The Planning and Zoning Commission of the City of Grapevine, Texas met in Joint
Public Hearing with the City Council, on this the 16th day of October 2007, in the City
Council Chambers, 200 South Main Street, 2nd Floor, Grapevine, Texas with the

Mayor Tate called the joint meeting to order at 7:40 p.m. and Chairman Oliver called the
Planning and Zoning Commission deliberation session to order at 8:47 p.m.
INVOCATION
Commissioner Mark Lowery delivered the Invocation.
JOINT PUBLIC HEARINGS
CONDITIONAL USE APPLICATIONS CU07-20 AND CU07-21 - TASTINGS
First for the Commission to consider and make recommendation to the City Council was
conditional use applications CU07-20 and CU07-21 submitted by Scott and Cindy
Summers for property located at 909 South Main Street, Suite 109 and Suite 110 and
platted as Lot 1, Block 1, Hasten Addition. The applicant was requesting to amend the
previously approved site plan associated with Z05-10 (Ord. 2005-75) specifically to
allow the possession, storage, retail sale and off -premise consumption of alcoholic
beverages (beer and wine only) in conjunction with a retail store (CU07-20) and to allow

the possession, storage, retail sale and on -premise consumption of alcoholic beverages
(beer, wine and mixed drinks) in conjunction with a restaurant (CU07-21).
This application was tabled at the September 18, 2007 public hearing after discussion
centered on restaurant uses in this new mixed use project and the possible negative
impact restaurant uses could have on this project if they were allowed to consume the
majority of the retail space on the ground floor of both retail buildings. Meetings were
held with representatives of Fairfield Development to discuss limitations on restaurants.
Fairfield Development agreed that any additional full service restaurant uses will not be
permitted on the subject property with the exception of coffee shops, bakeries,
sandwich shops, and wine tasting rooms which shall require approval of a conditional
use permit.
Mr. Larry Lee and Mr. Scott Summers, representing the application, were available for
questions and requested favorable consideration of the applications. Discussion was
held regarding restaurant hours.
With no further questions, guests to speak, one letter of support, the public hearing was
closed.
In the Commissioner's deliberation session, B J Wilson moved to approve conditional
use application CU07-20. Mark Lowery seconded the motion, which prevailed by the
following vote:

In the Commissioner's deliberation session, B J Wilson moved to approve conditional
use application CU07-21. Chris Coy seconded the motion, which prevailed by the
following vote:

ZONE CHANGE APPLICATION Z07-14 AND CONDITIONAL USE APPLICATION
CU07-30 - LUCAS FUNERAL HOME
Next for the Commission to consider and make recommendation to the City Council was
zone change application Z07-14 and conditional use application CU07-30 submitted by
James N Lucas for property located at 410 North Dove Road and platted as Lot 6R,
block 7, W C Lucas Addition. The applicant was requesting to rezone approximately
1.398 acres from ""R-7.5" Single Family District to "PO" Professional Office District and
a conditional use permit to exceed the maximum permitted height and to allow a funeral
home.

Mr. James Lucas, the applicant, was available for questions and requested favorable
consideration of the application. Mr. Lucas stated that they have had several funeral
homes in residential neighborhoods. Mr. Lucas also stated that according to their
survey they usually have 25-30 cars per funeral service and they hire off-duty police
officers for traffic control. Improvements to the property will include landscaping,
sidewalks and lighting. The height of the building can be redesigned to meet the
ordinance.
The following citizens spoke in support of the project: Sandra Bass, Jack Roseberry
and Joe Wright.
The following citizens spoke in opposition of the project stating traffic issues, lower
property values and quality of life: Larry Francis, Jennifer Duffer, Elizabeth Kaufman,
Amber Guinn, Billy Hall, Huey Thomas, Lynda Randolph, C B Kloppe and Sherry
Blasingame.
With no further questions, guests to speak, one letter of support and 11 letters of
protest, the public hearing was closed. Because the total percent of property within 200
feet of the subject property was 40.46 percent, a 3/4 vote from City Council was
required in order to approve this request.
In the Commission's deliberation session, after a brief discussion regarding traffic, the
master plan, parking on Hilltop Drive and improvements to the site, Chris Coy moved to
deny zone change application Z07-14. No second to the motion was made, motion
failed.
Mark Lowery moved to approve zone change application Z07-14. B J Wilson seconded
the motion, which prevailed by the following vote:
Ayes: Fry, Wilson, Lowery, Hotelling and Fechter
Nays: Oliver and Coy

CONDITIONAL USE APPLICATION 0007-31 - TUSCANY
Next for the Commission to consider and make a recommendation to the City Council
was conditional use application CU07-31 submitted by Lance Rose for property located
at 960 East Northwest Highway, Suite 130 and platted as Lot 1, Block 1, Grapevine
Corner Addition. The applicant was requested a conditional use permit to amend the
previously approved site plan of CU06-54 SPRC, CU06-13 (Ord. 06-33) to allow the
possession, storage, retail sale and on -premise consumption of alcoholic beverages

(beer, wine and mixed beverages) in conjunction with a restaurant with outside dining,
specifically to revise the layout of the restaurant.
Mr. Lance Rose and Mr. Clayton Phillips, representing the application, were available
for questions and requested favorable consideration of the application. Mr. Phillips
stated the restaurant will be smoke free with the exception of the second floor outside
dining area.
With no further questions, guests to speak, nor letters or petitions, the public hearing
was closed.
In the Commission's deliberation session Mark Lowery moved to approve conditional
use application CU07-31. Herb Fry seconded the motion, which prevailed by the
following vote:

