will be placed on the agenda for public hearing at the discretion of the staff. Based on the size
of the agenda, your application may be scheduled to a later date.
All public hearings will be opened and testimony given by applicants and interested citizenry.
Public hearings may be continued to the next public hearing. Public hearings will not be
tabled.
Any changes to a site plan (no matter how minor or major) approved with a conditional use or
a special use permit can only be approved by city council through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning ordinance shall
have, from the date of submittal, a period of four months to request and be scheduled on an
agenda before the Planning and Zoning Commission and City Council. If after said period of
four months an application has not been scheduled before the Commission and Council said
application shall be considered withdrawn, with forfeiture of all filing fees. The application,
along with the required filing fee may be resubmitted any time thereafter for reconsideration.
Delays in scheduling applications before the Planning and Zoning Commission and City
Council created by city staff shall not be considered a part of the four month period.

1. Please add case number CU06-50 to all each sheets.
2. Please revise the note on page A-1 as follows: Conditional Use
Request CU06-50 is a request to amend the previously approved
site plan of CU06-08 for a planned commercial center with the
possession storage, retail sale and on -premise consumption of
alcoholic beverages (beer, wine and mixed beverages) in
conjunction with a restaurant, specifically to modify the building
elevations and add a new fire lane.
3. Please include in tabular format the calculation of the percentage
masonry of the entire structure, excluding doors and windows.
4. Please provide an elevation of the refuse/trash dumpster screening
device.
The above comments must be reflected in the revised submittal,
which is due by Friday, October 20 at 12:00 p.m. for the November 21
joint public hearing. Please submit the revised documents to the
Department of Development Services at 200 South Main Street.
The revised submittal shall include:
one (1) mylar of each sheet (minimum size 22" x 34")
two (2) folded blackline copies of each sheet, (minimum size 22" x 34")
two (2) reduced sorted (collated sets) copy at 11" x 17".
If these revisions are made and submitted at the correct time, you will be
scheduled for the next available agenda.

On behalf of John Evans, General Partner for the owning entity of the old Movies 8
theater property at 1301 William D. Tate Avenue, Grapevine, I am writing this letter
requesting a Conditional Use Permit for this project.
Mr. Evans received a Conditional Use Permit on April 8 of this year allowing him to
completely demolish the old theater building and to construct two restaurant buildings in
its place. Uncle Julio's would be a little more than 9,000 square feet of heated area, and
Mr. Evans would construct a second building of approximately 6,500 square feet of
heated area. A landscaped courtyard would be placed between the restaurants.
Mr. Evans has demolished the theater building in anticipation of the new buildings.
During the preparation of construction drawings for Uncle Julio's, the tenant made some
minor modifications to the building elevations, but did not increase the heated area of the
building. The civil engineer was instructed by the City to install a new fire lane on the
north side of the building, and in so doing, several parking spaces were lost. It was
determined that the most effective way to maximize the parking was to leave the north
parking lot relatively intact, except for adding the new fire lane. The net result of these
activities is that the overall parking count on the site went from the 276 previously
proposed to 273 spaces currently proposed.
At a 3 to 1 ratio, 273 spaces will allow 819 restaurant seats. Uncle Julio's is designed
for 377 seats and the future restaurant is expected to require approximately 270 seats,
for a total of 647 seats. 647 seats requires 216 parking spaces, leaving 57 extra spaces
on the property.
Based on these facts, on behalf of Mr. Evans and the owning partnership, I request your
consideration and approval of these minor revisions to the Conditional Use Permit.

exterior building elevations and reconfigure the parking lot in order to add a fire lane on

was approved by the Site Plan Review Committee on October 26, 2006. Copies of the
approved site plan are enclosed.
Any changes to a site plan approved with a conditional use or a special use (no matter
how minor or major) can only be approved by city council through the public hearing
process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.
