Dear Mr. Frost:
On April 8, the Building Board of Appeals approved variance request BBA96-02 from
the Grapevine Code of Ordinances as follows:
Section 7-129, Type of Construction.
(b) No fence erected on property within a platted subdivision shall be constructed
of barbed wire fencing.
(c) It shall be unlawful to construct a chain link fence in the required front yard
area with the barbed wire along the top in an up position.
The variance allows the placement of barbed wire along the top of the existing six (6)
foot chain link fence along Airline Drive as shown on the plot plan.
A copy of the approved minutes will be available after they have been approved at the
next regular Building Board of Appeals meeting. If you need a copy for your records,

RECOMMENDATION:
Staff recommends the Building Board of Appeals deny the request to City Code of
Ordinances, Chapter 7, Article IV, Fences, Section 7-129, for Lot 2, Block 4, J. J.
Daniel Addition and addressed as 1100 South Main Street, Grapevine, Texas as
follows:
1. Section 7-129, Type of Construction.
(b) No fence erected on property within a platted subdivision shall be

yard area with the barbed wire along the top in an up position.

BACKGROUND INFORMATION:
An application was submitted to the Department of Development Services by Mr.
George M. Frost representing T.U. Electric for the property located at 1100 South
Main Street. Staff does not feel that the residential nature of this area is conducive
to the implementation of barbed wire for fencing. The Board previously approved (at
the January 15, 1996 meeting) the installation of a fence exceeding thirty-six (36)
inches in height in the required front yard.

The Building Board of Appeals for the City of Grapevine, Texas, met in regular
session, Monday, April 8, 1996, at 6:30 P.M., in the Council Chambers, Room #205,
307 West Dallas Road, Grapevine, Texas with the following members present:

CALL TO ORDER
Chairman Joe Lipscomb called the meeting to order at 6:30 P.M.
NEW BUSINESS
BBA96-02 - TU ELECTRIC
The first item for the Building Board of Appeals to consider was BBA96-02 submitted
by Mr. George Frost representing TU Electric who requested a variance for the
property located at Lot 2, Block 4, J.J. Daniel Addition and addressed as 1100 South
Main Street. The request was to the City of Grapevine Code of Ordinances as
follows:
Section 7-129, Type of Construction.
(b) No fence erected on property within a platted subdivision shall be constructed
of barbed wire fencing.
(c) It shall be unlawful to construct a chain link fence in the required front yard
area with the barbed wire along the top in ap up position.
The variance request is to allow the placement of barbed wire along the top of the
existing six (6) foot chain link fence along Airline Drive as shown on the plot plan.
Scott Williams, Building Official, explained the details of the request and noted the
applicant was in the audience.
George Frost, applicant, recapped the continued security problem TU is having.

Sonny Rhodes, TU Electric, reminded the board of the vandalism taking place in the
area. He noted that the security problems had even increased since the new fence
extension had been installed.
Mr. Rhodes replied that they are using regular strands of barbed wire at an angle. He
added it is more difficult for the trespasser to get over.
With no one else to speak for or against the request, Art Gordon motioned to close
the public hearing. Dennis Roberts seconded the motion which prevailed by the
following vote:
Ayes: Lipscomb, Roberts, Gordon, and Kidd
Nays: None
Absent: Long, Smith, Czapanskiy
After discussion, Dennis Roberts moved, with a second by Art Gordon, to grant the
variance to the City of Grapevine Code of Ordinances, Chapter 7, Article IV for Lot
2, Block 4, J.J. Daniel Addition and addressed as 1100 South Main Street allowing
the placement of barbed wire along the top of the existing six (6) foot chain link fence
along Airline Drive as shown on the plot plan.

BBA96-03 - DOVE PARK APARTMENTS
The next item for the Building Board of Appeals to consider was BBA96-03 submitted
by Mr. William Cothrum representing Masterplan who requested a variance for the
property located at Lot 1, Block 1, Dove Park Addition and addressed as 1400 Park
Boulevard. The request was to the City of Grapevine Code of Ordinances as follows:
Section 7-127(a), FRONT YARD REQUIREMENTS.
(a) CORNER LOTS:
It shall be unlawful to erect a fence in the required front yard building setback
area or the established front yard area, whichever area is greater in depth, on
any corner lot, except along the interior lot line in accordance with subsection
(b).

