JOINT PUBLIC HEARINGS ZONE CHANGE APPLICATION Z07-12 AMINO ENTERPRISES First for the Commission to consider and make a recommendation to the City Council was zone change application Z07-12 submitted by Amino Enterprises for property located at 3091 West Dove Road and platted as Lot 1, Block 10, Parra Linda Estates, Section IV. The applicant was requesting to rezone approximately 2.74 acres from "CN" Neighborhood Commercial District to "PO" Professional Office District for the development of two office buildings. 091807 3 P & Z JOINT PUBLIC HEARING SEPTEMBER 18, 2007 Mr. Konstantine Bakintas and Ms. Joanna Kepler, representing the owner/applicant, were available for questions and requested favorable consideration of the application. Mr. Bakintas stated that the cross access is existing. He has also spoken with the Carroll Independent School District regarding the development and the cross access and they are in support of the project. There will be a two car garage with a private drive access for the owner of the property. There will be approximately 50 employees for their sales and accounting office. With no further questions, guests to speak, nor letters or petitions, the public hearing closed. In the Commissioner's deliberation session after a brief discussion regarding the private drive access and the necessity of the cross access Chris Coy moved to approve zone change application Z07-12. Danette Murray seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Coy, Murray, Wilson, Lowery and Hotelling Nays: None CONDITIONAL USE APPLICATIONS CU07-20 AND CU07-21 - TASTINGS Next for the Commission to consider and make recommendation to the City Council was conditional use applications CU07-20 and CU07-21 submitted by Scott and Cindy Summers for property located at 909 South Main Street, Suite 109 and Suite 110 and platted as Lot 1, Block 1, Hasten Addition. The applicant was requesting to amend the previously approved site plan associated with Z05-10 (Ord. 2005-75) specifically to allow the possession, storage, retail sale and off -premise consumption of alcoholic beverages (beer and wine only) in conjunction with a retail store (CU07-20) and to allow the possession, storage, retail sale and on -premise consumption of alcoholic beverages (beer, wine and mixed drinks) in conjunction with a restaurant (CU07-21). Mr. Scott Summers, the applicant, was available for questions and requested favorable consideration of the applications. Discussion was held regarding restaurant hours. City Council discussed whether there was an agreement with Fairfield Development as to the use of the building for retail use only with no restaurants. After further discussion, City Council asked Fairfield Development to make a commitment regarding the use of the building. With no further questions, guests to speak, one letter of support for each application, the public hearing was tabled to the October 16, 2007 public hearing. In the Commissioner's deliberation session, Chris Coy moved to table conditional use applications 0007-20 and CU07-21 to the October 16, 2007 public hearing. Herb Fry seconded the motion, which prevailed by the following vote: 091807 P & Z JOINT PUBLIC HEARING SEPTEMBER 18, 2007 Ayes: Oliver, Fry, Coy, Murray, Wilson, Lowery and Hotelling Nays: None CONDITIONAL USE APPLICATION CU07-23 - HYATT PLACE Next for the Commission to consider and make recommendation to the City Council was conditional use application CU07-23 submitted by Moody National HP Grapevine MT, LP for property located at 2220 Grapevine Mills Circle West and platted as Lot 1, Block 6, Grapevine Mills Addition, Phase 1. The applicant was requesting to amend the previously approved site plant of CU98-63 (Ord. 98-151) for a planned commercial center in excess of 1,000,000 square feet of gross leasable area, specifically to allow the possession, storage, retail sale and on -premise consumption of alcoholic beverages (beer, wine and mixed drinks) in conjunction with a cafe. Mr. Bryan Klein and Mr. David Gould, representing the owner/applicant, were available for questions and requested favorable consideration of the application. Mr. Gould stated there would be no change in the amount of meeting space with renovation of the hotel. With no further questions, guests to speak, nor letters or petitions, the public hearing was closed. In the Commission's deliberation session, Herb Fry moved to approve conditional use application CU07-23. B J Wilson seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Coy, Murray, Wilson, Lowery and Hotelling Nays: None CONDITIONAL USE APPLICATION CU07-26 - TEXAS NISSAN OF GRAPEVINE Next for the Commission to consider and make a recommendation to the City Council was conditional use application CU07-26 submitted by DDVT Development LP for property located at 1401 West State Highway 114 and platted as Lot 1, Block 1, Regency Center Addition. The applicant was requested a conditional use permit to amend the previously approved site plan of CU99-72 (Ord. 99-184) for a new and used automotive sales and service, specifically to allow a 1,964 square foot addition to the new car sales building. Mr. Jim Stevenson, representing the owner/applicant, was available for questions and requested favorable consideration of the application. Chris Coy seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Coy, Murray, Wilson, Lowery and Hotelling Nays: None CONDITIONAL USE APPLICATION CU07-27 - TIMBERLINE OFFICE PARK Next for the Commission to consider and make a recommendation to the City Council was conditional use application CU07-26 submitted by Kosse Maykus for property located at 2700 William D. Tate Avenue and platted as Lot 1, Block A, Timberline Office Park. The applicant was requesting a conditional use permit to amend the previously approved site plan of CU05-69 (Ord. 06-07) for a planned office center specifically to allow the addition of a 6,400 square foot office buildings Mr. Mike Wright, the architect, representing the owner, was available for questions and requested favorable consideration of the application. With no further questions, guests to speak, nor letters or petitions, the public hearing was