COMMENTS:
The applicant is requesting a conditional use permit to allow the possession, storage, retail
sale, and off -premise consumption of alcoholic beveraqes (beer, wine, and mixed
beverages) in conjunction with a commercial kitchen with delivery and pick-up service only.
Planned development overlay PD21-02 is a request to allow for the overniqht parkinq of
delivery vehicles.
With this request the applicant intents to develop a chef -driven, multiple -concept, food and
beverage delivery and take-out service only, on the subject site. Up to sixteen different
concepts will provide popular dishes and alcoholic beverages for customer pick-up or by

delivery by employee servers. Customers will place orders either through a downloadable
mobile app, through the applicant's website, or through direct contact by phone. All orders
are purchased digitally; there is no cash payment option. The 3.69-acre site will have two
points of access from the northbound State Highway 114 service road. All operations will
be contained within a single -story, 14,938 s.f. structure. Two drive -through lanes on the
north and south side of the building will be utilized by the employee driver -servers to pick
up and deliver the food/beverage orders. Parking for customers who wish to pick up their
orders are provided to the south of the building who will then enter on the west side
through doors under the port-cochere to be greeted by a host that will match them with
their order.
Hours of operation are Monday through Thursday 8:00 a.m. to 8:30 p.m. and 10:00 a.m. to
8:30 p.m. Friday through Sunday. Total parking required is 73 spaces and the applicant
has provided 104 spaces. Relative to the planned development overlay the applicant will
have their own branded delivery vehicles (current model year Nissan Kicks) that will remain
on site. Approximately 30 parking spaces will be designated for this purpose which will be
screened by the dumpster enclosure and landscaping.
PRESENT ZONING AND USE:
The property is currently zoned "CC" Community Commercial District and is undeveloped.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject property and surrounding areas were rezoned in the 1984 City Rezoning from
1-1" Light Industrial District to "PID" Planned Industrial Development District. At the March
20, 2001 meeting the City Council approved zone change request Z01-02 (Ord. 2001-19)
from "PID" Planned Industrial Development District to "BP" Business Park District. At the
January 15, 2008 meeting the City Council approved zone change request Z07-15 (Ord.
2008-02) and conditional use permit CU07-39 (Ord.2008-02) for a planned commercial
center for a retail shopping center which never developed. At the February 17, 2009
meeting the City Council approved a one-year extension to CU07-39. At an April 21, 2015
meeting the council denied conditional use request CU15-08 on the subject property for a
commercial parking lot/park-and-ride airport shuttle service. Also on the subject property at
an August 18,2015 meeting, conditional use request CU15-35 was denied by the council
on the subject site relative to a document storage facility.
On the property to the south Conditional Use Permit CU93-07 was approved on July 20,
1993 for a church in a Planned Industrial District under the standard development option
with deed restrictions. Construction on the project did not occur within the allotted time
frame and the conditional use permit expired. The site was rezoned (Z96-13) in June 1996
to "CC" Community Commercial District as directed by Council. The GE Computer
Services property to the south was rezoned from 1-1" Light Industrial District to "LI" Light
Industrial District in the 1984 City Rezoning. Council approved special use request SU96-
14 (Ordinance 96-103) at the December 17, 1996 joint public hearing allowing the

