Worth, TX 76104 Re: GRAPEVINE FILE #CU22-08 To Whom It May Concern, This letter is to verify that your request for a conditional use permit located 909 South Main Street, Suite 110 and is platted as Lot 1, Block 1, Hasten Addition to allow a conditional use permit to amend the previously approved site plan, specifically to expand the existing restaurant was approved by City Council on February 15, 2022. Any changes to a site plan approved with a conditional use or a special use (no matter how minor or major) can only be approved by city council through the public hearing process. No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a Building Permit is obtained and the erection or alteration of a structure is started, or (2) an Occupancy Permit is obtained and a use commenced. The City Council may grant one additional extension not exceeding one (1) year, upon written application, without notice or hearing. No additional extension shall be granted without complying with the notice and hearing requirements for an initial application for a Conditional Use Permit. The subject property contains 5.519 acres and has approximately 440 feet of frontage along South Main Street, 391 feet of frontage along West Dallas Road and 554 feet of frontage along East Nash Street. REQUESTED CONDITIONAL USE AND COMMENTS: The applicant is requesting a conditional use permit to amend the previously approved site plan of CU14-11 (Ord. 14-21), specifically to expand the existing restaurant. City Council on April 15, 2014 approved CU14-11 (Ord.14-21) to establish a 3,756 sq. ft. restaurant (Mac’s—An American Grill) with two outside dining areas. The restaurant owner, intends to expand 1,344 sq. ft. into the adjacent space to the north and occupy a total of 5,100 sq. ft. Total seating for the restaurant will accommodate 153 patrons (133 seats indoors and 20 seats outdoors). Outdoor seating will be limited to a single patio. The existing outdoor dining area will continue to be utilized for dining only—no outside speakers, music, television etc., are proposed. PRESENT ZONING AND USE: The property is zoned “MXU” Mixed Use District and contains a residential/commercial mixed-use development consisting of 20,200 square feet of ground floor retail in two separate buildings that have frontage on South Main Street (9,900 and 10,300 respectively) along with 251 apartment units, all served by a five-level parking garage containing 510 parking spaces. HISTORY OF TRACT AND SURROUNDING AREA: The bulk of the subject property was zoned “C-2” Community Business District prior to the 1984 City-wide rezoning. A portion of the subject property and the adjacent property to the east was zoned “R-2” Two-Family District and the properties to the north across Dallas Road and to the west and south were zoned “LI” Light Industrial District prior to the 1984 City-wide rezoning. The subject and surrounding properties were subsequently rezoned to “PO” Professional Office District during the 1984 City-wide rezoning. • On July 17, 1994, City Council approved Z94-08 (Ord. 94-56) rezoning the subject property from “PO” Professional Office District to “HCO” Hotel/Corporate Office District for development of a bank (Omni American). • On June 17, 1997, City Council also approved Z97-12 rezoning the subject property from “PO” Professional Office District to “HCO” Hotel/Corporate Office District for a .142-acre parcel that was previously developed as a single-family home - this tract was intended to be used as off-street parking for the bank. • On September 20, 2005, City Council approved Z05-10 (Ord. 05-75) rezoning the subject site from “HCO Hotel Corporate Office and “LI” Light Industrial District to “MXU” Mixed Use District. This 5.5-acre property developed as a mixed-use project containing 251 apartment units and 20,200 square feet of ground floor retail lease space in two separate buildings that have frontage on South Main Street, all served by a five-level parking garage containing 510 parking spaces. • On October 16, 2007, City Council approved two conditional use requests for off- premise consumption of beer and wine and on-premise consumption of alcoholic beverages in conjunction with a restaurant (Tastings) with outside dining (CU07-20 and CU07-21) on the subject site with the stipulation that no other full-service restaurants be allowed on the subject property. • On April 15, 2014, City Council approved CU14-11 (Ord. 14-21), an expansion to the existing restaurant and the previously approved on-premise consumption of alcoholic beverage sales (beer, wine and mixed beverages) and outdoor dining. SURROUNDING ZONING AND EXISTING LAND USE: O:\ZCU\CU22-08.4_EM Edits 3 NORTH: “GU” Governmental Use District—Grapevine Main SOUTH: “PO” Professional Office District and “GU” Governmental Use District—former Bank of America, City of Grapevine Municipal complex EAST: “PO” Professional Office District and “LI” Light Industrial District— small office building and Johnson Excavation Company WEST: “PO” Professional Office District and “CBD” Central Business District—Old Main Place office complex and Prosperity Bank AIRPORT IMPACT: The subject tract is located within "Zone A" zone of minimal effect as defined on the "Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. Few activities will be affected by aircraft sounds in Zone A, except for sound sensitive activities such as auditoriums, churches, schools, hospitals, and theaters. The applicant’s proposal is an appropriate use in this noise zone. MASTER PLAN APPLICATION: The Master Plan designates the subject property as a Commercial land uses. The request is compliant with the Master Plan. THOROUGHFARE PLAN APPLICATION: The City of Grapevine Thoroughfare Plan designates Main Street as a Type C, Minor Arterial with a minimum 80-foot right-of-way developed as four lanes with a center left turn lane. Section 2. That the City Manager is hereby directed to amend the official zoning map of the City of Grapevine, Texas, to reflect the herein conditional use permit. Section 3. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community.
