HomeMy WebLinkAbout1984-05-01STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Planning and Zoning Commission of the City of Grapevine, Texas, met in a workshop session, reconvened from April 30, 1984, on this the 1st day of May, 1984, at 7 PM,in the Conference Room, 307 West Dallas, Road, following a joint session with the City Council beginning at 6:30 PM, with the following persons present, to wit: Sharron Spencer Ron Cook Harlen Joyce Gerald Norman Shane Wilbanks Richard Atkins Peggy Engho]m Chairman Vice Chairman Member Member Member Member Member with no one absent, and the following City Staff, to wit: James L. Hancock J.R. Baddkaker, P.E. John F. Boyle H. T. (Tommy) Hardy .Adrienne Leonard Joy Welch with consultants, to wit: Tony Wiles Marlin Smith City Manager Director of Public Works City Attorney Building Official Assistant City Attorney Secretary Planning Consultant Legal Consultant and with Jim Glynn, City Councilman and David Chance, Court Reporter also present. In the earlier meeting the following items were considered by the Commission, with minutes relative to the following items included with the Council Minutes: 1. North /South Arterial, Portion on South Side of Grapevine 2. East /West Arterial Location OLD BUSINESS - WORKSHOP Chairman Spencer declared that the meeting be reconvened from Monday, April 30 at 11:30 PM, and explained the procedures and purposes of such. The Commission was to deliberate, review, and make a recommendation to the City Council relative to the City of Grapevine instituted zoning case to consider the adoption of a new zoning district map for the entire City pursuant to Comprehensive Zoning Ordinance No. 82 -73, as amended. Parcel 10 Location being Parra Linda Estates, with present zoning being "R -1 ", the recommended zoning for this parcel is "R -7.5 ". Following brief discussion Gerald Norman made a motion that Parcel 10 be rezoned as advertised to "R -7.5 ", and Harlen Joyce seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, & Engholm Nays: None P &Z Minutes May 1, 1984 Page 2 Parcel 8 Canterbury Village being Parcel 8, presently zoned "R -1" was advertised for "R- 12.5" to be the new zoning designation. Richard Atkins made a motion to rezone Parcel 8 to "R- 12.5" as advertised, and Shane Wilbanks seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 9 Next the Commission considered Parcel 9, the Harwell Addition located at Dove and Kimball, presently having "R -3 ", "C -1" and "C -2" zoning and advertised "R -7.5 ". Shane Wilbanks made a motion to rezone the subject parcel to "R -7.5 ", and Gerald Norman seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm. Nays: None Parcel 151 Next for discussion was Parcel 151 located at the southeast corner of Dove and Kimball as well as the northeast corner, presently zoned "C -2" and advertised for "CN" Neighborhood Commercial zoning. Vice Chairman Cook made a motion to so zone the subject parcel as advertised, and Richard Atkins seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Norman, Wilbanks, Atkins & Engholm Nays: Joyce Parcel 168 Located on the south side of Dove Loop, this property previously zoned "R -1" was advertised to be zoned "R -20 ", and Commissioner Wilbanks made a motion to rezone the parcel as advertised, "R -20 ", and Harlen Joyce offered the second. The prevailing vote was as follows: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 97 Next, the Commission considered Parcel 97, previously zoned "I -2" and proposed for "LI" Light Industrial. The property includes Grapevine Industrial Park at the back and West State Highway 114. There being little discussion Commissioner Norman moved to rezone the parcel to "LI" as advertised, and Harlen Joyce seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 96 The next parcel including the batch plants on 114, Gifford Hill, etc. is currently zoned "I -1" and "I -2" and proposed for "LI ". Gerald Norman made a motion to rezone it to "LI ", and Shane Wilbanks seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcels 15 & 51 Next for consideration was Parcels 15 & 51. The Commission noted previous zoning designations included "R -1 ", "R -211, "C -211, "PO" and "SP" for Specific Use, and was advertised for "PO" for the entire parcel. Following the discussion, Peggy Engholm made a motion to rezone the P &Z Minutes May 1, 1984 Page 3 parcel to "PO" for professional office usage, and Gerald Norman seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Atkins, Wilbanks & Engholm Nays: None Parcel 176 The next parcel considered was #176, located currently zoned "C -2" for commercial usage and "SP" Site Plan, and advertised for "HC" Highway Commercial usage. Subsequent to brief discussion, Harlen Joyce made a motion to rezone the subject parcel to "HC" as advertised, and Vice Chairman Cook seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks & Engholm. Nays: Atkins Parcel 52 Next to consider, Parcel 52, located west of Dogwood to Pebblebrook and West Wall, zoned "R -1" now