Zoning Adjustment Case BZA21-07 submitted by Anthony and Vivian McNosky
for property located at 414 Smith Street and consideration of same.
6. Board of Zoning Adjustment to conduct a public hearing relative to Board of
Zoning Adjustment Case BZA21-08 submitted by James Gravatt for property
located at 848 East Texas Street and consideration of same.
7. Board of Zoning Adjustment to conduct a public hearing relative to Board of
Zoning Adjustment Case BZA21-09 submitted by Christopher Morey for
property located at 1321 Pine Street and consideration of same.

The Board of Zoning Adjustment for the City of Grapevine, Texas, met on Monday
evening, September 13, 2021, at 6:00 P.M. in the Planning and Zoning Conference
Room, 2"d Floor, 200 South Main Street, Grapevine, Texas for a Briefing Session with

Vice -Chairman Sheppard called the Briefing Session of the Board of Zoning Adjustment
to order at approximately 6:00 P.M.

Albert Triplett briefed the Board of Zoning Adjustment regarding the items scheduled to
be heard in the regular public hearing.
ADJOURNMENT OF BRIEFING SESSION
With no further discussion, George Dalton made a motion to adjourn the Briefing
Session. John Borley seconded the motion which prevailed by the following vote:

The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular
session, Monday evening, September 13, 2021, at 6:15 P.M., in the Council Chambers,
2nd Floor, 200 South Main Street, Grapevine, Texas with the following members
present:

Vice Chairman John Sheppard called the Public Hearing Session of the Board of Zoning
Adjustment to order at approximately 6:24 P.M.

For office of Chairman, George Dalton nominated Ben Johnson. John Borley seconded
the nomination. Doug Anderson nominated John Sheppard, there was no second. The
motion which prevailed by the following vote:

Nays: Anderson, Sheppard
Absent: None
Abstain: None
Ben Johnson was elected as Chairman.
For office of Vice -Chairman, John Sheppard nominated Doug Anderson. John Borley
seconded the motion which prevailed by the following vote:

PUBLIC HEARING
Chairman Ben Johnson called the Public Hearing of the Board of Zoning Adjustment to
order at approximately 6:30 P.M.
ITEM 4. CITIZEN COMMENTS
There was no one wishing to speak during citizen comments.
NEW BUSINESS
ITEM 5: BOARD OF ZONING ADJUSTMENT CASE BZA21-07, ANTHONY AND.
VIVIAN MCNOSKY, 414 SMITH STREET
The first item for the Board of Zoning Adjustment to consider was BZA21-07 submitted
by Anthony and Vivian McNosky for property located at 414 Smith platted as South 60
feet of Lot 5, Block 32, City of Grapevine Addition
Section 15.F.2., "R-7.5" Single Family District, Density Requirements, requires a
minimum lot area of 7,500 sq. ft. The applicant requested a variance of 900 sq. ft. and
allowing a lot area of 6,600 sq. ft. for an existing lot.
Section 15.G.4., "R-7.5" Single Family District, Area Regulations, requires a
minimum lot width of sixty-five feet (65'). The applicant requested a variance of five -
feet (5') allowing lot width of sixty -feet (60') for an existing lot.
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The applicant requested a special exception allowing the existing detached
accessory structure to remain as developed as shown on the plot plan.

Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The applicant requested a special exception to relocate existing carport supports
and encroach into the required six-foot (6) side yard setback as shown on the plot plan.
Mr. Triplett explained that Staff found special conditions existed for the requested
variances and special exception for the existing detached accessory structure (garage).
Specifically, the subject lot was originally platted in 1921 predating the City's first zoning
ordinance adopted in 1955. Developed, platted property and right-of-way existed
adjacent to the subject site, on the north, south, west and east property lines
respectively, eliminating the possibility to expand the site to meet the area and width
requirements. The existing detached garage was built in 1950 prior to the rezoning of
the subject site in the 1984 City Rezoning to "R-7.5" Single Family District. The location
of the existing detached garage would remain nonconforming. Staff found no special
condition existed that would have allowed the relocation of the existing carport supports
into the required six-foot (6) side yard setback as shown on the plot plan.
With no questions for Mr. Triplett, Vivian McNosky of 508 Pleasant Run Road,
Colleyville, Texas, took the Oath of Truth; he gave a brief presentation to the Board and
requested favorable consideration of his request and offered to answer any questions of
the Board.
John Sheppard asked if the property was rental property. Mrs. McNosky stated, that it
was currently rental property but planned to move back into the home.
With no further questions for Mr. McNosky, Doris Bateman of 422 Smith Street,
Grapevine, Texas took the Oath of Truth; she stated that she lived next door to the
subject property, she voiced her concerns if the carport post were to be allowed to be
relocated, she requested the Board deny the request.
With no questions for Ms. Bateman, City Council Representative Sharron Rogers of
3214 Wintergreen Court, Grapevine, Texas took the Oath of Truth; she reminded the
Board of their responsibilities as a Board.
With no questions for Ms. Rogers and no additional speakers, John Borley made a
motion to close the public hearing. John Sheppard seconded the motion which prevailed
by the following vote:
Ayes: Johnson, Anderson, Dalton, Sheppard, Borley
Nays: None
Absent: Gaspard
John Borley made a motion that special conditions existed for the requested variances

