HomeMy WebLinkAboutItem 10 - Flood Damage Prevention Ordinance-TE /61 MEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: BRUNO RUMBELOW, CITY MANAGER MEETING DATE: APRIL 19, 2011 SUBJECT: FLOOD DAMAGE PREVENTION ORDINANCE AMENDMENT RECOMMENDATIO City Council consider adopting an ordinance amending Chapter 7, Article X, Flood Damage Prevention, Section 7 -192, Basis for Establishing the Areas of Special Flood Hazard, in its entirety and take any necessary action. BACKGROUND: This amendment addresses a minor modification in the requirements of City ordinances under the National Flood Insurance Program. Until recently, our Code of Ordinances only referenced the Flood Insurance Study and associated maps for Tarrant County in which the majority of Grapevine lies. The Texas Water Development Board and FEMA has advised us it is now a requirement for our ordinances to also reference the Flood Insurance Studies in Dallas County and Denton County. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AMENDING THE GRAPEVINE CODE OF ORDINANCES, CHAPTER 7, BUILDING AND CONSTRUCTION, ARTICLE. X, FLOOD DAMAGE PREVENTION, SECTION 7 -192; BASIS FOR ESTABLISHING THE AREAS OF SPECIAL FLOOD HAZARD, IN ITS ENTIRETY AS HEREINAFTER DESCRIBED; PROVIDING SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS the City of Grapevine is currently a participant in the National Flood Insurance Program (NFIP) administered bythe Federal Emergency Management Agency (FEMA); and WHEREAS, the City of Grapevine has previously adopted a Flood Damage Prevention Ordinance using FEMA's model ordinance as a condition of participation in the NFIP; and WHEREAS, FEMA has issued updated NFIP Maps with new effective dates; and WHEREAS; FEMA has amended its model ordinance to reflect the date of the effective NFIP Maps in Tarrant. County, September 25, 2009; and WHEREAS, FEMA has advised the City of Grapevine that, as a condition for continued participation in the NFIP, we must amend our Flood Damage Prevention ordinances to include references to the Flood Insurance Studies and associated Flood Insurance Rate Maps in Dallas County and Denton County with their effective dates; and WHEREAS, continued participation by the City of Grapevine in the NFIP is important to the well being of the citizens of Grapevine. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the preamble of this ordinance are true and correct and are hereby incorporated into the body of this ordinance as if copied in their entirety. Section 2. That Chapter 7,. Building and Construction, Article X, Flood Damage Prevention, Section 7-192 is hereby amended in its entirety to read as follows: "The areas of special flood hazard identified by the Federal Emergency Management Agency in the current scientific and engineering reports entitled, "The Flood Insurance Study (FIS) for Tarrant County, Texas and Incorporated Areas ", dated September 25, 2009, with accompanying Flood Insurance Rate Maps (FIRMS) dated September 25, 2009; "The Flood Insurance Study (FIS) for Denton County, Texas and Incorporated Areas ", dated April 18, 2011, with Flood Insurance Rate Map (FIRM), dated April 18,2011; "The Flood Insurance Study (FIS) for Dallas County, Texas and Incorporated Areas ", dated June 16, 2005, with accompanying Flood Insurance Rate Maps (FIRMS) dated June 16, 2005, and any revisions thereto are hereby adopted by reference and declared to be a part of this ordinance." Section 3 That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of any section, subsection, word, sentence or phrase shall be held to be invalid; it shall not affect the remaining part of this ordinance. Section 4. That the fact that uninterrupted participation in the NFIP is importantto the citizens of the City of Grapevine creates an urgency and an emergency for the immediate preservation of the public health, safety, and general welfare which requires that this ordinance shall take effect immediately from and after its passage and it is accordingly so ordained.
