On September 9, 2013, the Building Board of Appeals approved Building Board of
Appeals Case BBA13-04 for 3055 West Kimball Avenue, legally described as Tract 1A,
Franklin Wood Survey. The following request was to Grapevine Code of Ordinances,
Chapter 7, Article IV:
Section 7-127, Fences, Front Yard Requirements, to allow a six-foot (6') pipe rail fence
within the required and established front yard as shown on the site plan.
A copy of the minutes will be available after they have been approved at the next regular

RECOMMENDATION:
Staff recommends the Building Board of Appeals Approve the following request
to City of Grapevine Code of Ordinances, Chapter 7, Article IV, Fences, for
property addressed as 3055 West Kimball Avenue, legally described as Tract 1A,
Franklin Wood Survey:
Section 7-127, Fences, Front Yard Requirements, requires fences constructed in
a required or established front yard to be 36 inches or less in height, and have at
least 50 percent through vision.
The applicant is requesting to construct a six-foot tall (6) cattle panel fence with
more than 50 percent through vision within the required and established front
yard.
SPECIAL CONDITION:
Staff feels special conditions exist for this request. This property is not located
within a typical residential subdivision, being over seven (7) acres in size.
Additionally, much of the property is within flowage easement, and would be
difficult if not impossible to develop. This makes the proposed agricultural use
appropriate, and the applicant has stated the fence is necessary to contain
animals.
BACKGROUND INFORMATION:
The application was submitted by property owner Lynn Fitzgerald. The Board
has approved fences that exceed three -feet (3') in front yards along Kimball in
the past.

Dear Sirs:
I have applied for a fence permit to fence the 750 feet of road frontage of the property at 3055 W
Kimball Avenue. Because this is a front yard, I need to apply for a variance for a fence taller than 3
feet.
This is a 7 acre property and I plan to keep Welsh ponies, so I hope you will be willing to grant a
variance to permit a 6 foot panel fence. I want to make sure the ponies don't get out to Kimball
road. The panels are cattle panels (heavy 4x4 wire), reinforced with pipe surrounds. T posts will be
used every 10 feet for support. These are completely see through and will not obstruct the line of
sight.
There is no house or any other structure on the property at this time. I do eventually plan to
construct a house, which will be situated approximately 340 feet off of Kimball road, on the east
side of the property. The driveway will exit onto Kimball. The home construction may not start for
up to 2 years.
I have attached copies of the most recent survey from 2013, and also the previous survey which
shows the flowage easement elevations. The proposed fence, house site and road are marked. I have
also attached photos looking along the property to the east and west from the same side and
opposite side of the street while standing in what will be the driveway opening. A drawing showing
the fence specifications and photo of sample panels is also attached.
Much of the property is under a flowage easement from the Corp of Engineers. Because this is a
wire fence, permission to construct it is not needed from them, but at the request of the City I have
obtained a letter stating that the Corp has no objections to the fence. I will bring the Corp
regulations and letter to the meeting in case you wish to review those.

Sec. 7-127. Front yard requirements.
(a) Corner lots: It shall be unlawful to erect a fence in the required front yard building
setback area or the established front yard area, whichever area is greater in depth, on any
corner lot, except along the interior lot line in accordance with subsection (b).
(b) Interior lots:
(1) It shall be unlawful to erect a fence, hedge or vines over 36 inches in height
in the required front yard area or the established front yard area, whichever area is
greater in depth, on any interior lot.
(2) It shall be unlawful to erect a fence, hedge or vines in the required front yard
area or the established front yard area, whichever area is greater in depth, on any
interior lot that does not have at least 50 percent through vision.
(3) It shall be unlawful to maintain a fence, hedge or vines in the required front
yard area or an established front yard area, whichever area is greater in depth, of
an interior lot in a manner that does not permit at least 50 percent through vision.
(4) For the purpose of this section, "established front yard area" shall mean an
open, unoccupied space on a lot facing a street and extending across the front of a
lot between the side yard lines and extending from the abutting street to a
principal building or structure. The phrase "required front yard" shall have the
meaning ascribed to it in the Grapevine Zoning Ordinance No. 82-73.

