This letter confirms that on March 7, 2022 the Board of Zoning Adjustment approved the
following request for the property located at 820 E. Texas Street:
Section 43.E.3., “Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use.
The Board approved a special exception allowing the existing residential structure to remain
as developed along with an expansion as shown on the plot plan.

Erica,
Here are the answers to your questions. We are in the process of making the changes requested to
the drawings and hopefully will have it by today. Worst case on Monday.
1. 93% of the original structure is retained. Only the 9’-8” x 8’-6” previous addition in the back is
being removed. That will get the house retained back to 100% of the original house.
2. The primary house building is one-story and the building height is 12’-4”. The detached garage
is one-story and the building height is 14’-7”.
3. The rear yard is 4950 Sq Ft and the garage is 1000 Sq Ft so the garage structure is 20.2%
4. The garage building height is 14’-7” so it does not require the additional setback.
5. The building distance between 820 E Texas and 816 E Texas is 10’-0”. This is the original
spacing that was done prior to the ordinance and the side of 820 E Texas is remaining at its
original location.

Greetings! Please find attached our 1st Review Comments for requested side-yard setback
variances located at 820 E. Texas Street. Staff is preparing to have this request on the March 7,
2022 Board of Zoning Adjustment (BZA) agenda for their consideration.
In order to meet deadlines for agenda preparation and posting, we will need a revised plan set
emailed to myself and all persons copied on this email as a PDF file by noon on Tuesday,
February 22, 2022. If all requested revisions have been incorporated into the resubmitted
plans, then we will ask for additional hardcopies at a later date.
Please let me know if you have any questions regarding comments or the direction provided