Fellowship of Las Colinas to develop a church with a height of 60.5 feet, exceeding the 50-
foot maximum height allowed in the "CC" Community Commercial District. The site was
later revised (SU97-08; Ordinance 97-109) to include an 87,300 square foot Phase 2,
Children's Education Center and to increase the number of fixed auditorium seating by
1,255 seats for a total of 4,092 seats. At the February 17, 1998 meeting, Council approved
(SU98-01) a revision to the site plan allowing for an approximate 26,500 square foot
temporary building to be utilized as the church's preschool structure. This addition of a
temporary building to the site plan was approved with the stipulation that it would be
removed within four years of the issuance of a certificate of occupancy for the structure.
Special Use Permit S000-01 was approved by Council at their January 16, 2001 meeting
and allowed for a revision to the previously approved creative communications building and
the addition of an atrium/food court. The Site Plan Review Committee, at their June 20,
2001 meeting approved a slight amendment to the site plan associated with the Fellowship
Church specifically reducing the size of the Creative Communications building from
155,972 square feet to 144,100 square feet. Council approved at the May 21, 2002
meeting a revision of the site plan for the Fellowship Church (SU02-02) specifically allowing
a modification to the west exterior elevation, the landscaping in the bookstore courtyard
area and allowing the addition of six flagpoles near the main entrance to the site. At the
December 12, 2002 meeting City Council approved SU02-05 (Ord. 2002-96) to eliminate
the four-year time limit on the existing preschool building and allow for its permanent use
and to allow for the addition of another preschool building.
SURROUNDING ZONING AND EXISTING LAND USE:
NORTH: "CC" Community Commercial District —vacant
SOUTH: "CC" Community Commercial District —Fellowship Church
EAST: "CC" Community Commercial District and City of Coppell—vacant
WEST: "CC" Community Commercial District —Cracker Barrel Restaurant and
Grapevine Mills Mall
AIRPORT IMPACT:
The subject tract is located within "Zone B" Middle Zone of Effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. In Zone B,
the following uses may be considered only if sound treatment is included in building design:
multi family apartments, motels, office buildings, movie theaters, restaurants, personal and
business services. Single Family residential and sound sensitive uses such as schools and
churches should avoid this zone. The applicant's proposal is an appropriate use in this
noise zone.

MASTER PLAN APPLICATION:
The Master Plan designates the subject property as a commercial land use. The
applicant's proposal is in compliance with the Master Plan.

GRAPEVINE, TEXAS, ISSUING CONDITIONAL USE PERMIT
CU21-14 TO ALLOW FOR THE POSSESSION, STORAGE,
RETAIL SALE, AND OFF -PREMISE CONSUMPTION OF