PUBLIC HEARING
BUILDING BOARD OF APPEALS TO CONSIDER BUILDING BOARD OF APPEALS
CASE BBA13-04, LYNN FITZGERALD
The Building Board of Appeals considered BBA13-04 submitted by Lynn Fitzgerald, for
property located at 3055 West Kimball Avenue, legally described as Tract 1A, Franklin
Wood Survey. The request was to Grapevine Code of Ordinances, Chapter 7, Article
IV, Fences:
Section 7-127, Fences, Front Yard Requirements, requires fences constructed in
a required or established front yard to be 36 inches or less in height, and have at
least 50 percent through vision.
Scott Williams explained that Staff recommended the Building Board of Appeals
approve the applicant's request for approval of a six-foot tall (6) cattle panel fence with
more than 50 percent through vision within the required and established front yard.
Mr. Williams explained that Staff found a special condition existed for the request.
Specifically, the property was not located within a typical residential subdivision, being
over seven (7) acres in size.
He stated that a large portion of the property was in a flowage easement and could not
be developed. The property was adjacent to a busy street and the proposed request
was to contain animals and keep predators off of the property. He further stated that the

Board had approved fences that exceeded three -feet (3') in front yards along Kimball
Avenue in the past.
Joe Lipscomb asked Mr. Williams if the variance requested was only for the portion of
the property that fronted Kimball Avenue. Mr. Williams stated, that was correct, the
variance requested was only for the frontage along Kimball Avenue, any portion of a
fence within the 25 -foot required front yard or in front of a future residence required a
variance if it exceeded three -feet (3') in height.
With no further questions for Mr. Williams, applicant Dr. Lynn Fitzgerald of 216 North
Teague Street, Longview, Texas addressed the Board. She explained the purpose of
her requested variance was to contain five (5) aging Welsh ponies. The ponies had
been known to jump fences and wanted to prevent them from getting out onto Kimball
Avenue; as well as preventing Coyotes and other predators from coming onto the
property.
She further stated she wanted to clarify misunderstandings the surrounding neighbors
had about her requested variance. She explained that the request was for Kimball
Avenue not Cliffside. She presented two (2) additional options for fencing to the Board,
one being a four -foot (4') Cattle Panel fence instead of the requested six-foot (6') Cattle
Panel fence and the second being a six-foot (6) Pipe Rail fence. She requested
favorable consideration of her request and offered to answer any questions of the
Board.
With no questions for Dr. Fitzgerald, Mr. Gary Kohr, of 2801 Cliffside Court, addressed
the Board. He. explained that he and the surrounding neighbors were under the
impression that the entire property was being fenced to contain livestock. He stated that
if the only portion that was to be fenced was along Kimball Avenue there were no
issues.
Russell Kidd asked Mr. Williams if the applicant could fence the remaining property
without a variance request. Mr. Williams explained to the Board that the applicant could
fence her property without a variance by right as long as it was not in the required or
established front yard.
With no further questions for Mr. Williams, Mr. Eddy Morris, of 2813 Cliffside Court,
addressed the Board. He requested clarification of the location of the fence in regards
to Cliffside Court. Mr. Lipscomb explained to Mr. Morris that the applicant could
construct a fence on her property in her rear yard as long as it complied with the fence
ordinance.
Mr. Williams explained that the applicant could construct a fence up to eight -feet (8') in
her side and rear yard without having to apply for a variance. The only request before
the Board was for a fence that exceeded three -feet (3') along Kimball Avenue.
With no questions for Mr. Morris, Mr. Gary Kohr, of 2801 Cliffside Court, re -addressed
the Board. He expressed concerns of the neighbors regarding the potential of a
livestock fence.

expressed his concerns and disapproval about the development of subject property.
With no further questions for Mr. Thompson, and no additional speakers, Jerrold Sklar

prevailed by the following vote:
