REQUESTED ZONE CHANGE AND CONDITIONAL USE AND COMMENTS: The applicant is requesting a zone change to rezone 1.009 acres from "LI" Light Industrial District to "CC" Communitv Commercial District for an existing car wash. Conditional Use Request CU09-34 is a request to re-establish an existing car wash and construct a new automobile lube center (Mustang Elite Car Wash and Lube Center) on a reconfigured lot, vacate the existing lube center (to be used as future automotive reaair) and allow for one 20 -foot pole sign As a result of the planned future widening of Ira E. Woods Avenue/State Highway 26, the applicant requests to rezone a vacant portion of the subject site, re-establish the location of the automobile lube center to the undeveloped site to the east, and install one pole sign. The portion of the subject site which is developed with the car wash and the current automobile lube center is zoned "LI" Light Industrial District; the proposed zone change 0:/ZCU/CU09-34.4/Z09-06.4 October 15, 2009 (9:25AM) request will change the zoning to "CC" Community Commercial District and establish consistent zoning throughout the site. An existing monument sign will be removed upon commencement of the road widening and a 20 -foot, 98.77 square foot pole sign is proposed on the subject site as a replacement sign. This "taking" eliminates the use of the current Mustang Elite Lube Center building as it was originally intended and in its current use. Also negatively impacted are the access entry, dry down and exit to the existing Mustang Elite Car Wash. The combined car wash and lube center was built in 1994 and have been providing continuous service to not only the Grapevine residents but also the adjacent Colleyville and Southlake Communities. In January 2007 Eric and Jenny Warden entered into a letter of intent "L.OI" to purchase the assets of Mustang Elite Car Wash & Lube Center. During the "due diligence" the imminent "taking" for the highway 26 project proved to pose a problem for the survival of the business as currently structured on a long term basis. The State confirmed that it would acquire approximately 68 feet of frontage of the 2125 Ira E Woods property. This "taking" will terminate the use of the existing lube center. The State also confirmed the "taking" will damage the operation of the car wash to the extent the properties "highest and best use" will be permanently downgraded. Preserve the Business: Mr. Warden met with Mr. Jerry Hodge Director of Transportation Projects to discuss options to preserve the business. Mr. Hodge was very optimistic that the City of Grapevine shared the same goal to protect the long standing business for both service to the community as well as the tax revenue generated. Action Plan Initiated: K8r. Warden & K4c Hodge discussed the purchase of the vacant land adjacent to the car wash. The plan is to re -build the lube center and to re -develop the {o1 so the car wash can maintain its operations. The points of concern requiring exception discussed with Mr. Hodge with regards to the development of the new site are listed below. Mr. Hodge agreed with the overall logic and supported this endeavor. 1. Landscape set back requirement in front on both properties. Without an exception the car wash is in operable. There isn't enough room from the new right of way line "ROW" to manage cars exiting the car wash tunnel. 2. Rear cross access. This can only be achieved through an exception to build up to the near property line. Mr. Warden had numerous meetings and conversations over many months with Mr. ScottHall the right of way coordinator "TxD8T", Curtis bzftis the design engineer °TxDOT" in addition to Mr. Jerry Hodge Director of Transportation Projects with the City of Grapevine with regard to all of these challenges. With verbal agreement by all that the plans, suggestions and needs were all reasonable and viable Mr. Warden moved forward with the acquisition of Mustang Elite Car Wash 0' Lube Center along with the acquisition and development ofthe adjacent property. Mr. Warden is requesting "exception" as listed. Once approved Mr. Warden will begin construction to relocate the lube center on the acquired property along with the development of the access to entry/exit for the combined car wash & lube center. This will allow service to be continuous for customers ottoday's standards with as little disruption as possible during the Highway project. The net result will be continued service for the community, continued employment for approximately 50 plus dedicated workers, increase in tax base for Grapevine and a successful locally owned and operated business.