WHEREAS, an application was made requesting issuance of a conditional use
permit by making applications for same with the Planning and Zoning Commission of the
City of Grapevine, Texas, as required by State statutes and the zoning ordinance of the
City of Grapevine, Texas, and all the legal requirements, conditions and prerequisites
having been complied with, the case having come before the City Council of the City of
Grapevine, Texas, after all legal notices requirements, conditions and prerequisites having
been complied with; and
WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing
called by the City Council did consider the following factors in making a determination as
to whether this requested conditional use permit should be granted or denied: safety of the
motoring public and the pedestrians using the facilities in the area immediately
surrounding the site; safety from fire hazards and measures for fire control; protection of
adjacent property from flood or water damages, noise producing elements, and glare of the
vehicular and stationary lights and effect of such lights on established character of the
neighborhood; location, lighting, and types of signs and relation of signs to traffic control
and adjacent property, street size and adequacy of width for traffic reasonably expected to
be generated by the proposed use around the site and in the immediate neighborhood;
adequacy of parking as determined by requirements of this ordinance for off-street parking
facilities; location of ingress and egress points for parking and off-street locating spaces,
and protection of public health by surfacing on all parking areas to control dust; effect on
the promotion of health and the general welfare; effect on light and air; the effect on the
overcrowding of the land; the effect on the concentration of population; the effect on the
transportation, water, sewerage, schools, parks and other facilities; and
WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing
called by the City Council of the City of Grapevine, Texas, did consider the following
factors in making a determination as to whether this requested conditional use permit
should be granted or denied; effect on the congestion of the streets, the fire hazards,
panics and other dangers possibly present in the securing of safety from same, the effect
on the promotion of health and the general welfare, effect on adequate light and air, the
effect on the overcrowding of the land, the effect on the concentration of population, the
effect on the transportation, water, sewerage, schools, parks and other public facilities;
and
WHEREAS, all of the requirements of Section 48 of Ordinance No. 82-73 have been
satisfied by the submission of evidence at a public hearing; and
WHEREAS, the City Council further considered among other things the character of
the existing zoning district and its peculiar suitability for particular uses and with the view
to conserve the value of buildings and encourage the most appropriate use of land
throughout this City; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that there is
a public necessity for the granting of this conditional use permit, that the public demands it,
that the public interest clearly requires the amendment, that the zoning changes do not
unreasonably invade the rights of those who bought or improved property with reference to
the classification which existed at the time their original investment was made; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that the
conditional use permit lessens the congestion in the streets, helps secure safety from fire,
panic and other dangers, prevents the overcrowding of land, avoids undue concentration
of population, facilitates the adequate provisions of transportation, water, sewerage,
schools, parks and other public requirements; and
WHEREAS, the City Council of the City of Grapevine, Texas, has determined that
there is a necessity and need for this conditional use permit and has also found and
determined that there has been a change in the conditions of the property surrounding and
in close proximity to the property requested for a change since this property was originally
classified and, therefore, feels that the issuance of this conditional use permit for the
particular piece of property is needed, is called for, and is in the best interest of the public
at large, the citizens of the City of Grapevine, Texas, and helps promote the general
health, safety and welfare of this community.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That the City does hereby issue a conditional use permit in
accordance with Section 48 of Ordinance No. 82-73, the Comprehensive Zoning
Ordinance of the City of Grapevine, Texas, same being also known as Appendix "D" of the
City Code, by granting Conditional Use Permit CU21-14 to allow the possession, storage,
retail sale and off -premise consumption of alcoholic beverages (beer, wine, and mixed
beverages) in conjunction with a commercial kitchen with delivery and pick-up service only
in a district zoned "CC" Community Commercial District within the following described
property: Lot 2, Block 1, Northpoint Addition (2850 State Highway 121) all in accordance
with a site plan approved pursuant to Section 47 of Ordinance No. 82-73, attached hereto
and made a part hereof as Exhibit "A", and all other conditions, restrictions, and
safeguards imposed herein, including but not limited to the following: None.
Section 2. That the City Manager is hereby directed to amend the official zoning
map of the City of Grapevine, Texas, to reflect the herein conditional use permit.
Section 3. That in all other respects the use of the tract or tracts of land herein
above described shall be subject to all the applicable regulations contained in said City of
Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City
of Grapevine, Texas.
Section 4. That the zoning regulations and districts as herein established have
been made in accordance with the comprehensive plan for the purpose of promoting
health, safety, morals and the general welfare of the community. They have been
designed with respect to both present conditions and the conditions reasonably anticipated
to exist in the foreseeable future; to lessen congestion in the streets, to secure safely from
fire, panic, flood and other dangers; provide adequate light and air; to prevent
overcrowding of land, to avoid undue concentration of population; facilitate the adequate
provisions of transportation, water, sewerage, drainage and surface water, parks and other
public requirements, and to make adequate provisions for the normal business,
commercial needs and development of the community. They have been made with
reasonable consideration, among other things, of the character of the district, and its
peculiar suitability for the particular uses and with a view of conserving the value of
buildings and encouraging the most appropriate use of land throughout the community.
Section 5. That this ordinance shall be cumulative of all other ordinances of the
City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of
said ordinances except in those instances where provisions of those ordinances which are
in direct conflict with the provisions of this ordinance.
Section 6. That the terms and provisions of this ordinance shall be deemed to be
severable and that if the validity of the zoning affecting any portion of the tract or tracts of

land described herein shall be declared to be invalid, the same shall not affect the validity
of the zoning of the balance of the tract or tracts of land described herein.
Section 7. That any person violating any of the provisions of this ordinance shall
be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum
not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed
committed upon each day during or on which a violation occurs or continues.
Section 8. That the fact that the present ordinances and regulations of the City of
Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace
and general welfare of the inhabitants of the City of Grapevine, Texas, creates an
emergency for the immediate preservation of the public business, property, health, safety
and general welfare of the public which requires that this ordinance shall become effective
from and after the date of its final passage, and it is accordingly so ordained.

parking of delivery vehicles in the "CC" Community Commercial District within the following
described property: Lot 2, Block 1, North Point Addition (2850 State Highway 121) all in
accordance with a site plan approved pursuant to Section 47 of Ordinance No. 82-73,
attached hereto and made a part hereof as Exhibit "A", and all other conditions,
restrictions, and safeguards imposed herein, including but not limited to the following:
None.
Section 2. The City Manager is hereby directed to amend the official zoning map
of the City of Grapevine, Texas, to reflect the herein conditional use permit.

On behalf of Crave Delivery, Inc., Kimley-Horn is pleased to submit the enclosed applications for a
Conditional Use and Site Plan approval and a Planned Development Overlay to develop a Crave
Delivery facility at 2850 North State Hwy 121 in Grapevine. The subject property is currently zoned
"CC" Community Commercial. This site plan for Crave Delivery has been submitted as a Conditional
Use Permit (CU21-14) to allow for the possession, storage, retail sale and off -premise consumption of
alcoholic beverages (beer, wine, and mixed beverages) in conjunction with a commercial kitchen with
delivery and pick-up service only. This site plan for Crave Delivery has also been submitted as a
Planned Development Overlay (PD21-02) to allow for adapted parking requirements for the overnight
parking of delivery vehicles.
Each Crave Collective houses up to 16 restaurant partners who create their most popular dishes for
consumer pickup or delivery by employee servers. The proposed Crave Delivery will not cause
substantial harm, but will add to the value, use, and enjoyment of other property in the neighborhood.
The design of the site includes ample parking screening to limit congestion near the key visibility
corridor of SH 121 and ensures an attractive design will remain in place, and the site is estimated to
generate only 400 trips per 18-hour workday.
The greater Grapevine delivery area will be served by the meals prepared in this facility that functions
with minimal office space, and large, open preparatory area with local staff. This development will
substantially increase the land value in the area, with each facility bringing dozens of high -quality W2
jobs to the community and an estimated $20 million in annual revenue.
Ordering from Crave Delivery
Customers wishing to order from Crave Delivery locations have the option of ordering through a
downloaded mobile app or through the Crave! Website. Customers who are unable to order through

these services may also phone Crave Customer Service directly to place an order. All orders are
digital with no option to pay in cash. Customers may choose to have their order delivered by a Crave
Driver or to pick up an order for themselves at the facility.
Parking and Pickup
Customers picking up food at the Crave Delivery Grapevine facility will enter the site from State Hwy
221 using the drive lane on the south end of the site, park on the south end of the building in the nine
curb cut parking stalls, designated with "Crave! Pickup' signage, directly adjacent to the south end of
the building. They will exit their vehicle and enter the facility through the doors under the port-cochere
on the west side of the building to be greeted by the Crave pickup host who will match them with their
order. Customers will return to their vehicle and use the same drive lanes to return to State Hwy 221
for their exit from the site.
Delivery Vehicle Parking
This site will be supported with 30 Crave! Delivery vehicles (current model year Nissan Kicks
hatchback) that will be parked behind the southeast side of the building using the eleven stalls closest
to the building, the next twelve stalls immediately adjacent across the fire lane and seven stalls
directly adjacent to those to the southwest as shown on the Site Plan. The delivery vehicles will be
screened from Highway 121 by the building, landscaping and dumpster enclosures.
House of Operation
The hours of operation for this facility are 8:00 am-8:30 pm Monday through Thursday and 10:00 am -
8:30 pm Friday through Sunday of each week.
Crave Delivery is very excited about the prospect of serving the Grapevine community. We believe our

having been complied with, the case having come before the City Council of the City of

WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing
called by the City Council did consider the following factors in making a determination as
to whether this requested conditional use permit should be granted or denied: safety of the
motoring public and the pedestrians using the facilities in the area immediately
surrounding the site; safety from fire hazards and measures for fire control; protection of
adjacent property from flood or water damages, noise producing elements, and glare of the
vehicular and stationary lights and effect of such lights on established character of the
neighborhood; location, lighting, and types of signs and relation of signs to traffic control
and adjacent property, street size and adequacy of width for traffic reasonably expected to
be generated by the proposed use around the site and in the immediate neighborhood;
adequacy of parking as determined by requirements of this ordinance for off-street parking
facilities; location of ingress and egress points for parking and off-street locating spaces,
and protection of public health by surfacing on all parking areas to control dust; effect on
the promotion of health and the general welfare; effect on light and air; the effect on the
overcrowding of the land; the effect on the concentration of population; the effect on the
transportation, water, sewerage, schools, parks and other facilities; and
WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing
called by the City Council of the City of Grapevine, Texas, did consider the following
factors in making a determination as to whether this requested conditional use permit
should be granted or denied; effect on the congestion of the streets, the fire hazards,
panics and other dangers possibly present in the securing of safety from same, the effect
on the promotion of health and the general welfare, effect on adequate light and air, the
effect on the overcrowding of the land, the effect on the concentration of population, the
effect on the transportation, water, sewerage, schools, parks and other public facilities;
and
WHEREAS, all of the requirements of Section 48 of Ordinance No. 82-73 have been
satisfied by the submission of evidence at a public hearing; and
WHEREAS, the City Council further considered among other things the character of
the existing zoning district and its peculiar suitability for particular uses and with the view
to conserve the value of buildings and encourage the most appropriate use of land
throughout this City; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that there is
a public necessity for the granting of this conditional use permit, that the public demands it,
that the public interest clearly requires the amendment, that the zoning changes do not
unreasonably invade the rights of those who bought or improved property with reference to
the classification which existed at the time their original investment was made; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that the
conditional use permit lessens the congestion in the streets, helps secure safety from fire,
panic and other dangers, prevents the overcrowding of land, avoids undue concentration
of population, facilitates the adequate provisions of transportation, water, sewerage,
schools, parks and other public requirements; and
WHEREAS, the City Council of the City of Grapevine, Texas, has determined that
there is a necessity and need for this conditional use permit and has also found and
determined that there has been a change in the conditions of the property surrounding and
in close proximity to the property requested for a change since this property was originally
classified and, therefore, feels that the issuance of this conditional use permit for the
particular piece of property is needed, is called for, and is in the best interest of the public
at large, the citizens of the City of Grapevine, Texas, and helps promote the general
health, safety and welfare of this community.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That the City does hereby issue a conditional use permit in
accordance with Section 48 of Ordinance No. 82-73, the Comprehensive Zoning
Ordinance of the City of Grapevine, Texas, same being also known as Appendix "D" of the
City Code, by granting Conditional Use Permit CU21-14 to allow the possession, storage,
retail sale and off -premise consumption of alcoholic beverages (beer, wine, and mixed
beverages) in conjunction with a commercial kitchen with delivery and pick-up service only
in a district zoned "CC" Community Commercial District within the following described
property: Lot 2, Block 1, Northpoint Addition (2850 State Highway 121) all in accordance
with a site plan approved pursuant to Section 47 of Ordinance No. 82-73, attached hereto
and made a part hereof as Exhibit "A", and all other conditions, restrictions, and
safeguards imposed herein, including but not limited to the following: None.
Section 2. That the City Manager is hereby directed to amend the official zoning
map of the City of Grapevine, Texas, to reflect the herein conditional use permit.
Section 3. That in all other respects the use of the tract or tracts of land herein
above described shall be subject to all the applicable regulations contained in said City of
Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City
of Grapevine, Texas.
Section 4. That the zoning regulations and districts as herein established have
been made in accordance with the comprehensive plan for the purpose of promoting
health, safety, morals and the general welfare of the community. They have been
designed with respect to both present conditions and the conditions reasonably anticipated
to exist in the foreseeable future; to lessen congestion in the streets, to secure safely from
fire, panic, flood and other dangers; provide adequate light and air; to prevent
overcrowding of land, to avoid undue concentration of population; facilitate the adequate
provisions of transportation, water, sewerage, drainage and surface water, parks and other
public requirements, and to make adequate provisions for the normal business,
commercial needs and development of the community. They have been made with
reasonable consideration, among other things, of the character of the district, and its
peculiar suitability for the particular uses and with a view of conserving the value of
buildings and encouraging the most appropriate use of land throughout the community.
Section 5. That this ordinance shall be cumulative of all other ordinances of the
City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of
said ordinances except in those instances where provisions of those ordinances which are
in direct conflict with the provisions of this ordinance.
Section 6. That the terms and provisions of this ordinance shall be deemed to be
severable and that if the validity of the zoning affecting any portion of the tract or tracts of

