This letter is to verify that your request for a conditional use permit located 909 South Main Street,
Suite 110 and is platted as Lot 1, Block 1, Hasten Addition to allow a conditional use permit to
amend the previously approved site plan, specifically to expand the existing restaurant was
approved by City Council on February 15, 2022.
Any changes to a site plan approved with a conditional use or a special use (no matter how
minor or major) can only be approved by city council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.
The City Council may grant one additional extension not exceeding one (1) year, upon written
application, without notice or hearing. No additional extension shall be granted without complying
with the notice and hearing requirements for an initial application for a Conditional Use Permit.

• Provide a graphic scale.
• Add the following conditional use request notes:
o Conditional Use Request CU22-08 is a request to amend the previously approved site plan of CU14-11 (Ord. 2014-2 1) for a restaurant to allow the possession, storage, retail sales and on-premise consumption of alcoholic beverages (beer, wine and mixed beverages) and outside dining, specifically to allow on- and off-premise consumption of alcoholic beverages (beer, wine and mixed beverages), and an expansion in conjunction with an existing restaurant.
o The entire site is the premise.
Sheet A1.01/Floor Plan
• Remove the contractor notes and the demolition notes and symbols.
• Label the existing areas of consumption/dining, kitchen, point of sale alcohol storage, restrooms, outdoor dining etc. Provide a graphic scale.
• Provide the existing seating layout.
• In lieu of labeling scope of work, hatch the expansion area.
Sheet A1.02/Floor Plan
• Remove the contractor notes and wall type.
• Provide a heavier line for the expansion area and provide the perimeter dimensions of the restaurant.
• Provide the full extent of the site including the outdoor dining. Label the consumption/dining, and alcohol storage area(s).
• Cloud the new opening/connection of the suites.
• In lieu of labeling scope of work, hatch the expansion area.

• Add courtyard view to the south elevation label and rear of Building “A” to the east elevation label.

The above comments must be reflected in the revised final submittal, for the next public hearing. Please submit the revised documents to the Department of Development Services at 200 South Main Street.
The revised final submittal shall include:
One blackline of each sheet (minimum size 22” x 34”)

Thirty (30) reduced copies of each sheet at 11" x 17" three hole
punched, stapled and z-folded (fold the right edge to the left edge
and then fold the right edge in half to form a z-fold).

PROPERTY LOCATION AND SIZE:
The subject property is located at 909 South Main
Street, Suite 110 and is platted as Lot 1, Block 1,
Hasten Addition. The subject property contains 5.519
acres and has approximately 440 feet of frontage
along South Main Street, 391 feet of frontage along
West Dallas Road and 554 feet of frontage along East
Nash Street.
REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the previously approved site
plan of CU14-11 (Ord. 14-21), specifically to expand the existing restaurant.
City Council on April 15, 2014 approved CU14-11 (Ord.14-21) to establish a 3,756 sq. ft.
restaurant (Mac’s—An American Grill) with two outside dining areas. The restaurant
owner, intends to expand 1,344 sq. ft. into the adjacent space to the north and occupy a
total of 5,100 sq. ft. Total seating for the restaurant will accommodate 153 patrons (133
seats indoors and 20 seats outdoors). Outdoor seating will be limited to a single patio.
The existing outdoor dining area will continue to be utilized for dining only—no outside
speakers, music, television etc., are proposed. Total parking provided on site is 602
spaces (510 garage spaces, 92 surface spaces); 590 spaces are required.
City Council approved CU14-11 subject to the following conditions: Additional full-service