CONDITIONAL USE APPLICATION CU07-32 - PARK PLACE MERCEDES
Next for the Commission to consider and make a recommendation to the City Council
was conditional use application CU07-31 submitted by Michael Patterson for property
located at 1300 Texan Trail and platted as Lot 1, Block 1, Park Place Mercedes
Addition. The applicant was requesting a conditional use permit to establish an
automotive dealership with sales and service of new and used vehicles and a 20 -foot
pole sign.
Mr. David Ferrell and Mr. Ken Schnitzer, representing the application, were available for
questions and requested favorable consideration of the application. Discussion was
held regarding the need for a parking garage for display of automobiles.
With no further questions, guests to speak, nor letters or petitions, the public hearing
was closed.
In the Commission's deliberation session Chris Coy moved to approve conditional use
application CU07-32 with the condition that staff approves the elevations of the 20 -foot
pole sign. B J Wilson seconded the motion, which prevailed by the following vote:

HISTORIC LANDMARK SUBDISTRICT APPLICATION HL07-06 - EZELL RESIDENCE
Next for the Commission to consider and make a recommendation to the City Council
was historic landmark subdistrict application HL07-06 submitted by Pamala Ezell for
property located at 513 East Worth Street and platted as Lot 4, east 1/2 Lot 3, Block

108, College Heights Addition. The applicant was requesting a historic landmark
subdistrict to be known as the Ezell Residence.
With no further questions, guests to speak, two letters of support, the public hearing
was closed.

landmark subdistrict application HL07-06. Chris Coy seconded the motion, which
prevailed by the following vote:

HISTORIC LANDMARK SUBDISTRICT APPLICATION HL07-07 - SCHULD
PROPERTY
Next for the Commission to consider and make a recommendation to the City Council
was historic landmark subdistrict application HL07-07 submitted by Kimberly Schuld for
property located at 320 South Church Street and platted as Lot 1 B, Block 11, City of
Grapevine Addition. The applicant was requesting a historic landmark subdistrict to be
known as the Schuld Property.
Ms. Kimberly Schuld, the property owner, was available to answer questions.
With no further questions, guests to speak, nor letters or petitions, the public hearing
was closed.
In the Commission's deliberation session Herb Fry moved to approve historic landmark
subdistrict application HL07-07. Mark Lowery seconded the motion, which prevailed by
the following vote:

AM07-04 - ZONING ORDINANCE AMENDMENTS TO SECTION 40 "MXU" MIXED
USE DISTRICT REGULATIONS RELATIVE TO REAL ESTATE SIGNAGE
Next for the commission to consider and make recommendation to the City Council was
AM07-04 - zoning ordinance amendments to Section 40 "MXU" Mixed Use District
regulations relative to real estate signage. On February 20, 2007, City Council
approved amendments to Section 60, Sign Regulations reducing the size of real estate
signs. However, signs within the "MXU" Mixed Use District are addressed in Section
40. This request was to reduce the size of real estate signage in Section 40, "MXU"
Mixed Use District regulations.

PRELIMINARY PLAT APPLICATION LOTS 1 AND 2 BLOCK 1 PARK PLACE
MERCEDES ADDITION
Next for the Commission to consider and make a recommendation to the City Council
was the Statement of Findings and Preliminary Plat Application of Lots 1 and 2, Block 1,
Park Place Mercedes Addition submitted by Airport Office Joint Venture for property
located between Minter's Chapel Road and Texan Trail north of the Sewell Dealership.
The applicant was preliminary platting 22.919 acres for a commercial development.
In the Commission's deliberation session Chris Coy moved to approve the Statement of
Findings and Preliminary Application of Lots 1 and 2, Block 1, Park Place Mercedes
Addition. Herb Fry seconded the motion, which prevailed by the following vote:
Ayes: Oliver, Fry, Coy, Wilson, Lowery, Hotelling and Fechter
Nays: None
Next for the Commission to consider and make a recommendation to the City Council
was the Statement of Findings and Final Plat Application of Lot 1, Block 1, Park Place
Mercedes Addition submitted by Airport Office Joint Venture for property located
between Minter's Chapel Road and Texan Trail north of the Sewell Dealership. The
applicant was final platting 9.872 acres for a commercial development.
In the Commission's deliberation session Chris Coy moved to approve the Statement of

FINAL PLAT APPLICATION LOT -1, BLOCK 1 MILLER COMPANY ADDITION
Next for the Commission to consider and make a recommendation to the City Council
was the Statement of Findings and Final Plat Application of Lot 1, Block 1, Miller
Company Addition submitted by The Miller Company for property located 1080 Texan
Trail. The applicant was final platting 1.416 acres for an industrial development.

CONSIDERATION OF MINUTES
Next for the Commission to consider were the minutes of the September 18, 2007,
planning and Zoning joint public hearing
Chris Coy moved to approve the Planning and Zoning Commission minutes of
September 18, 2007. Herb Fry seconded the motion, which prevailed by the following
vote:
Ayes: Oliver, Fry, Coy, Wilson, Lowery, Hotelling and Fechter