ITEM 6: BOARD OF ZONING ADJUSTMENT CASE BZA21.08, JAMES GRAVATT,
848 EAST TEXAS STREET
The next item for the Board of Zoning Adjustment to consider was BZA21-08 submitted
by James Gravatt for property located 848 East Texas Street, platted as Lot 7, Block 5,
D.E. Box Addition.
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The applicant requested a special exception allowing the existing residential
structure to remain as developed along with an expansion as shown on the plot plan.
Mr. Triplett explained that Staff found a special condition existed for the requested
special exception. Specifically, the subject site was an existing developed lot, and the
existing dwelling was built in 1949 predating the City's first zoning ordinance adopted in

1955. Currently and as proposed the site was noncompliant with the current Zoning
Ordinance (82-73) relative to the required six-foot (6') side yard setback adjacent to the
east property line. The proposed expansion of the dwelling did not exacerbate the
existing side yard seatback adjacent to the east property line of approximately four -feet
(4').
Mr. Triplett stated that the applicant intended to expand the existing dwelling from by
adding 333 square -foot of additional living area to the south side of the dwelling, located
in the rear yard, adjacent to the south property line. On June 30, 2021, the Historic
Preservation Commission approved Certificate of Appropriateness (CA21-32) that
allowed for the expansion.
With no questions for Mr. Triplett, James Gravatt of Rocking J Construction, of 840 East
Texas Street, Grapevine, Texas representing property owner Marjorie Huey, took the
Oath of Truth; he gave a brief presentation to the Board and requested favorable
consideration of his request and offered to answer any questions of the Board.
With no questions for Mr. Gravatt, and no additional speakers, John Sheppard made a
motion to close the public hearing. George Dalton seconded the motion which prevailed
by the following vote:
Ayes: Johnson, Anderson, Dalton, Sheppard, Borley
Nays: None

John Sheppard made a motion that a special condition existed for the requested special
exception. Specifically, the subject site was an existing developed lot, built in 1949

ITEM 7: BOARD OF ZONING ADJUSTMENT CASE BZA21-09. CHRISTOPHER
MOREY, 1321 PINE STREET
The next item for the Board of Zoning Adjustment to consider was BZA21-09 submitted
by Chrisopher Morey for property located 848 East Texas Street, 1321 Pine Street,
platted as Lot 4, Block 5, Sky Harbor Addition.
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The applicant requested a special exception allowing the existing residential
structure to remain as developed along with an expansion as shown on the plot plan.
Mr. Triplett explained that Staff found a special condition existed for the requested
special exception. Specifically, the subject site was an existing developed lot, and the
existing dwelling was built in 1956 prior to the rezoning of the subject site in the 1984
City Rezoning to "R-7.5" Single Family District. Currently and as proposed the site was
noncompliant with the current Zoning Ordinance (82-73) relative to the required six-foot
(6') side yard setback adjacent to the south property line. The proposed expansion of
the dwelling did not exacerbate the existing side yard setback adjacent to the south
property line of approximately four -feet (4').
Mr. Triplett stated that the applicant intended to expand the existing dwelling from
approximately 1,535-square feet, to approximately 1,760-square feet by demolishing an
existing 290-square foot converted attached garage and adding 515-square-foot of
additional living area to east side of the dwelling, located in the rear yard adjacent to the
east property line. An approximate 760-square foot detached garage was also proposed
in the rear yard adjacent to the east property line.
With no questions for Mr. Triplett, Christopher Morey, of 1321 Pine Street, Grapevine,
Texas, took the Oath of Truth; he gave a brief presentation to the Board and requested
favorable consideration of his request and offered to answer any questions of the
Board.
With no questions for Mr. Morey and no additional speakers, John Borley made a
motion to close the public hearing. George Dalton seconded the motion which prevailed
by the following vote:
Ayes: Johnson, Anderson, Dalton, Sheppard, Borley
Nays: None
Absent: Gaspard

exception. Specifically, the subject site was an existing developed lot, and the existing

ITEM 8: 2022 MEETING AGENDA CALENDAR
Next the Board of Zoning Adjustment considered the approval of the 2022 Meeting

Dalton seconded the motion which prevailed by the following vote:

ITEM 9: MINUTES
Next the Board of Zoning Adjustment considered the minutes of the July 12, 2021,
Briefing Session and Public Hearing.
George Dalton made a motion to accept the minutes of the July 12, 2021, Briefing
Session. John Borley seconded the motion which prevailed by the following vote:
Ayes: Johnson, Anderson, Dalton, Sheppard, Borley
Nays: None