restaurant uses are not permitted on the subject property with the exception of coffee
shops, bakeries, sandwich shops, and wine tasting rooms which shall require approval of a
conditional use permit and that the restaurant shall not be open past midnight on any night
of the week. The ordinance will reflect the aforementioned conditions.
PRESENT ZONING AND USE:
The property is zoned “MXU” Mixed Use District and contains a residential/commercial
mixed-use development consisting of 20,200 square feet of ground floor retail in two
separate buildings that have frontage on South Main Street (9,900 and 10,300
respectively) along with 251 apartment units, all served by a five-level parking garage
containing 510 parking spaces.
HISTORY OF TRACT AND SURROUNDING AREA:
The bulk of the subject property was zoned “C-2” Community Business District prior to the
1984 City-wide rezoning. A portion of the subject property and the adjacent property to the
east was zoned “R-2” Two-Family District and the properties to the north across Dallas
Road and to the west and south were zoned “LI” Light Industrial District prior to the 1984
City-wide rezoning. The subject and surrounding properties were subsequently rezoned to
“PO” Professional Office District during the 1984 City-wide rezoning.
• On July 17, 1994, City Council approved Z94-08 (Ord. 94-56) rezoning the subject
property from “PO” Professional Office District to “HCO” Hotel/Corporate Office
District for development of a bank (Omni American).
• On June 17, 1997, City Council also approved Z97-12 rezoning the subject property
from “PO” Professional Office District to “HCO” Hotel/Corporate Office District for a
.142-acre parcel that was previously developed as a single-family home - this tract
was intended to be used as off-street parking for the bank.
• On September 20, 2005, City Council approved Z05-10 (Ord. 05-75) rezoning the
subject site from “HCO Hotel Corporate Office and “LI” Light Industrial District to
“MXU” Mixed Use District. This 5.5-acre property developed as a mixed-use project
containing 251 apartment units and 20,200 square feet of ground floor retail lease
space in two separate buildings that have frontage on South Main Street, all served
by a five-level parking garage containing 510 parking spaces.
• On October 16, 2007, City Council approved two conditional use requests for off-
premise consumption of beer and wine and on-premise consumption of alcoholic
beverages in conjunction with a restaurant (Tastings) with outside dining (CU07-20
and CU07-21) on the subject site with the stipulation that no other full-service
restaurants be allowed on the subject property.
• On April 15, 2014, City Council approved CU14-11 (Ord. 14-21), an expansion to
the existing restaurant and the previously approved on-premise consumption of
alcoholic beverage sales (beer, wine and mixed beverages) and outdoor dining.

The subject tract is located within "Zone A" zone of minimal effect as defined on the

activities will be affected by aircraft sounds in Zone A, except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The applicant’s proposal
is an appropriate use in this noise zone.
MASTER PLAN APPLICATION:
The Master Plan designates the subject property as a Commercial land uses. The request
is compliant with the Master Plan.
THOROUGHFARE PLAN APPLICATION:
The City of Grapevine Thoroughfare Plan designates Main Street as a Type C, Minor

WHEREAS, all of the requirements of Section 48 of Ordinance No. 82-73 have been
satisfied by the submission of evidence at a public hearing; and
WHEREAS, the City Council further considered among other things the character of
the existing zoning district and its peculiar suitability for particular uses and with the view to
conserve the value of buildings and encourage the most appropriate use of land
throughout this City; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that there is
a public necessity for the granting of this conditional use permit, that the public demands it,
that the public interest clearly requires the amendment, that the zoning changes do not
unreasonably invade the rights of those who bought or improved property with reference to
the classification which existed at the time their original investment was made; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that the
conditional use permit lessens the congestion in the streets, helps secure safety from fire,
panic and other dangers, prevents the overcrowding of land, avoids undue concentration of
population, facilitates the adequate provisions of transportation, water, sewerage, schools,
parks and other public requirements; and
WHEREAS, the City Council of the City of Grapevine, Texas, has determined that

CU14-11 (Ord. 2014-21) specifically to expand the restaurant 1,344 sq. ft. to allow for the
possession, storage, retail sales, and on- and off-premise consumption of alcoholic
beverages (beer, wine and mixed beverages) and outside dining in conjunction with a
restaurant (Mac’s—An American Grill) in a district zoned “MXU” Mixed Use District within
the following described property: Lot 1, Block 1, Hasten Addition (909 South Main Street,
#110) all in accordance with a site plan approved pursuant to Section 47 of Ordinance No.
82-73, attached hereto and made a part hereof as Exhibit "A", and all other conditions,
restrictions, and safeguards imposed herein, including but not limited to the following:

health, safety, morals and the general welfare of the community. They have been
designed with respect to both present conditions and the conditions reasonably anticipated
to exist in the foreseeable future; to lessen congestion in the streets; to secure safely from
fire, panic, flood and other dangers; provide adequate light and air; to prevent
overcrowding of land, to avoid undue concentration of population; facilitate the adequate
provisions of transportation, water, sewerage, drainage and surface water, parks and other
public requirements, and to make adequate provisions for the normal business, commercial
needs and development of the community. They have been made with reasonable
consideration, among other things, of the character of the district, and its peculiar suitability
for the particular uses and with a view of conserving the value of buildings and encouraging
the most appropriate use of land throughout the community.
Section 5. That this ordinance shall be cumulative of all other ordinances of the
City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said
ordinances except in those instances where provisions of those ordinances which are in
direct conflict with the provisions of this ordinance.
Section 6. That the terms and provisions of this ordinance shall be deemed to be
severable and that if the validity of the zoning affecting any portion of the tract or tracts of

committed upon each day during or on which a violation occurs or continues.
Section 8. That the fact that the present ordinances and regulations of the City of
Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace
and general welfare of the inhabitants of the City of Grapevine, Texas, creates an
emergency for the immediate preservation of the public business, property, health, safety
and general welfare of the public which requires that this ordinance shall become effective
