This letter is to verify that your request on properties located at 2501 & 2519 Lonesome Dove
Road in the Leonard Lincoln Survey, Abstract 981, Tracts 1 B04 & 1 B04G to rezone 0.4751 acres
from "R-20" Single Family Residential District to "R-7.5" Single Family Residential District was
approved by the City Council on March 15, 2022. A copy of the approved exhibit is enclosed.
Any changes to a site plan approved with a conditional use or a special use (no matter how
minor or major) can only be approved by city council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.
The City Council may grant one additional extension not exceeding one (1) year, upon written
application, without notice or hearing. No additional extension shall be granted without complying
with the notice and hearing requirements for an initial application for a Conditional Use Permit.

do not wish to attend the hearing, the attached form is provided for your
convenience. If owners of more than 20% of the property within 200 feet of the
subject tract object to the case, a 3/4 vote of the City Council is required to approve

Purpose of Request:
The public hearing is to consider an application submitted by Hat Creek Development for
properties located at 2501 & 2519 Lonesome Dove Road in the Leonard Lincoln Survey,
Abstract 981, Tracts 1B04 & 1B04G. The applicant is requesting to rezone 0.4751 acres
from R-20 Single Family Residential to R-7.5 Single Family Residential. The property is
owned by Ferguson Lonesome Dove, LLC.
A copy of the site plan is on file with the Department of Development Services or online
with the City Council packets at 72 hours

3) See Email 3/2/2022 from Erica Marohnic regarding next steps relative to plat and access for Lot
15. Lot 15 has no access or frontage. This lot does not conform. It also appears it does not have
water or sewer access.
4) HOA to maintain lot in middle of road and dedicated lot/park that is dedicated to the city.
5) All easements for Hall’s Storage (2451 Lonesome Dove) to be developable in the Future will need
to be added to the Plat.
6) Existing drive on park lot needs to be removed unless parks department would like it for access.
7) NO CIVIL PLANS WERE SUBMITTED FOR THIS SUBMITTAL.
8) Lonesome dove will need curb, gutter and sidewalk along the frontage per our city code.
9) Roadway layout does not meet minimum roadway radius requirements per City
code. Intersections will need to be designed using AASHTO Urban design standards. A knuckle
will need to be added or the radius of the road will need to be changed to meet AASHTO.
10) USACE approval of the flowage easement will be needed prior to acceptance of the plat. Indicate
the location of the Existing Flowage easements per the recorded plat and the location of the
revised flowage easement based on location of the surveyed 572 contour. Indicate the
abandonment of the easement.
11) Revise the drainage plan to indicate all existing flows to the site and the disposition of the flows
meeting City code. Existing conditions drainage overtop Lonesome Dove. Provide hydrology to
indicate existing flows drainage across this site.
12) Show required storm drain to accommodate existing flows to the pond
13) Indicate how the pond will discharge to Foxfire Meeting City Code for downstream drainage
conditions.
14) The City may choose to increase the drainage system beyond existing conditions to relieve on
going flooding issues. The City will prepare a developer’s agreement to pay for upsizing beyond
what code requires.
15) Water line connection will be required to dead end line in Homestead Addition
16) Roll over curbs will not be accepted in this sub division.

pavilions. Indicate how these improvements to the dedicated land are tied to the
development. Staff believes the only usable portion is going to be the north and northeast
portions of the property. Parks would like to maintain access off of both Ferguson and Gravel for
a pedestrian/service access.

PROPERTY LOCATION AND SIZE:
The subject property is addressed as at 2501 and
2519 Lonesome Dove Road. The site contains
approximately 0.4751 acres and has no frontage
along Lonesome Dove Road.
REQUESTED ZONE CHANGE AND COMMENTS:
The applicant is requesting to rezone 0.4751 acres
from “R-20” Single Family District to “R-7.5” Single Family District for the development of
two single family detached residential lots in conjunction with the recently approved
rezoning for Ferguson Place (Z21-05; Ord. No. 2001-041).
It is the applicant’s intent to develop two single family residences on the subject property
in conjunction with a recently approved rezoning of 13.045 acres to the immediate east
and south, with 29 residential lots known as Ferguson Place. The largest residential lot
in the proposed development is 22,058 sq. ft. in size and the smallest lot is 7,511 sq. ft.
Average lot size is 9,352 sq. ft. and the overall density is 2.29 dwelling units per acre; the
“R-7.5” Single Family District allows a maximum density of four dwelling units per acre.
The open space lots are located in the middle of the development and east of the
residences.
Proposed Lot 15 as shown on the attached Overall and Specific Concept Plans shows
access to be provided by an existing 30-foot access easement. Although the design as
proposed is not a residential lot with access via right-of-way frontage, Subsection 3.17,

General Requirements of Appendix B (Subdivision Ordinance) of the City’s Code of
Ordinances allows the Planning and Zoning Commission to consider variation and
modification to the subdivision ordinance’s general requirements. Therefore, when the
preliminary and final plats are submitted for the Ferguson Place subdivision, Staff will
state the requested deviation in their findings of fact and agenda memo to the
Commission. The Commission may choose to approve or deny the plat for proposed Lot
15 with access via an access easement.
PRESENT ZONING AND USE:
The property is currently zoned “R-20” Single Family District and is occupied by single
family residences that are intended to be demolished upon approval of the zoning change.
HISTORY OF TRACT AND SURROUNDING AREA:
• On November 2, 1993, City Council approved annexation (Ord. 1993-49) of the
subject property and adjacent properties as part of an approximate 300-acre tract
from the City of Southlake and the Corps of Engineers. The subject site and
adjacent properties received the “R-20” Single Family Designation upon
annexation.
• North of the subject site, on February 20, 2001, City Council approved zone
change request Z01-01 (Ord. 2001-13) to rezone the site from “R-20” Single Family
District to “R-5.0” Single Family District with “R-7.5” Single Family District
regulations.
• North of the subject site, on March 20, 2001, City Council approved a zone change
request Z01-03 (Ord. 2001-20) to rezone the same site from “R-5.0” Single Family
District to “R-7.5” Single Family District.
• South of the subject site, on October 19, 1999, City Council approved a zone
change request Z99-18 (Ord. 1999-156) to rezone the site from “R-20” Single
Family District to “R-12.5” Single Family District.
• West of the subject site, on January 16, 2007, City Council approved zone change
requests Z06-18 (Ord. 2007-01) and Z06-19 (Ord. 2007-02) to rezone the site from
“R-20” Single Family District to “R-7.5” Single Family District.

proposal is compliant with the Master Plan.
THOROUGHFARE PLAN APPLICATION:
Lonesome Dove Road is not a designated thoroughfare as shown on the Thoroughfare
