A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, AUTHORIZING THE MAYOR TO
ENTER INTO AN INTERLOCAL AGREEMENT WITH THE
CITY OF HALTOM CITY, TEXAS FOR THE PURPOSE OF A
COOPERATIVE PURCHASING PROGRAM AND PROVIDING
AN EFFECTIVE DATE
WHEREAS, the City of Grapevine, Texas is a local government in the State of
Texas and as such is empowered by the Texas Local Government Code, Section 271.102
to enter into a cooperative purchasing program agreement with other qualified entities in
the State of Texas; and
WHEREAS, the City of Haltom City, Texas is a qualified entity as authorized by
Section 271.102 of the Texas Local Government Code; and
WHEREAS, the City of Haltom City, Texas wishes to utilize a City of Grapevine
vendor for the purchase of a Caterpillar Rubber Tire Front End Loader, Model 924-GZ,
pursuant to City of Grapevine Bid Number 68-2000, awarded by the Grapevine City
Council on November 21, 2000, such bid having been processed in accordance with the
Texas Local Government Code, Chapter 149S1.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
Section 1. That all matters stated in the above preamble are true and correct and
are incorporated herein as if copied in their entirety.
Section 2. That the Mayor of the City of Grapevine is authorized to enter into an
Interlocal agreement with the City of Haltom City, a copy is attached hereto as Exhibit "A".
Section 3. That this resolution shall take effect from and after the date of its
passage.

GRAPEVINE, TEXAS on this the 6th day of February, 2001.

INTERLOCAL AGREEMENT
BETWEEN THE
CITY OF HALTOM CITY AND THE CITY OF GRAPEVINE
WHEREAS, the City of Haltom City and the City of Grapevine desire to enter into an
agreement to permit the City of Haltom City to utilize the City of Grapevine vendor, for the
purchase of a Caterpillar Rubber Tire Front End Loader Model 924-GZ; and
WHEREAS, the Texas Interlocal Cooperation Act{Article 4413 (32C)Vernon's Annotated
Texas Statutes} provides for the cooperation between local governmental bodies, the
parties hereto in consideration of the mutual promises contained herein;
Now, THEREFORE, THIS MEMORANDUM OF AGREEMENT is hereby made and entered
into by the City of Haltom City and the City of Grapevine upon and for the mutual
consideration stated herein:
The City of Haltom City to purchase a Caterpillar Rubber Tire Front End Loader Model
924-GZ from the City of Grapevine's Bid No. 68-2000.
II.
City of Haltom City will process all orders and payments direct with Darr Equipment
Company.
III.
The City of Haltom City agrees to indemnify and save harmless the City of Grapevine from
any liability of damages the City of Haltom City may suffer as a result of claims, demands,
costs, or judgments against the work and services under this Agreement, or arising from
accident, injury, or damage, whatsoever, to any person, or persons, or to the property or
any person(s) occurring during the performance of this Agreement, except for any liability
or damages caused by the negligence of the City of Grapevine, it's agents, officers, and/or
employees.

IV.
The Mayor is authorized to enter into this Interlocal Agreement for the City of Haltom City.
It is agreed by the City of Haltom City and The City of Grapevine that no purchases will
commence hereunder until this Interlocal Agreement has been fully executed by the parties
hereto. The Mayor is authorized to enter into this Interlocal Agreement for the City of
Grapevine.
V.
This Interlocal Agreement may not be assigned and embodies the entire agreement
between the parties, and may not be amended except in writing.
