SUBJECT: MAIN STREET FIRE PROTECTION ORDINANCE
RECOMMENDATION:
City Council consider; adopting an ordinance amending Chapter 7 Buildings and
Construction, Article, 1, Section 7-3 Chapter 11 Fire Protection and Prevention, Section
11-40 and Chapter 25 Utilities and Services, Section 25-28 to require fire protection
sprinkler systems in all buildings in the 300 and ,400 blocks of South Main Street, and
take any necessary action.
BACKGROUND:'
Staff and the City Council have been reviewing the many, issues surrounding Fire
Protection in the Historic Main Street area through anumber cif,work shops and
meetings with property owners over the past few months.
Staff has developed a program for implementing Fire Protection through the use'of
sprinkler systems in the 300 and 400 blocks of South.Main Street; the ;Historic Main
Street area. The program includes Pudic improvements with an estimated cost of
$ 1,0 0,000 and; private improvements with an estimated cast of 619,000. The
program offers City funding of the,private' 'improvements with provisions for monthly
payments to be paid to;the City by,:the property owners or tenants over periods of up to
20 years at an interest rate of 4.5%.
The majority of owners in the two block area are;supportive ;of the projoct and have
indicated a willingness to participate in the program., A minority, of owners have
indicated little or,no interest in participating in the program.
The intent of the proposed ordinance is to meet the City Council's desire for 1,00%
participation by the owners in the two block area.
The proposed ordinance requires property owners in the 300 and 400 blocks of South
Main Street to have a sprinkler fire protection system in place within 6 months of the
date of adoption. The ordinance identifies the cost participation program that staff has
developed with a .drop dead date for participation of December 21, 2007.

Penalty provisions for non-compliance with the terms of the ordinance include up to
$ 2,000 per day fines.
This area is the heart of the Historic Downtown Grapevine District, is a major visitor
attraction, and is irreplaceable.
Staff recommends approval.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS AMENDING THE GRAPEVINE
CODE_ OF ORDINANCES, CHAPTER 7 BUILDINGS AND
CONSTRUCTION, ARTICLE 1, SECTION 7-3 RELATIVE TO
FIRE PROTECTION SYSTEMS; BY AMENDING CHAPTER
11 FIRE PROTECTION AND PREVENTION RELATIVE TO
SPRINKLER SYSTEMS; BY AMENDING CHAPTER 25
UTILITIES AND SERVICES, SECTION 25-28(4) RELATING
TO WATER RATES FOR FIRE SPRINKLER CON-
NECTIONS; REPEALING CONFLICTING ORDINANCES;
PROVIDING A PENALTY NOT TO EXCEED TWO
THOUSAND DOLLARS ($2,000.00) FOR EACH
SEPARATE OFFENSE AND A SEPARATE OFFENSE
SHALL BE DEEMED COMMITTED UPON EACH DAY
DURING OR ON WHICH A VIOLATION OCCURS;
DECLARING AN EMERGENCY AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the City Council of the City of Grapevine has determined that the
passage of this ordinance is in the best interest of the health, safety and welfare of the
public; and
WHEREAS, the City Council of the City of Grapevine finds that the Preservation
of Historic Downtown Main Street to be special importance in preserving the character
and history of the City of Grapevine; and
WHEREAS, the nature of the buildings and structure of Historic Downtown
Grapevine puts those buildings and structures at risk for fire damage; and

serious risk to the lives of citizens and "tourists and would cause damage to buildings
with historic value that could not be replaced; and
WHEREAS all statutory and constitutional requirements for the passage of this
Ordinance have been adhered to, including, but not limited to, the Open Meetings Act.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
Section 1. That all of the above premises are found to be true and correct and
are hereby incorporated into the body of this ordinance by reference as if copied in their
entirety herein.
Section 2. That Chapter 7 Buildings and Construction, Article 1, Section 7-3 is
hereby amended by adding a new subsection to read as follows:
"Adding Section 903.2.14 Sprinklers required in all occupancies in the 300 and
400 blocks of South Main Street
903.2.14 Required in all occupancies in the 300 and 400 blocks of South Main Street
1. Approved automatic sprinkler systems shall be provided in all buildings
and structures, both new and existing, in the 300 and 400 blocks of South
Main Street, in the City of Grapevine, Texas.
2. Buildings and structures in the 300 and 400 blocks of South Main Street in
the City of Grapevine, Texas that are already existing on the date of
passage of this ordinance must comply with this requirement within six (6)
months after the passage of this ordinance. f South
3. Owners of buildings and structures in the 300 and 400 blocks o
Main Street in the City of Grapevine, Texas that are already existing on
the date of passage of this ordinance shall be eligible to participate in a
Cost Sharing Program with the City of Grapevine, Texas, provided that
those owners comply with all requirements of that program and agree to
participate no later than December 21, 2007. Such cost sharing
agreement may allow for a revised Fire Sprinkler Connection fee different
from the fee required by Section 25-28(4)b.
4. Regardless of whether owners of the above described' buildings
participate in the cost sharing program, the requirement to provide
sprinkler systems shall apply."
Section 3. That Chapter 11 Fire Protection and Prevention, Article III Fire
Code, Section 11-40 is hereby amended by adding a new subsection to read as follows:

Section 4. That Chapter 25 Utilities and Services, Article 11 Water and Sewers,
Section 25-28(4) is hereby amended to read as follows:
"4. Fire Sprinkler Connection:
a. $32.40 in all areas other than the Main Street Fire Protection
District which is addressed in subsection (b).
b. Main Street Fire Protection District.
(1) The Main Street Fire Protection District shall include all
buildings located within the 300 and 400 blocks of South Main
Street in the City of Grapevine, Texas.
(2)The Main Street Fire Protection Project shall include the costs to
install an approved fire sprinkler system within each building in
the District. The monthly fee for each building shall be the
equivalent of such building's proportionate share of the costs for
the Project. Such costs shall be payable over a 20 year term,
with an annual interest rate of 4.5%.
(3)The monthly fee described in 4 b(2) shall be billed as a fee for
service to the party that enters into the sprinkler system
construction agreement with the city and to any subsequent
owner or tenant of the subject property. If this fee is delinquent
in payment as defined by Section 25-37, water service may be
discontinued, pursuant to the provisions of Section 25-38, even
if other fees for utility service to the subject property have been
paid.
(4) The Director of Public Works shall prepare a final cost and
payment schedule for the Project. The current estimated 20
year costs for the project is included herewith as Exhibit "A",
which shall be submitted to the City Council for approval.
(5) Upon adoption, such schedule shall go into effect immediately
upon the completion of the Project. Following the full completion
of the twenty year payment schedule in full, the fee shall no
longer apply."
Section 5. Any person violating any of the provisions of this ordinance shall be
deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not
to exceed Two Thousand Dollars ($2,000.00) for each offense and a separate offense
shall be deemed committed each day during or on which an offense occurs or
continues.

Section 6. All ordinances or any parts thereof in conflict with the terms of this
ordinance shall be and hereby are deemed repealed and of no force or effect.
Section 7. If any section, subsection, sentence, clause or phrase of this
ordinance shall for any reason be held to be invalid, such decision shall not affect the
validity of the remaining portions of this ordinance.
Section 8. The fact that the present ordinances and regulations of the City of
Grapevine, Texas are inadequate to properly safeguard the health, safety, morals,
peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an
emergency for the immediate preservation of the public business, property, health,
safety and general welfare of the public which requires that this ordinance shall become
effective from and after the date of its passage, and it is accordingly so ordained.