closed. In the Commission's deliberation session Mark Lowery moved to approve conditional use permit CU07-27 with the condition that the monument sign be setback ten feet from the property lines. Danette Murray seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Coy, Murray, Wilson, Lowery and Hotelling Nays: None AM07-03—ZONING ORDINANCE AMENDMENTS TO SECTION 20 "R-TH" TOWNHOUSE DISTRICT REGULATIONS AND AMENDMENTS TO ALL APPLICABLE SECTIONS OF THE ZONING ORDINANCE RELATIVE TO THE ELIMINATION OF PUBLIC UTILITY USES AS A PERMITTED USE Amendments to Section 20, "R-TH" Townhouse District. The Planning and Zoning Commission met on April 10, 2007 and again on May 15, 2007 to discuss amendments to Section 20, "R-TH" Townhouse District Regulations that were drafted in an effort to modernize the guidelines with respect to current townhouse development in the Metroplex area. A public hearing was held on these amendments at the June 19, 2007 meeting however it was tabled given concerns that Council had relative to portions of the proposed ordinance. A joint worksession between the City Council and Planning and Zoning Commission was held on August 21, 2007 to discuss the proposed amendments to the "R-TH" Townhouse District regulations as well as to discuss Section 41, "PD" Planned Development Overlay relative to its purpose, intent, and implementation. At the workshop it was generally V agreed the prohibition on the use of the Planned Development Overlay relative to front entry garages on lots less than 40 -feet in width and the use of private streets less than 31 feet in width were perhaps too restrictive and should be eliminated. Possible amendments to the Planned Development Overlay regulations will be discussed at another joint worksession. A revised draft ordinance of Section 20, "R-TH" Townhouse District that comprises the results of all discussions to date was available, which included: • Thirty-one (31) foot street widths curb to curb with sidewalks to match minimum city design requirements. (public or private) • Twenty-five (25) foot setback from sidewalk to garage door for front entry garages. • Twenty-five (25) foot setback from edge of alley to garage door for rear entry garages. • Fifteen (15) foot front yard setback measured from the back of curb or nearest edge of street pavement. • Fifteen (15) foot rear yard setback measured from the nearest edge of the mutual access easement. • Thirty (30) foot minimum width for lots with rear entry garages. • Forty (40) foot minimum width for lots with front entry garages. • Eighty-five (85) foot minimum depth for lots with rear entry garages. • Eighty (80) foot minimum depth for lots with front entry garages. • Three thousand two hundred (3,200) square foot minimum for lots with front entry garages. • Twenty-five hundred and fifty (2,550) square foot minimum for lots with rear entry garages. • Maximum building coverage fifty-five (55) percent. • Total impervious lot coverage of eighty (80) percent. One area within the proposed ordinance disallows the use of the "PD" Planned Development Overlay to deviate from the standards as written: • Elimination of sidewalks along the street, public or private upon which a townhouse has frontage. Amendments to all applicable sections of the zoning ordinance relative to the elimination of public utility uses as a permitted use: The ordinance was written, "public utility uses required to service the district" are considered permitted uses within nearly all sections of the zoning ordinance and as such could be approved administratively without City Council oversight. This use has broad implications that perhaps were not fully realized when originally written. Any type of public utility use could be interpreted to meet this requirement. In a situation where a pubic utility related use is requested, Section 49, Special Uses has a provision for these 091807 7 P & Z JOINT PUBLIC HEARING SEPTEMBER 18, 2007 uses which would allow the City Council and Planning and Zoning Commission and the City Council the oversight necessary to consider the appropriateness of such requests. Discussion was held regarding the decision to eliminate the use of the "PD" Planned Development Overlay to deviate from Section 20.M.9. Any private streets developed in conjunction with a townhouse development to provide access to and frontage for townhouses developed under this ordinance must be a minimum of thirty-one (31) feet in width from curb to curb, constructed under the City's Construction Standards and inspected by City Staff. In the Commission's deliberation session Chris Coy moved to approve AM07-03 Zoning Ordinance Amendments to Section 20, "R-TH" Townhouse District Regulations and amendments to all applicable sections of the Zoning Ordinance relative to the elimination of public utility uses as a permitted use with the condition that September 18, 2007 be added to Section 20.D.6 to read as Townhouse developments approved prior to September 18, 2007 shall be deemed lawful and shall have the same status as subdivisions authorized pursuant to this ordinance and add a sentence to Section 20.M.9 to read as Any private streets developed in conjunction with a townhouse development to provide access to and frontage for townhouses developed under this ordinance must be a minimum of thirty-one (31) feet in width from curb to curb, constructed under the City's Construction Standards and inspected by City Staff. A_ planned development overlay shall not be used to deviate from this requirement Danette Murray seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Coy, Murray, Wilson, Lowery and Hotelling Nays: None END OF PUBLIC HEARING Discussion was held regarding a joint City Council and Planning and Zoning Commission workshop to be held October 16, 2007 to discuss future land use and zoning of properties located on North Main Street and east of Wood Street between East Wall Street and East Worth Street. CONSIDERATION OF MINUTES Next for the Commission to consider were the minutes of the August 21, 2007, planning and Zoning joint public hearing Danette Murray moved to approve the Planning and Zoning Commission minutes of August 21, 2007.
