Staff feels the amendment is overly restrictive on three and four family dwellings. Both the Building Department and the Fire Department have reviewed the amendment and support eliminating it, and enforcing the building code as written. My layout has only sidewalls/partition walls adjacent to each other. No back walls and no units stacked on top of each other. I will be providing the 1 hour fire wall between units as required. each unit will be a two story unit. The U.B.C. and Zoning Ordinance seem to be different in the definition of what multifamily dwelling are. Based on the Zoning Ordinance a R -3.75 Zoning is not the same as an apartment complex (multifamily): The U.B.C. states any thing greater than 2 units is an apartment complex (multifamily). The 1994 U.B.C. requires a 1 hour fire separation between units in a building containing less than 3,000 sq. feet on the second floor of the building. The fourplex that I am requesting an appeal for has less than 3,000 sq. feet on the second floor. The amendment requires a 1 hour fire resistive construction throughout in Group R, Division 1 Occupancy. The 1994 U.B.C. defines Group R, Division 1 Occupancy as multifamily any thing greater than 2 units per building. The definition of MULTIFAMILY DWELLING in the Grapevine Zoning Ordinance states. Multifamily Dwelling shall mean a building or buildings containing or aggregating more than four single-family dwelling units. Section 18 R-3.75 Three and Four -Family District Regulations in the Grapevine Zoning Ordinance states. PURPOSE: The R-3.75 Three and Four -Family District is established to provide adequate space for medium density, threeplex and fourplex type of residential development, promoting a population density generally higher than duplex developments but less than the typical apartment complex development density. (maximum 10 units per acre of gross area) Section 22. R-MF-2 Multifamily District Regulations in the Grapevine Zoning Ordinance states. Also present were City Council Representative Roy Stewart and the following City Staff: Scott Williams Dick Ward Tim Fleming Betsy Dunham CALL TO ORDER Assistant Director/Building Official Fire Marshall Plans Examiner/Field Coordinator Plans Examiner Chairman Joe Lipscomb called the meeting to order at approximately 6:00 P.M. A memo from Charles Bloomberg was passed out to the members regarding his opinions on the cases. NEW BUSINESS BUILDING BOARD OF APPEALS CASE BBA 98-14. 310.2.2, 1994 UNIFORM BUILDING CODE The first item of New Business for the Building Board of Appeals to consider was BBA98-14 submitted by City Staff regarding the deletion of the amendment to Section 7-3 of the Grapevine Code of Ordinances, specifically as it relates to Section 310.2.2. of the 1994 Uniform Building Code. Mr. Williams explained that Staff recommended the Board forward to City Council a recommendation to delete the current amendment to Section 7-3 of the Code of Ordinances, specifically 310.2.2. as follows: Building Board of Appeals 8/10/98 With no one to speak either for or against the recommendation, Dennis Roberts made a motion to close the public hearing. Art Gordon seconded the motion, which prevailed by the following vote: Ayes: Lipscomb, Gordon, Roberts, Banse Nays: None Absent: Bloomberg Dan Banse made a motion to approve City Staffs recommendation to forward to City Council a recommendation to delete the amendment to Section 7-3 of the Grapevine Code of Ordinances specifically as it relates to Section 310.2.2. of the 1994 Uniform Building Code as follows: Section 310.2.2. Special Provisions. Walls and floors separating dwelling units in the same building, or guest rooms in Group R, Division 1 hotel occupancies, shall not be of less than one -hour fire -resistive construction. Art Gordon seconded the motion, which prevailed by the following vote: Ayes: Lipscomb, Gordon, Roberts, Banse Nays: None Absent: Bloomberg BUILDING BOARD OF APPEALS CASE BBA98-16 125 WILDWOOD COURT The next item of business for the Building Board of Appeals to consider was BBA98-16, submitted by Randy Howell for property located at 125 Wildwood Court and platted as Lot 7, Block 1, Marshall Estates. The request was to Grapevine Code of Ordinances, Chapter 7, Article I, Section 7-3 which amends Section 310.2.2 of the 1994 Uniform Building Code and requires all Group R, Division 1 occupancies to be of one hour fire resistive construction throughout. Mr. Williams explained that Staff recommended approval to allow a four -family structure to be constructed with no fire rated structural elements as shown on the drawings. Mr. Williams explained that the request ducktails in with the ordinance amendment the Board just recommended to forward to City Council. Mr. Williams explained that staff went ahead and brought the request before them so 3 Building Board of Appeals 8/10/98 Mr. Williams explained that currently the amendment requires all occupancies, all structures, three stories or more in height to be 100% fire sprinklered. Mr. Williams explained that the code as written does not require R-3 Occupancies, which is single family and two family dwellings to be sprinklered if they are three stories in height. Mr. Williams explained that staff requests that the amendment be modified and exclude the sprinkler requirement for Group R, Division 3, Private Dwelling Units. Mr. Williams explained that this goes hand in hand with the case from the last meeting and the case tonight and felt the code as amended will be more practical and reasonable and would still give a level of protection that is needed. With no one else to speak either for or against the request, Dan Banse made a motion to close the public hearing. Russell Kidd seconded the motion, which prevailed by the following vote: Ayes: Lipscomb, Gordon, Roberts, Kidd, Banse Nays: None Absent: Bloomberg Dennis Roberts made a motion and Dan Banse seconded, to approve City Staffs recommendation to forward to City Council a recommendation to approve amendments to Section 7-3 of the Grapevine Code of Ordinances, Section 904, Fire Extinguishing Systems, as follows: 904.2.10, All Occupancies. Approved automatic extinguishing systems shall be installed in all stories of buildings three (3) or more stories in height, excluding buildings used solely as parking garages, without e.,Geptien and Grouo-R. Division 3, Sinale Familv Dwellina Units. The motion prevailed by the following vote: Ayes: Lipscomb, Gordon, Roberts, Kidd, Banse Nays: None Absent: Bloomberg BUILDING BOARD OF APPEALS CASE BBA98-17 3225 REDBIRD LANE, RONALD AND JOANNA ST. ANGELO The next item for the Building Board of Appeals to consider was BBA98-17, submitted by Ronald and Joanna St. Angelo who requested an exception to Grapevine Code of Ordinances, Chapter 7, Article 7-3, Amendments, for property addressed as 3225 Red Bird Lane, platted as Lot 6, Block 4, Placid Peninsula as follows: 5 Building Board of Appeals 8/10/98 With no further discussion, Art Gordon made a motion to accept the recommendation to allow the construction of a three story residence without the required fire protection.
