RECOMMENDATION:
Staff recommends the Building Board of Appeals approve the request to City Code of
Ordinances, Chapter 7, Article IV, Fences, Section 7-127, for Lot 1 R, Block 2,
Westover Addition, Phase I, and addressed as 4101 Grace Lane, Grapevine, Texas
as follows:
1. Section 7-127, Front Yard Requirements, limits fences located in the required
front yard to a maximum of 36" in height with a minimum of 50% through -
vision.
The variance reoiiest is to allow an existing 44" high wrought iron fence with
5Q% through vision to remain as installed in the required front vard.
BACKGROUND INFORMATION:
An application was submitted to the Department of Development Services by Mr.
Donald F. Schumacher for the property located at 4101 Grace Lane. Staff feels that
a special condition exists for the request, as the applicant installed a fence in the
required front yard to match a portion of fence installed by contractors working under
the direction of the City of Grapevine Public Works Department. This project was
related to the widening of Hall Johnson Road. A letter of support from the Director
of Public Works is included in this packet.

4101 Grace Lane. The reason for this appeal is to provide a safe environment for my six children
in the front of our house. Originally my lot sloped up to Grace Lane, and Grace Lane sloped up to
Hall Johnson. However, due to the city's project of widening Hall Johnson, it was necessary for
the City of Grapevine to drastically alter the grading of my yard. My driveway now slopes down to
Grace Lane, and Grace Lane now slopes down to Hall Johnson. As my lot sits on the corner of
this intersection, there have been several occurrences of my children rolling out into Grace Lane
on their tricycles, and there is the possibility of their continuing on down into the four lane traffic.
Also, due to the change in the grade of Grace Lane, cars are now entering into our subdivision at
an increased rate of speed (higher than the speed limit), putting our children at a higher risk of
being hit. In addition, we have observed that all vehicles wishing to make a quick turn -around
after entering our subdivision by mistake automatically take a left turn into our driveway, even
when our children are present in the driveway.
The city Public Works Department contracted for the initial portion of the iron fence to be
installed along the retaining wall they built. This was done for liability reasons on the city's part.
Due to miscommunication, we had expected the city to continue the fence all the way around the
yard. Since they contracted only the initial portion, we contracted to have the fence completed.
The city made their portion 44". We followed with the same height so that it would all match. The
fence contractor did not need a permit when he started the job, and we were not informed that
there were separate requirements for what the city had contracted versus the section we contracted
to have the fence completed. In light of these facts, we are requesting a variance to the height of
the completed fence.

Re: Fence Variance at 4101 Grace Lane
Dear Mr. Lipscomb -
The Public Works Department is currently overseeing the $5.5 million Hall Johnson
Road Paving and Drainage Improvement Project. Although this project primarily
provides improvements for Hall Johnson Road and Heritage Avenue, there are many
intersecting streets which will receive some modification in order to provide a smooth
transition to this new roadway. Grace Lane is one of the intersecting streets located
west of Heritage Avenue and south of Hall Johnson Road.
Along Hall Johnson Road in the vicinity of Grace Lane, the elevation of the road has
been lowered approximately 6 feet below.the previous road to meet roadway design
criteria. This lowering requires the use of retaining walls along both Hall Johnson
Road and Grace Lane since the elevation of the adjacent residential lots have
developed several feet higher than the roadways. The effect of this lowering required
the replacement of 95 feet of pavement on Grace Lane, which is 65 feet further than
most side streets.
The retaining wall located at the southeast corner of Hall Johnson Road and Grace
Lane has a height ranging from 2.25' to 3.75' while the retaining wall on the
southwest corner ranges from 1.5' to 4.25'. Adjacent to these retaining walls along
the south right-of-way of Hall Johnson Road exists an 8' high perimeter fence. A
retaining wall. was also necessary along a portion of 4101 Grace Lane due to the
ground elevation difference between the sidewalk and the front yard area. Due to the
wall's height and the grade of Grace Lane towards Hall Johnson Road, a wrought iron
fence was considered the most compatible treatment to handle safety and aesthetic
issues.

A style of fence agreeable to the City and the property owner was contracted and
constructed along the top of the City's retaining wall on July 25, 1996. This fence
was extended several feet beyond the end of the retaining wall to the north side of
the property owner's driveway. The height to the top of the ball caps is 44" from.
the concrete retaining wall. At the request of the homeowner association, a brick
facade will be laid along the retaining walls at the street intersection and a brick cap
along the top. This facade and cap will be extended along the top of the wall in front
of 4101 Grace Lane to the driveway.
The Public Works Department supports the variance requested by the property owner
at 4101 Grace Lane. It appears that the fence contractor has matched the previously
installed fence on the City's concrete retaining wall. We request that you grant the
variance being sought in this case.