(b) Interior Lots-
(1) It shall be unlawful to erect a fence, hedge or vines over thirty-six (36)
inches in height in the required front yard area or the established front
yard area, whichever area is greater in depth, on any interior lot.
(2) It shall be unlawful to erect a fence, hedge or vines in the required front
yard area or the established front yard area, whichever area is greater in
depth, on any interior lot that does not have at least fifty (50) per cent
through vision.
(3) It shall be unlawful to maintain a fence, hedge, or vines in the required
front yard area or an established front yard area, whichever area is
greater in depth, of an interior lot in a manner that does not permit at
least fifty (50) per cent through vision.
(4) For the purpose of this section, "established front yard area" shall mean
an open, unoccupied space on a lot facing a street and extending across
the front of a lot between the side yard lines and extending from the
abutting street a principal building or structure. The phrase "required
front yard" shall have the meaning ascribed to it in the Grapevine Zoning
Ordinance No. 82-73.
The proposed variance would allow a six (6) foot tall wrouaht iron fence with
a pate height of 7'6" to be erected with fifty (50) oer cent through vision in the
required and established front vard alone_ Park Boulevard as shown on the clot
Ian.
Scott Williams, Building Official, explained the details of the request.
Cathy Cothrum, applicant, spoke regarding several problems that have occurred in the
apartment complex such as parents using the complex's parking lot to drop their
children off at the elementary and children walking through parking lot on their way
home vandalizing cars. She also noted that the fitness center had been broken into
and a car had been reported stolen.
With no one else to speak for or against the request, Russell Kidd motioned to close
the public hearing. Art Gordon seconded the motion which prevailed by the following
vote:

After discussion, Art Gordon moved, with a second by Russell Kidd, to grant the
variance to the City of Grapevine Code of Ordinances, Chapter 7, Article IV for Lot
1, Block 1, Dove Park Addition and addressed as 1400 Park Boulevard allowing the
a six (6) foot tall wrought iron fence with a gate height of 7'6" to be erected with
fifty (50) per cent vision in the required and established front yard along Dove Road
as shown on the plot plan.

BBA96-04 - DAVID WEEKLEY HOMES
The next item for the Building Board of Appeals to consider was BBA96-04 submitted
by Mr. Lloyd Allberg representing David Weekley Homes who requested a variance for
the property located at Lot 7, Block 12, Lakeside Estates and addressed as 2728
Pinehurst Drive. The request was to the City of Grapevine Code of Ordinances as
follows:
Section 7-128, REVERSE FRONTAGE CORNER LOT REQUIREMENTS: On all reverse
frontage corner lots it shall be unlawful to construct a fence within the required side
yard area that is adjacent to a front yard area at a distance closer than fifteen (15)
feet to the side property line or at a height greater than eight (8) feet.
The variance request is to allow a. fence, to encroach fifteen (15) feet into the required
side yard as shown on the plot plan.
Mr. Williams explained Staff had approved the fence permit in error in August of
1995. The incorrect fence location came to Staff's attention upon review of a
swimming pool permit. The Building Official and the Public Works Department have
visited the site and do not feel that the location of the fence poses a visibility problem.
Martin Shelling, 21,0 West Wall Street, Grapevine Texas 76051, explained the
homeowner bought the house with the understanding that he had a large useable yard
area, but the ordinance requirements reduce thus useable area a great deal. Mr.
Shelling further added it would not be problem if the house was unpurchased.

Lloyd Allberg, applicant, noted to the Board Weekley Homes wants to meet the
expectation of the homeowner who purchased the home with the desire to be able to
utilize the side yard.
A Board Member questioned if the fence was existing.
Mr. Allberg explained it was built in conjunction with a new home.
Mr. Williams noted the fence was constructed exactly as it was shown on the plans,
which were reviewed and approved through the Building Inspection Department.
Mr. Allberg provided a letter from the neighbor on the west side of the property which
stated they had no objection.
With no one else to speak for or against the request, Dennis Roberts motioned to
close the public hearing. Russell Kidd seconded the motion which prevailed by the
following vote:
Ayes: Lipscomb, Roberts, Gordon, and Kidd
Nays: None
Absent: Long, Czapanskiy, Smith
After discussion, Dennis Roberts moved, with a second by Art Gordon, to grant the
variance to the City of Grapevine Code of Ordinances, Chapter 7, Article IV for Lot

MISCELLANEOUS REPORTS AND/OR DISCUSSION
Mr. Williams stated preliminary work had begun on the fence ordinance.
Plans for NTN Bearing, a 40,000 square foot office warehouse assembly were
approved by the Building Inspection Department.
Plans for Sterling Electronics headquarters building, a 181,000 square foot building
on William D. Tate Avenue and Southwest Grapevine Parkway are about to be
approved.

Richard Crow has submitted a 139,000 square foot spec office warehouse building
near Southwest Grapevine Parkway and Grayson Drive.
Sonny Bryan's Barbecue is going into the old ZuZu's space on Park Boulevard.
Housing Starts have been consistently up. The March report, which is the six month
point of fiscal year shows permits are up 20% over the fiscal year last year. Permit
fees are up 60% over the same time last year. Mr. Williams noted that not only more
work is coming in, but there is more work coming in with a higher valuation. Permit
fees are based on the value of the project.
Mr. Gary Cantrell has two office buildings going at the North end of Main Street.
Charlie's Cafe will be moving to Cantrell's building on Main Street.
MINUTES
The Building Board of Appeals considered the minutes of the April 8, 1996 meeting.
Russell Kidd motioned to approve the minutes of the April 8, 1996 meeting. Art
Gordon seconded the motion which prevailed by the following vote:
Ayes: Lipscomb, Gordon, Roberts, and Kidd
Nays: None
Absent: Long, Czapanskiy, Smith
