Proposal: The applicant is requesting a conditional use permit to amend
the previously approved site plan for an aquarium with on -premise alcohol beverage sales
in conjunction with a restaurant specifically to modify the layout of the proposed aquarium
which includes reorienting the structure, modifying the building elevations and eliminating

PROPERTY LOCATION AND SIZE:
The subject property is located at 423 South Main
Street and is platted as Lots 1, 2, and the south 23.5
feet of Lot 3, Block 18, Original Town of Grapevine.
The structure contains approximately 4,962 square
feet and has approximately 40 feet of frontage along
South Main Street, 95 feet of frontage along Franklin
Street, and 105 feet of frontage along Jenkins Street.
REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to allow for the possession, storage
retail sale, and on -premise consumption of alcoholic beverages (beer, wine and mixed
beverages) in conjunction with a restaurant.
The applicants intend to operate a restaurant (Tolbert's) in the former "Guest" building at
the northeast corner of South Main Street and Franklin Street. Approximately 58 parking
spaces are required. Four parking spaces will be created along Franklin Street.
Approximately 82 spaces are available in the "Foust" lot across Franklin Street to the south
and another 79 spaces are available in the "Market" lot located approximately 370 feet
north and east of the proposed restaurant. All total, approximately 228 parking spaces are
available within walking distance to serve the restaurant's needs.

PRESENT ZONING AND USE:
The property is zoned "CBD" Central Business District and is currently used as a retail
shop.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject property and surrounding areas were rezoned in the 1984 City Rezoning from
"C-2" Community Business District to "CBD" Central Business District. The subject
property is also located within a Historic Overlay District (1-11-92-03).
SURROUNDING ZONING AND EXISTING LAND USE:
NORTH: "CBD" Central Business District—various retail businesses
SOUTH: "CBD" Central Business District—various retail businesses
EAST: "CBD" Central Business District—various retail businesses
WEST: "CBD" Central Business District—various retail businesses
AIRPORT IMPACT:
The subject tract is located within "Zone A" zone of minimal effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. Few
activities will be affected by aircraft sounds in Zone A, except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal
is an appropriate use in this noise zone.
MASTER PLAN APPLICATION:
The Master Plan designates the subject property as a Central Business District land use.
The applicant's proposal is in compliance with the Master Plan.

Dear Paul and Kathleen:
This letter is to verify that your request for a conditional use permit located at 423 South Main Street and
platted as Lots 1, 2 and the south 23.5 feet of Lot 3, Block 18, City of Grapevine to allow for the
possession, storage, retail sale, and on -premise consumption of alcoholic beverages (beer, wine and
mixed drinks) in conjunction with a restaurant, was approved by the City Council and Planning and
Zoning Commission on October 18, 2005. A copy of Ordinance 2005-83 and approved site plan are
enclosed.
On October 18, 2005, the Planning and Zoning Commission, recommended the City Council approve
the request.
Any changes to a site plan approved with a conditional use or a special use (no matter how
minor or major) can only be approved by city council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on which
the City Council grants the Conditional Use, unless within such one (1) year period: (1) a Building Permit
is obtained and the erection or alteration of a structure is started, or (2) an Occupancy Permit is
obtained and a use commenced.
The City Council may grant one additional extension not exceeding one (1) year, upon written
application, without notice or hearing. No additional extension shall be granted without complying with
the notice and hearing requirements for an initial application for a Conditional Use Permit.

"Tolbert's" Restaurant will be a table service restaurant and bar. Tolbert's
is a Texas institution, established by the late Texas historian, journalist, author,
and chili aficionado, Frank X. Tolbert Sr., in Dallas in 1976. Known foremost for their
chili, Tolbert's operated in Dallas for 27 years. Frank X. Tolbert Sr. also co-founded the
Annual Terlingua Chili Cook -off in Terlingua Texas, in 1967. The event still takes place
the Is' Saturday in November. Tolbert's will be locally owned by Kathleen Tolbert Ryan,
and Paul Ryan, residents of Grapevine for over 10 years. The restaurant will compliment
the other businesses in the area, bringing more buyers to the local shops, and offering
additional dining choices. This will be a place that visitors will not find in their home
town. It is not a chain. It will be unique to Grapevine, and will bring continuing publicity
with the connection to Frank X. Tolbert, his writings, and the Annual Terlingua Chili
Cook -off. Tolbert's will offer Texas cuisine and regular specials.
