when filed and will be placed on the agenda for public hearing at the discretion of
the staff. Based on the size of the agenda, your application may be scheduled to a
later date.

Any changes to a site plan (no matter how minor or major) approved with a
conditional use or a special use permit can only be approved by city council

Any application for a change in zoning or for an amendment to the zoning
ordinance shall have, from the date of submittal, a period of four months to
request and be scheduled on an agenda before the Planning and Zoning
Commission and City Council. If after said period of four months an application
has not been scheduled before the Commission and Council said application shall
be considered withdrawn, with forfeiture of all filing fees. The application, along
with the required filing fee may be resubmitted any time thereafter for
reconsideration. Delays in scheduling applications before the Planning and
Zoning Commission and City Council created by city staff shall not be considered
a part of the four month period.

4. Please show the monument sign elevation.
5. Please note the purpose for the removal of trees within the right-of-way

7. Please add the following note:
Conditional use request, CU07-28 is a request to amend the
previously approved site plan of CU06-32 (Ord. 06-56) for a
planned commercial center with the possession, storage, retail sale
and on -premise consumption of alcoholic beverages (beer, wine
and mixed drinks) in conjunction with a restaurant, specifically to
revise the exterior elevations, revise the monument sign location
and allow the addition of an outdoor fireplace, fountains and
gazebo.
The above comments must be reflected in the revised submittal,
which is due by Thursday, August 23rd by 12:00 p.m. Please submit
the revised documents to the Department of Development Services at 200
South Main Street.
The revised submittal shall include:
four (4) folded blackline copies of each sheet, (minimum size 22" x 34")
four (4) reduced sorted (collated sets) copies at 11" x 17" three hole
punched, stapled and z -folded (fold the right edge to the left edge
and then fold the right edge in half to form a z -fold).

Staff recommends the Site Plan Review Committee consider the proposed changes to
Conditional Use Request CU06-32 (Ord. 2006-56) approved at the August 15, 2006
meeting for a planned commercial center with the possession, storage, retail sale and
on -premise consumption of alcoholic beverages (beer, wine, and mixed drinks) in
conjunction with a restaurant specifically to revise the exterior elevations by adding an
outdoor fireplace, fountains and gazebo, revise the landscape plan, and revise the
monument sign location, and take any other action necessary.
BACKGROUND INFORMATION
The subject site was approved for a 416 seat restaurant (Ferrari's Italian Villa) with on -
premise alcohol beverage sales and consumption. The elevations, floor plan and
monument sign of an existing 10,564 square foot restaurant, formerly occupied by
Golden Corral, were revised to accommodate Ferrari's.
With this request the applicant proposes to modify the exterior elevations of the
restaurant by adding two fountains, an outdoor fireplace, and a future gazebo. The
proposed monument sign has been relocated in order to avoid a conflict with existing
underground utilities. The landscape plan has been revised to reflect the removal of
four trees which were adjacent to William D. Tate Avenue. Four Red Oak trees will
replace the removed trees. Please see the attached letter and plans detailing other
minor exterior changes.

This letter is to verify that your request to amend the previously approved site plan to
amend the previously approved site plan of Conditional Use Request CU06-32 (Ord. 06-
56) to allow the possession, storage and retail sales of off -premise consumption of
alcoholic beverages (beer, wine and wine only) in conjunction with a restaurant specifically
to revise the exterior elevations by adding an outdoor fireplace, fountains and gazebo,
revise the landscape plan, and revise the monument sign location located at 1200 William
D Tate Avenue and platted as Lot 3R, Block 1, Towne Center Addition was approved by
the Site Plan Review Committee on August 29, 2007. A copy of the approved site plan is
enclosed.
Any changes to a site plan approved with a conditional use or a special use (no
matter how minor or major) can only be approved by city council through the public
hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date
on which the City Council grants the Conditional Use, unless within such one (1) year
period: (1) a Building Permit is obtained and the erection or alteration of a structure is
started, or (2) an Occupancy Permit is obtained and a use commenced.

To whom it may concern,
Please find forthwith a list outlining the revisions made to the drawing documents for the Conditional Use Permit
for the above referenced project.
1. A fountain has been added on the East Elevation in front of the outdoor Pergolata.
2. The location of the new monument sign (on William D. Tate) has been shown.
3. The wood fence on the South side of the building has been adjusted to avoid easements and utilities.
4. The wood fence on the South side of the building no longer extends fully to the West end of the building.
5. On the Northeast outdoor Pavilion Dining area, the perimeter railing design in elevation has been modified.
6. On the Northeast outdoor Pavilion Dining area, a cover has been denoted; refer to roof plan sheet & details.
7. On the Northeast outdoor Pavilion Dining area, the fireplace has been relocated to the Northwest corner.
8. On the Southeast outdoor Pergolata, the perimeter railing has been lowered on the South & East sides.
9. The Southeast outdoor Pergolata has been shortened and widened so as to avoid easements and utilities;

10. The stacked modular cementious retaining wall has been changed to a concrete stem -wall.

14. Outside on the Northwest corner, the exhibition kitchen area has been changed to a future gazebo.
15. The aluminum and glass entry on the East elevation has been narrowed by Eft and is hollow metal & glass.

has been removed.

18. The radiused canopy on the East elevation has been changed from standing seam to fabric awning frame.
19. All GFRC (glass -fiber -reinforced -concrete) columns have been changed to stone.
20. The existing four (4) roof dormers on the North side pitch have been removed.
21. The existing roof has been re -roofed with a similar type of asphaltic shingles.
22. The floor plan has been updated to reflect the internal layout of the restaurant building as well (not clouded)
23. Deleted the signage on the East elevation tower with the Tuscan clay tile roof.
24. The Monument Sign elevation has been changed; refer to the detail on the elevation sheet.
25. Street trees have been removed and been mitigated as shown on the landscape plan.
