The application was submitted by Gary Skotnicki on behalf of property owners, Bob and Norma Duane. REQUEST: The applicant intends to expand the existing Dalton Oil Building into a 2,694 sq. ft. single-story office building for Mi Mutual Mortgage Company. The required front-yard setback for the “HC” Highway Commercial District is 25 feet. The existing attached service canopy at 323 West Northwest Highway encroaches 15 feet within the required front-yard setback. The current proposal desires to stay within the existing front-yard setback adjacent to the north property line and the expansion to the proposed professional office will not increase or decrease the existing front-yard setback. The following special exception is requested: Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning Adjustment to approve the remodeling and/or enlargement of a nonconforming use. The applicant is requesting a special exception to allow the existing service canopy structure to remain as developed within the front yard as shown on the plot plan. SPECIAL CONDITION: Staff finds that a special condition exists for the requested special exception.
