Given under my hand and seal of office this day of SEAL Notary Signature BOARD OF ZONI'XG ADJUSTMENT APPLICATION PROCEDURAL TIMETABLE 5 oAzculformslappbza 1/99 Revised 1/06,1/13,1/14,1/12/14 Zoning Variance Form responses: Item 4 — Section 43 of the Zoning Ordinance — a change in a non -conforming structure as provided in Section 68(H)(3) of the Zoning Ordinance permitting a change that is not "contrary to the public interest, where, owing to special conditions, the literal enforcement of the provision of this ordinance will result in unnecessary hardship, so that the spirit of this ordinance shall be observed and substantial justice done. The specific change requested is raising the roof line to make room for central heating and air conditioning and improving the exterior appearance as shown on the plans and drawings submitted with the application. Item 5 — A special condition exists because the property was developed and the non -conforming structures were built before passage of the City's first zoning ordinance. A hardship exists because the roofs are sagging and the underlying roof supports need to be replaced to maintain the structural integrity of the buildings. In addition, the existing roof line does not permit the installation of central heating and air, which is much more energy efficient than the existing window units and eliminates the risk of leaks and insect intrusion as well as penmitting the windows to be opened when the temperature is moderate. Other modifications are needed to improve the appearance of the existing structures for the benefit of the neighborhood as well as occupants. None of the changes will increase the size or change the footprint of the existing structures and without these changes the structures will deteriorate becoming less safe to occupy and more unattractive to the neighborhood. Item 6 — The Historic Preservation Cominission has already issued a Certificate of Appropriateness recognizing that the requested improvements are necessary to maintain the historic character of the neighborhood as it was originally developed. Historically these two structures did not have sagging roof lines, window air conditioning units and a deteriorating exterior; they were attractive new buildings and the requested improvements will restore their original character. Texas St. Grapevine, Tx. 76051 Yasmine & Fabien, As your Architect, I would like to respond to the issues that were brought up in the last meeting with the City of Grapevine and concerned neighbors about the improvements that were made to the existing residential units on your property. The homes are in questionable condition as they exist, they are in need of repair and updating to not only improve the functionality of the residences, but to bring them to a level of quality of appearance that will complement your property as well as the surrounding neighborhood. The roofs of the homes are in need of replacement both for structural and aesthetic values, and need to be raised to allow for the installation of a central heating and air conditioning system. In the drawings that I produced for you I show, what I feel, would be adequate to not only accomodate the HVAC system but also be more aesthedically pleasing. The original square footage of the homes has not changed, but the addition of the higher roof lines does enhance the look and functionality, again adding to the rentability of the homes and to their intrinsic value to the neighborhood. Such chairman or, in his absence, the acting chairman shall administer oaths and compel attendance of witnesses. All meetings of the Board shall be open to the public. The Board shall keep minutes of its proceedings showing the vote of each member upon such question or, if absent or failing to vote, indicating such fact, and shall keep records of its examinations and other official actions, all of which shall be filed in the office of the Board and shall be a public record. G. Appeals to the Board of Adjustment may be taken by any person aggrieved, or by any officer of the department, board or bureau of the City, affected by any decision of the building inspector or other administrative officer of the City relative to the Zoning Ordinance. Such appeal shall be taken within fifteen (15) days after the date of the decision of the building inspector or other administrative officer has been rendered, by filing with the officer from whom the appeal is taken and within the Board of Adjustment a notice of appeal specifying the grounds thereof. The officer from whom the appeal is taken shall forthwith transmit to the Board all the papers constituting the record from which the appeal was taken. 1. A filing fee of one hundred dollars ($100.00) to help pay a part of the cost of legal publication, accumulating engineering data, and other administrative costs shall accompany each notice or appeal filed with the Board of Adjustments. 2. To permit in any district such modification of the requirements of the district regulations as the Board may deem necessary to secure an appropriate development of a lot where adjoining such lot on two (2) or more sides there are lots occupied by buildings which do not conform to the regulations of the district. In exercising its powers, the Board of Adjustment may, in conformity with the provisions of this Ordinance and the provisions of Articles 1101-A to 1011-J, both inclusive, after amended, reverse, or affirm wholly or partly, or may modify the order, requirement, decision or determination appealed from and may make such order, requirement, decision or determination as should be made, and to that end shall have all the powers of the officer from whom the appeal is taken. 1. The concurring vote of four (4) members of the Board shall be necessary to revise any order, requirement, decision or determination of any such administrative official, or to decide in favor of the applicant on any matter upon which it is required to pass under the Ordinance, or to effect any variance to this Ordinance. 2. Any person or persons, jointly or severally, aggrieved by any decision of the Board of Adjustment, or any taxpayer, or any officer, department, board or bureau of the City may present to a Court Of Record a petition, duly verified, setting forth that such decision is illegal, in whole or part, specifying the grounds of the illegality. Such petition shall be presented to the Court within ten (10) days after the filing of the decision in the office of the Board of Adjustment. J.