land described herein shall be declared to be invalid, the same shall not affect the validity
of the zoning of the balance of the tract or tracts of land described herein.
Section 7. That any person violating any of the provisions of this ordinance shall
be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum
not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed
committed upon each day during or on which a violation occurs or continues.
Section 8. That the fact that the present ordinances and regulations of the City of
Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace
and general welfare of the inhabitants of the City of Grapevine, Texas, creates an
emergency for the immediate preservation of the public business, property, health, safety
and general welfare of the public which requires that this ordinance shall become effective
from and after the date of its final passage, and it is accordingly so ordained.

OVERLAY PERMIT; PROVIDING A PENALTY NOT TO
EXCEED THE SUM OF TWO THOUSAND DOLLARS
($2,000.00); DECLARING AN EMERGENCY AND
PROVIDING AN EFFECTIVE DATE
WHEREAS, an application was made requesting issuance of a planned
development overlay by making applications for same with the Planning and Zoning
Commission of the City of Grapevine, Texas, as required by State statutes and the zoning
ordinance of the City of Grapevine, Texas, and all the legal requirements, conditions and
prerequisites having been complied with, the case having come before the City Council of
the City of Grapevine, Texas, after all legal notices requirements, conditions and
prerequisites having been complied with; and
WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing
called by the City Council did consider the following factors in making a determination as
to whether this requested planned development overlay should be granted or denied:
safety of the motoring public and the pedestrians using the facilities in the area
immediately surrounding the site; safety from fire hazards and measures for fire control;
protection of adjacent property from flood or water damages, noise producing elements,
and glare of the vehicular and stationary lights and effect of such lights on established
character of the neighborhood; location, lighting, and types of signs and relation of signs to
traffic control and adjacent property; street size and adequacy of width for traffic
reasonably expected to be generated by the proposed use around the site and in the
immediate neighborhood; adequacy of parking as determined by requirements of this
ordinance for off-street parking facilities; location of ingress and egress points for parking
and off-street locating spaces, and protection of public health by surfacing on all parking
areas to control dust, effect on the promotion of health and the general welfare; effect on
light and air; the effect on the overcrowding of the land; the effect on the concentration of
population; the effect on the transportation, water, sewerage, schools, parks and other
facilities; and
WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing
called by the City Council of the City of Grapevine, Texas, did consider the following
factors in making a determination as to whether this requested planned development
overlay should be granted or denied; effect on the congestion of the streets, the fire
hazards, panics and other dangers possibly present in the securing of safety from same,
the effect on the promotion of health and the general welfare, effect on adequate light and
air, the effect on the overcrowding of the land, the effect on the concentration of
population, the effect on the transportation, water, sewerage, schools, parks and other
public facilities; and
WHEREAS, all of the requirements of Section 41 of Ordinance No. 82-73 have been
satisfied by the submission of evidence at a public hearing; and
WHEREAS, the City Council further considered among other things the character of
the existing zoning district and its peculiar suitability for particular uses and with the view
to conserve the value of buildings and encourage the most appropriate use of land
throughout this City; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that there is
a public necessity for the granting of this planned development overlay, that the public
demands it, that the public interest clearly requires the amendment, that the zoning
changes do not unreasonably invade the rights of those who bought or improved property
with reference to the classification which existed at the time their original investment was
made; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that the
