LANDSCAPE ARCHITECTURE SERVICES CONTRACT -
CONNECTOR PROJECT
City Council to consider awarding a Landscape Architecture contract to la terra studio in the
amount of $89,000 plus 10% contingency for the design of six areas throughout the
connector project and authorize staff to execute said contract and take any necessary
action.
FUNDING SOURCE:
Funds are available from the Quality of Life Unencumbered Fund Balance due to the
$700,000 saved in the State Highway 26 landscaping project.
BACKGROUND INFORMATION:
Several areas throughout the Connector corridor were not included in TXDOT's landscape
plan for the project. These areas are highly visible and landscaping will enhance the look of
Grapevine. The following areas are proposed for landscape design:
Location 1 — CVS at W. Northwest Highway and E. SH 114 Frontage Road
Location 2 — South of Ira E. Woods Avenue on east side of SH 114
Location 3 — South of Ira E. Woods Avenue on the west side of SH 114
Location 4 — Area east of Location 2 above that creates a "bowl" in front of Target
Location 5 — William D. Tate Avenue at E. SH 114 Frontage Road- Classic Chevrolet corner
Location 6 — Area west of Main Street between the westbound road and SH 114
Once TXDOT has approved the proposed six locations, the intent would be to budget the
installation of landscaping and irrigation for these areas in multiple years.
La terra has assembled a team of Pacheco Koch for civil engineering and Irri *Tech for
irrigation design as sub - consultants on this project. All three firms are sub - consultants on
the CAC expansion project headed by Barker, Rinker, Seacat. Having la terra prepare both
designs will provide a seamless connection as well as be more cost effective.
Staff recommends approval.

Agreement between Client and Landscape Architect
Dear Mr. Mitchell:
la terra studio, inc. is pleased to submit this proposal to provide Professional Services for the above referenced
project.
ARTICLE 1 -AGREEMENT
This Agreement is made and entered into effect as of the 19th day of June, 2013.
Between the Landscape Architect's CLIENT:

Parks and Recreation

1.1 PROJECT TEAM:
This proposal provides for the basic services of the project team listed below. The project team shall consist of the
following:
■ la terra studio — Prime Consultant
■ Irri *Tech — Irrigation Design
■ Pacheco Koch — Civil Engineering
ARTICLE 2 — BASIC SERVICES
2.1 The LANDSCAPE ARCHITECT shall prepare contract documents for construction associated with
the implementation of landscape enhancements along the DFW Connector Project in Grapevine,
Texas.
2.1.1 Data Gathering
The Landscape Architect shall meet with the Client in an initial kickoff meeting to establish the goals
and milestones for the project.
The Landscape Architect will work with the City to obtain electronic base files. The City is responsible
for providing Landscape Architect with data necessary to conduct schematic designs and construction
documents.
The Client will work with the Landscape Architect to obtain information pertaining to City and State
requirements in reference to landscape and irrigation guidelines along TxDOT right -of -way.
The following is a list of locations for landscape improvements included in the above reference project
(also, see attached location indicators)
Location 1 — CVS at W. Northwest Hwy and E Texasl 14 Frontage Road
Location 2 — South of Ira E Woods Ave on the East side of Texasl 14
Location 3 — South of Ira E Woods Ave on the West side of Texas 114
Location 4 — Area east of location 2 above that creates a "bowl' across from Barbeques Galore
Location 5 — William D. Tate Ave at E Texas 114 Frontage Road - Classic Chevrolet corner
Location 6 —Area west of Main Street between the west -bound frontage road and State 114
2.1.2 Schematic Design
The Landscape Architect shall visit the site to verify and inventory existing conditions, taking special note
to vehicular circulation, adjacent landscapes, existing vegetation, views, and focal points.
The Landscape Architect shall review the proposed road design to understand proposed road alignments
and conditions, taking special note to vehicular circulation, curb cuts, turn lanes, and median widths.
The Landscape Architect will apply landscape design principles that are compatible with other adjacent
landscape projects.
The Landscape Architect will develop concepts to present to City Staff. Upon City Staff selection of a
concept, the Landscape Architect will proceed to finalize the selected concept into a final schematic
design.
The Landscape Architect will submit to the Owner a detailed Estimate of Probable Cost at the Schematic
Design phase and the Landscape Architect will work with the City to derive at a budget for construction.
The Landscape Architect shall prepare plans and sketches specifically addressing concepts for:
-- Earth forms
— Hardscape (containment edges)
— Landscaping (with plant materials list)
— Landscape irrigation system (schematics)
The Landscape Architect will prepare plans in TxDOT format
2.1.3 Construction Documents
Preparation of construction drawings in TxDOT format which shall include documenting landscape and
irrigation enhancements for approximately $1,000,000 worth of construction activities:
• Existing condition and removal plans;
• Construction layout plans;
• Site Plans
• Traffic Control Plans (civil)
• Erosion Control Plans /SWPPP (civil)
• Grading plans;
• Landscape plans;
• Irrigation plans;

Submittal of construction documents for City review at the 60 %, 95% and Final completion.

Preparation of updated opinion of probable construction cost which shall accompany the 60 %, 95% and
Final submittals.

