HomeMy WebLinkAboutItem 06 - Grapevine Township District MEMO TO: HONORABLE MAYOR, MEMBERS OF THE CITY COUNCIL AND PLANNING AND ZONING COMMISSION FROM: BRUNO RUMBELOW, CITY MANAGER MEETING DATE: OCTOBER 25, 2021 SUBJECT: RECEIVE A REPORT, HOLD A DISCUSSION, AND PROVIDE STAFF DIRECTION REGARDING INCLUDING COMMERCIAL PROPERTIES IN THE CERTIFICATE OF APPROPRIATENESS PROCESS FOR PROPERTIES LOCATED WITHIN THE HISTORIC GRAPEVINE TOWNSHIP DISTRICT (HGT). BACKGROUND: In 1991, the City of Grapevine adopted a Historic Preservation Ordinance in an effort to protect the city's rich, unique architectural heritage. The ordinance created the Historic Preservation Commission and a process for designating historic districts and landmarks. The city has the Historic Township District, five local historic districts and individual residential and commercial historic landmarks. Exterior alterations to residential buildings and properties within the Grapevine Historic Township District are required to conform to recommendations found in the district's design guidelines. The design review process for complying with these recommendations is through a request for a Certificate of Appropriateness (CA) from the Historic Preservation Commission. The City’s Historic Preservation Officer manages the CA process and various programs within Grapevine’s six districts and multiple landmarks. The Historic Preservation Department staff is seeking direction on a request to expand the requirements for a CA for exterior changes visible from the street to include commercially zoned properties located within the Historic Township Boundary. A CA would be required for new additions or demolition of building facades visible from the street. This would affect approximately 70 commercially zoned properties (See Exhibit A) RECOMENDATION: At the present time 70 commercially zoned properties receive no review for impact of applicant proposed changes visible from the street within the boundary of the Historic Township. These 70 properties are located on the perimeter and in the heart of the Historic Township. In order to provide the highest quality of professional services in the areas of comprehensive planning and research staff needs a tool that can help address and resolve issues during the planning process. Use of the existing Certificate of Appropriateness application form on commercial properties within the Historic Township would:  Create a seamless process for applicants for the review of their proposed changes to their properties in the Historic Township;  Save applicants time and money in the areas of comprehensive planning and research, and prevent re- submissions to the Planning and Zoning Department;  Ensure historic preservation standards are applied consistently to the entire historic Township district;  Allow for oversight and review of proposed changes to commercial properties on the perimeter and properties flanking Main Street, thus protecting the architectural integrity of the gateway and heart of the Historic Township. MEMO TO: HONORABLE MAYOR, MEMBERS OF THE CITY COUNCIL AND PLANNING AND ZONING COMMISSION FROM: BRUNO RUMBELOW, CITY MANAGER MEETING DATE: OCTOBER 25, 2021 SUBJECT: RECEIVE A REPORT, HOLD A DISCUSSION, AND PROVIDE STAFF DIRECTION REGARDING THE ESTABLISHMENT OF A DEFINITION AND VALUE FOR “WHAT CONSTITUTES DEMOLITION” FOR LANDMARKED PROPERTIES AND ALL PROPERTIES LOCATED WITHIN THE BOUNDARY OF THE HISTORIC TOWNSHIP DISTRICT (HGT). BACKGROUND: The City of Grapevine’s Zoning Ordinance and Appendix G does not have a definition of what constitutes a whole or partial demolition of a structure. Because no definition or value have been included in the existing Historic Preservation Ordinance, owners of property within the boundary of the Historic Township have taken structures down to the ground in increments without obtaining the required demolition permit from the building department or obtaining a Certificate of Appropriateness from the Historic Preservation Department. RECOMENDATION: The Historic Preservation Department staff seeks to establish a definition for “Demolition” in Appendix G to read: DEMOLITION means an act or process that destroys or razes a structure or its appurtenances in part or in whole, or permanently impairs its structural integrity, including its ruin by neglect of necessary maintenance and repairs. Further, the Historic Preservation Department staff recommends establishing the percentage value of “Demolition” to be 20 percent of the removal of exterior roofs or walls on landmarked properties and properties located within the boundary of the Grapevine Historic Township. and are incorporated herein by reference as if copied in their entirety Section 2. A. That Appendix G., Section 7 is hereby amended and replaced as follows: • Sec. 7. - Certificates of appropriateness. The commission shall follow the United States Secretary of the Interior's formal written Standards for the Rehabilitation of Historic Buildings in its consideration of all applications for certificates of appropriateness for property with an HL historic landmark subdistrict overlay. These standards shall be made available to owners and tenants of property designated as historic. (a) A person shall not alter a property designated as historic or property within a historic district, or any portion of the exterior of a structure on the site, or designated adjacent right-of-way, or place, construct, maintain, expand or remove any structure on the site without first obtaining a certificate of appropriateness (CA) in accordance with this ordinance. A CA shall be obtained prior to the issuance of any building permit, although the CA review and building permit and other required permit review processes may be conducted simultaneously. A CA may also be required for work not otherwise requiring a building permit. The CA shall be required in addition to, and not in lieu of, any required building permit. (b) A person shall not place, construct or expand any single family residential structure or commercial structure on property within the Historic Grapevine Township District without first obtaining a certificate of appropriateness (CA) in accordance with this ordinance. A CA shall be obtained prior to the issuance of any building permit, although the CA review and building permit review processes may be conducted simultaneously. For the purposes of this section, single family residential structure shall mean new single family residential construction, existing single family residences, and any structure that was originally constructed or occupied as a single family residence regardless of current use. A commercial structure shall mean a structure which houses any business other than a customary home occupation or manufacturing business which involves the exchange of goods or services for the renumeration of a person occupying the premises upon which the transaction or part thereof takes place. CA review for properties within the township which do not have HL overlay shall be only for compliance with subsections (c), (d) and (e), and shall not include review for compliance with the Secretary of the Interior's Standards for Historic Preservation. (c) Prior to commencement of any work, the owner shall file an application for a certificate of appropriateness with the director of development services.
