follows: Conditional Use Request CU07-08 is a request to amend

Staff recommends the Site Plan Review Committee consider the proposed changes to
Conditional Use Request CU06-08 (Ord. 2006-28) approved at the April 18, 2006
meeting for a planned commercial center with the possession, storage, retail sale and
on -premise consumption of alcoholic beverages (beer, wine, and mixed drinks) in
conjunction with a restaurant specifically to allow the addition of a valet stand and
relocate parking, and take any other action necessary.
BACKGROUND INFORMATION
The subject site was approved for a 377 seat restaurant (Uncle Julio's) with on -premise
alcohol beverage sales and consumption. One new pole sign was approved at the
entrance off of the service road of State Highway 114 West along with an existing pole
sign along William D. Tate Avenue.
On October 26, 2006 the Site Plan Review Committee met, and approved CU06-50 on
the subject site, which was a request to modify the exterior building elevations and add
a new fire lane.
With this request the applicant proposes to add a passenger drop off for valet parking,
and reposition all of the handicap accessible parking spaces to the front of the
restaurant. Three parking spaces are proposed to be eliminated with the reconfigured
parking. The site however, will continue to exceed required parking by 54 spaces.

This letter is to verify that your request to amend the previously approved site plan of
conditional use CU06-08 (Ord. 2006-28) for a planned commercial center with the
possession, storage, retail sale and on -premise consumption of alcoholic beverages (beer,
wine, and mixed drinks) in conjunction with a restaurant specifically to allow the addition of
a valet stand and relocate parking located at 1301 William D Tate Avenue and platted as
Lot 4, Block 1, Hayley Addition was approved by the Site Plan Review Committee on
March 28, 2007. A copy of the approved site plan is enclosed.
Any changes to a site plan approved with a conditional use or a special use (no
matter how minor or major) can only be approved by city council through the public
hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date
on which the City Council grants the Conditional Use, unless within such one (1) year
period: (1) a Building Permit is obtained and the erection or alteration of a structure is
started, or (2) an Occupancy Permit is obtained and a use commenced.

On behalf of John Evans, General Partner for the owning entity of the old Movies 8 theater property
at 1301 William D. Tate Avenue, Grapevine, I am writing this letter requesting a revised
Conditional Use Permit for this project.
Mr. Evans previously received a Conditional Use Permit to demolish the theater building and
construct two freestanding restaurant buildings in separate phases. He subsequently requested and
received permission to modify the architectural building elevations for Uncle Julio's restaurant, and
to add a fire lane to the north side of the building.
Mr. Evans has received a request from Uncle Julio's to add a passenger drop-off for valet parking,
and to move all seven required handicap accessible parking spaces to the front of the two buildings.
This change will result in the loss of four parking spaces. However, one island can be removed
from a row of parking to the north, leaving the allowed twelve spaces in a row between islands.
This additional space will reduce the loss of spaces to three.
The approved master plan showed 273 parking spaces provided for 216 spaces required. With the
requested change, this site will still have 270 spaces. At a 3 to 1 ratio, 270 spaces will allow 810
restaurant seats. Uncle Julio's is designed for 377 seats and the future restaurant is expected to
require 270 seats, for a total of 647 seats. 647 seats requires 216 parking spaces, leaving an extra 54
spaces on the site.
Based on these facts, on behalf of Mr. Evans and the owning partnership, I request your
consideration and approval of these minor revisions to the Conditional Use Permit.