DELIVERABLES:
• Opinion of Probable Cost
• Construction Documents: 60 %, 95% and Final submittal - two (2) sets of
11'x17'half- -size and one(1) set of full size 22'x34" construction drawings and at the
95% and Final Submittal two (2) bound copies of the technical specifications and bid
documents.
• Bid Documents - One (1) set of reproducible drawings, one set of unbound technical
specifications and bid proposal form, and one file of the construction documents in
electronic format. Format for drawings shall be in PDF and Word format for
specifications and bid documents.
ARTICLE 3 - ADDITIONAL SERVICES
3.1 Additional Services
The LANDSCAPE ARCHITECT may provide services beyond the BASIC SERVICES listed above upon
written consent by the CLIENT. Additional services not currently included in the BASIC SERVICES fee
proposal could include the following;
• Services resulting from significant changes in the general scope, extent, or character of the project or
scope of work, and revising previously accepted studies, reports, design documents, or contract
documents when such revisions are required by changes in laws, rules, regulations, ordinances,
codes, or orders enacted subsequent to the preparation of such studies, reports, or documents, or are
due to any other causes beyond the Landscape Architect.
• Architectural /Engineering design activities, environmental services, field surveying, or other services
not associated with the general oversight and management of the project.
• Preparation of Record Drawings
• Bidding Assistance
Assist the City with the bidding process
Answer contractor questions
Attend a pre -bid conference
Issue Addendum
• Construction Observation
Provide periodic observation during construction.
Review Submittals
Participate in a Punch -List site visit and issue report
Participate in Final Inspection and issue report
Review and approve pay applications
Participate in an "End -of- year" warranty site visit
Review and approve mock -ups
• Project Filing, Plan Review and Post Construction Inspection in compliance with the Texas
Department of Licensing and Regulation or an Independent Contract Provider (RAS, Registered

Accessibility Specialist) for Texas Accessibility Standards. LANDSCAPE ARCHITECT shall revise the
construction documents accordingly as part of the basic services during the plan review process.
(Additional Service Fee of $1,500)
• Printing and distribution of construction documents.
• Utility Mapping beyond DIGTESS information and visible utilities.
• Right -of -Way delineation for dedication.
• Wetland Determination & 404 Permitting.
ARTICLE 4 - COMPENSATION AND PAYMENTS
4.1 The CLIENT agrees to pay the LANDSCAPE ARCHITECT for the BASIC SERVICES listed above, a lump
sum fee of: $89,000.00 — Eighty Nine Thousand Dollars. The project will be invoiced as a percentage
complete of the items mentioned below:
Information Gathering $ 2,500.00
Schematic Design $ 25,000.00
Construction Documents $ 47,000.00
Sub Consultants
a. Irrigation Design $8,500.00
b. Civil Engineering $6,000.00
Sub -total Sub - Consultants: $ 14,500.00
Total $ 89,000.00
4.2 ADDITIONAL SERVICES shall be provided on an hourly basis with a mutually agreed "not to exceed
amount ". Hourly rates for Additional Services are as follows:
Principal / Registered Landscape Architect $ 155.00 / hour
Intern Landscape Architect $ 75.00 / hour
CADD Technician $ 60.00 / hour
Administrative $ 40.00 / hour
4.3 Reimbursable expenses such as postage, handling of documents, printing, and courier service are will be
billed at cost.
4.4 The LANDSCAPE ARCHITECT shall bill the CLIENT on the monthly based on the percentage of services
completed during the 30 days prior. Payments are due to LANDSCAPE ARCHITECT upon receipt of
invoice.
4.5 The anticipated completion date for this project is August 1St, 2013. LANDSCAPE ARCHITECT will work
diligently to meet the before mentioned completion date. Circumstances outside the control of the
LANDSCAPE ARCHITECT may cause delay and the LANDSCAPE ARCHITECT will communicate with
the CITY any anticipated delays and adjust the completion date accordingly.
ARTICLE 5 - MISCELLANEOUS PROVISIONS
5.1 This Agreement is governed by the law of the LANDSCAPE ARCHITECT'S principal place of business.
5.2 This Agreement is the entire and integrated agreement between the CLIENT and LANDSCAPE
ARCHITECT. It supersedes all prior negotiations, statements or agreements, either written or oral. The
parties may amend this Agreement, only by a written instrument signed by both CLIENT and LANDSCAPE
ARCHITECT.
5.3 WARRANTY DISCLAIMER: Any language, term or condition of this agreement to the contrary
notwithstanding, the LANDSCAPE ARCHITECT makes no expressed or implied warranties of
merchantability or fitness for any purpose regarding the LANDSCAPE ARCHITECT'S service, which
warranties are expressly disclaimed.
5.4 INDEPENDENT CONTRACTOR: The CLIENT and LANDSCAPE ARCHITECT understand, acknowledge,

and agree that the LANDSCAPE ARCHITECT shall be acting as an independent contractor at all times
during the performance of this agreement and no provision or obligation expressed or implied in this
agreement shall create an employment, agency or fiduciary agreement.
5.5 THIRD PARTY BENEFICIARY DISCLAIMER: Nothing contained in this Agreement shall create a
contractual relationship with or a cause of action in favor of a third party against either the CLIENT or
LANDSCAPE ARCHITECT.
5.6 Neither the CLIENT nor LANDSCAPE ARCHITECT shall assign this Agreement without the written
consent of the other.
5.7 This Agreement shall be signed and returned to the LANDSCAPE ARCHITECT prior to the
commencement of services.
5.8 This Agreement is entered into effect as of the day and year first written above.
ARTICLE 6 - STATEMENT OF JURISDICTION
6.1 The Texas Board of Architectural Examiners (TBAE) has jurisdiction over complaints regarding the
professional practices of persons registered as landscape architects in Texas.
