Any application for a change in zoning or for an amendment to the zoning ordinance shall have, from the date of submittal, a period of four months to request and be scheduled on an agenda before the Planning and Zoning Commission and City Council. If after said period of four months an application has not been scheduled before the Commission and Council said application shall be considered withdrawn, with forfeiture of all riling fees. The application, along with the required filing fee may be resubmitted any time thereafter for reconsideration. TRIPLETT, JR, PLANNER II DATE: SEPTEMBER 28, 2006 SUBJECT: CONDITIONAL USE REQUEST CU06-43; LOT 6, BLOCK 1, CROSSROADS OF DFW ADDITION RECOMMENDATION Staff recommends the Site Plan Review Committee consider the proposed changes to Conditional Use Request CU04-18 (Ord. 2004-36) approved at the May 18, 2004 meeting for a planned commercial center with the possession, storage, retail sale and on -premise consumption of alcoholic beverages (beer, wine, and mixed drinks) in conjunction with a restaurant specifically to allow for the addition of a patio cover to an existing patio, and take any other action necessary. BACKGROUND INFORMATION The subject site was approved for a 246 seat restaurant (Buffalo Wild Wings) with on - premise alcohol beverage sales and consumption. One monument sign was approved at the entrance off of William D. Tate Avenue. At the May 25, 2006 meeting of the Site Plan Review Committee, CU05-34 was approved on the subject site which was a request for one 40 -foot pole sign with 159 - square feet of sign face. With this request the applicant proposes to add a 19 -foot by 36 -foot patio cover to an existing 603 -square feet paved outdoor dining area.