planned development overlay lessens the congestion in the streets, helps secure safety
from fire, panic and other dangers, prevents the overcrowding of land, avoids undue
concentration of population, facilitates the adequate provisions of transportation, water,
sewerage, schools, parks and other public requirements; and
WHEREAS, the City Council of the City of Grapevine, Texas, has determined that
there is a necessity and need for this planned development overlay and has also found
and determined that there has been a change in the conditions of the property surrounding
and in close proximity to the property requested for a change since this property was
originally classified and, therefore, feels that the issuance of this planned development
overlay for the particular piece of property is needed, is called for, and is in the best
interest of the public at large, the citizens of the City of Grapevine, Texas, and helps
promote the general health, safety and welfare of this community.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That the City does hereby issue a planned development overlay in
accordance with Section 41 of Ordinance No. 82-73, the Comprehensive Zoning
Ordinance of the City of Grapevine, Texas, same being also known as Appendix "D" of the
City Code, by granting Planned Development Overlay No. PD21-02 to allow overnight
parking of delivery vehicles in the "CC" Community Commercial District within the following
described property: Lot 2, Block 1, North Point Addition (2850 State Highway 121) all in
accordance with a site plan approved pursuant to Section 47 of Ordinance No. 82-73,
attached hereto and made a part hereof as Exhibit "A", and all other conditions,
restrictions, and safeguards imposed herein, including but not limited to the following:
None.
Section 2. The City Manager is hereby directed to amend the official zoning map
of the City of Grapevine, Texas, to reflect the herein conditional use permit.
Section 3. That in all other respects the use of the tract or tracts of land herein
above described shall be subject to all the applicable regulations contained in said City of
Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City
of Grapevine, Texas.
Section 4. That the zoning regulations and districts as herein established have
been made in accordance with the comprehensive plan for the purpose of promoting
health, safety, morals and the general welfare of the community. They have been
designed with respect to both present conditions and the conditions reasonably anticipated
to exist in the foreseeable future; to lessen congestion in the streets, to secure safely from
fire, panic, flood and other dangers; provide adequate light and air; to prevent
overcrowding of land, to avoid undue concentration of population; facilitate the adequate
provisions of transportation, water, sewerage, drainage and surface water, parks and other
public requirements, and to make adequate provisions for the normal business,
commercial needs and development of the community. They have been made with
reasonable consideration, among other things, of the character of the district, and its
peculiar suitability for the particular uses and with a view of conserving the value of
buildings and encouraging the most appropriate use of land throughout the community.
Section 5. This ordinance shall be cumulative of all other ordinances of the City
of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said
ordinances except in those instances where provisions of those ordinances which are in
direct conflict with the provisions of this ordinance.
Section 6. That the terms and provisions of this ordinance shall be deemed to be
severable and that if the validity of the zoning affecting any portion of the tract or tracts of
land described herein shall be declared to be invalid, the same shall not affect the validity
of the zoning of the balance of the tract or tracts of land described herein.

Section 7. Any person violating any of the provisions of this ordinance shall be
deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to
exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed
committed upon each day during or on which a violation occurs or continues.
Section 8. The fact that the present ordinances and regulations of the City of
Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace
and general welfare of the inhabitants of the City of Grapevine, Texas, creates an
emergency for the immediate preservation of the public business, property, health, safety
and general welfare of the public which requires that this ordinance shall become effective
from and after the date of its final passage, and it is accordingly so ordained.