and advertised for "R -7.5 ". Then Shane Wilbanks made a motion to recommend "R -7.5" zoning, and Harlen Joyce seconded with the prevailing vote as follows: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 56 Next to consider, Parcel 56, zoned "R -1" and advertised for "R- 12.5" rezoning, is located in the vicinity of Ridgecrest. The discussion was brief, after which Richard Atkins made a motion to rezone the parcel as advertised, and Gerald Norman offered the second. The prevailing vote was as follows: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 55 Next, Parcel 55, located east of Dogwood, presently zoned "R -2" and advertised to zone "R -3.5" was considered and briefly discussed, then Gerald Norman made a motion to rezone as advertised, and Vice Chairman Cook seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcels 53 & 54 The subject parcels, Lucas Funeral Home and the West side of Dogwood was discussed at length. Presently zoned "C -2" and "R -3 ", it was advertised for "PO ". It was noted that Tim Lancaster spoke at the public hearings relative to needing "R -3.5" zoning for his property, and the Commission concurred that the funeral home should have "CC" zoning. Prior to the consensus being reached to recommend readvertisement for further public hearings, the following actions were first taken: First a motion from Shane Wilbanks to rezone the funeral home "CC ", then Mr. Wilbanks amended the motion to readvertise for "CC ", then to readvertise to "R -3.5" and a second from Harlen Joyce; then an addition to the motion from Mr. Wilbanks to readvertise with the written consent of the property owner, with the prevailing vote as follows: Ayes: Joyce, Norman, Wilbanks, Atkins & Engholm Nays: Spencer & Cook P &Z Minutes May 1, 1984 Page 4 Then Richard Atkins made a motion to amend the motion to reconsider the standing motion since it was under the moratorium, and Shane Wilbanks concurred, with a second from Peggy Engholm. The prevailing vote was as follows: Ayes: Spencer, Cook, Norman, Wilbanks, Atkins & Engholm Nays: Joyce Following a lengthy discussion, with legal counsel from Mr. Boyle, it was reiterated to include with any motion to readvertise a parcel or parcels, the statement that the motion be contingent upon written agreement of the property owner. Then Gerald Norman made a motion to rescind the standing motion, and Richard Atkins seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Norman, Wilbanks, Joyce, Atkins & Engholm Nays: None Then Vice Chairman Cook made a motion to readvertise the tract currently zoned "R -3" to "R -3.5 ", contingent upon agreement from the property owner, and Gerald Norman offered a second with the prevailing vote as follows: Ayes: Spencer, Cook, Joyce, Norman, Atkins & Engholm Nays: Wilbanks Then Richard Atkins made a motion to readvertise for rezoning contingent upon agreement from the property owner, the area currently zoned "C -2" to "PO ", and Vice Chairman Cook seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Norman, Wilbanks, Atkins & Engholm Nays: Joyce Parcel 173 The subject parcel is the hospital, West College, Highway 114 and the Lancaster Tract, presently zoned "SP" and "PD" and is advertised for "PCD" Planned Commercial District. A motion from Richard Atkins and a second from Shane Wilbanks was to recommend "PCD" as advertised, and the following was the prevailing vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parr -P1 179 Parcel 172, the McLelland Addition proposed for "R -7.5" and presently zoned "R -1" and "SP" Site Plan was briefly discussed, then the general consensus was to discuss later. Parcel 57 Presently zoned "R1 ", the area of Cannon Elementary School was advertised "GU" for governmental use. Shane Wilbanks made a motion to so rezone the property as advertised, and Richard Atkins seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None P &Z Minutes May 1, 1984 Page 5 Parcel 59 Next for consideration, Parcel 59, previously zoned "R -3 ", "R -1" "C -2111 & "PO" and advertised for "PO" zoning was discussed briefly, then Vice Chairman Cook made a motion to rezone to "PO" as advertised, and Gerald Norman offered the second. The prevailing vote was as follows: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks & Engholm Nays: Atkins Parcel 60 Next, the Commission considered Parcel 60. The existing zoning, "R -2" was advertised to change to "GU" since the area is Heritage Park. There being no discussion, Shane Wilbanks made a motion to rezone as advertised, and Harlen Joyce seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 172 The subject parcel belonging to Mr. Deacon, presently zoned "R -1" and advertised for "R -7.5" was discussed; then, Mr. Cook made a motion to zone the property as advertised, and Harlen Joyce seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Norman, Wibanks, Atkins & Engholm Nays: None Abstain: Joyce Parcel 58 The present zoning on Parcel 58 is "R -1,11, "R -3 ", and "SP" Site Plan, and it was advertised to rezone to "R -7.5 ". Gerald Norman made a notion to zone the property as advertised, and Vice Chairman Cook seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Norman, Atkins & Engholm Nays: Joyce & Wilbanks Parcel 172 -A Parcel 172 -A, located at the rear and the west of Wall, previously zoned "R -1" and advertised for "R -TH" was discussed, and it was noted that the owners of the property had requested "R -3.5" zoning. Subsequently, Richard Atkins made a motion to recommend that the Council rezone the subject parcel to "R -3.5" as requested, and Harlen Joyce seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 25 Next the Commission discussed Parcel 25, Park Place, presently zoned "SP" Site Plan, and advertised "R- MF -2 ", then Peggy Engholm made a motion to recommend it be rezoned as advertised. Gerald Norman offered a second to the notion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None P &Z Minutes May 1, 1984 Page 6 Parcel 24 -A Next Parcel 24 -A was discussed. It was noted that the present zoning was "R -1" and it was and "SP" Specific Use, the location being Woodlake Phase II, advertised for "PRD -12 ". There was a considerable amount of indecision among Commissioner, and Richard Atkins recommend that the part of Parcel 24A being church property be zoned "R -TH" and the remaining area be "R- MF -1 ". The motion failed for lack of a second; then, the general consensus of members was to consider the subject parcel Wednesday night. Parcel 23 This parcel being Jones Branch, west of Park and south of the City Limits, presently zoned "R -2 ", was discussed, then Vice Chairman Cook made a motion to zone the property "R -3.5 ", and Gerald Norman seconded the motion, with the following prevailing vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 24 Parcel 24, east of Jones Branch next to Woodlake Apartments, with "R -1 ", "R -2, and "C -2" as present zoning was advertised for "R -3.5" Duplex zoning. Shane Wilbanks first made a motion to rezone only those tracts zoned "R -2, "C -2" to "R -3.5 ", then following the discussion, he withdrew the motion. Then Gerald Norman made a motion to rezone the subject tract as advertised, "R -3.5 ", and Shane Wilbanks seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 94R Next, Parcel 24B was discussed. It was advertised "PRD -12" and is presently zoned "C -2 ". The 20 acres include the area of the Skaggs Store. It was noted that the Master Plan calls for medium density for the area , and the requests were made for commercial zoning at the corner of Dove and Dove. Then, Richard Atkins made a motion to zone the subject parcel "PRD -12" as advertised, and Peggy Engholm seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Norman, Wilbanks, Atkins & Engholm Nays: Joyce Parcel 63 Located in the downtown area, with present zoning "R -3 ", "R -2 ", "C -2" and "SP" (housing authority), this parcel was recommend by Mr. Wiles to be "R -TH" because of the mix in the Central Business District, and to provide more flexibility for the area, since "R -TH" permits other uses. Subsequent to the discussion Peggy Engholm made a motion to recommend "R -TH" zoning and Vice Chairman Cook seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Atkins & Engholm Nays: Wilbanks Parcel 66 The subject parcel presently zoned "I -2" and advertised for "L-I" was briefly discussed, followed by a motion from Shane Wilbanks to so zone the property as advertised, and Harlen Joyce offered a second. The prevailing vote was as follows: P &Z Minutes May 1, 1984 Page 7 Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 64 This parcel was advertised for "CBD" Central Business District. Richard Atkins made a motion to so zone the property as advertised, and Peggy Engholm seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 65 Presently "LI" and "SP" for mini- warehouses and advertised "LI ", there was little discussion on the subject parcel, and Gerald Norman made a motion to zone the property "LI" as advertised, and Harlen Joyce seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 61 Zoned "R -2 ", and advertised "LI ", this being Wright Construction company property which was briefly discussed; and Gerald Norman made a motion to zone the property as advertised, and Harlen Joyce seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 62 Existing in the subject parcel are doctors offices, presently zoned "R -2" and on the west "C -1 ", "R -3 ", "R -2 ", and "C -2" with advertised rezoning being "CN" Neighborhood Commercial. Harlen Joyce made a motion to rezone "CN" as advertised, but the motion failed for lack of a second. Then following further discussion, Shane Wilbanks made a motion to recommend "Po" zoning for the tract, which failed also for lack of a second. The next motion was offered by Richard Atkins who recommended that the parcel be rezoned "LB ", and Peggy Engholm seconded; but Commissioners were reminded that the "LB" designation had been eliminated; therefore no action was taken on Mr. Atkins' motion. Then Vice Chairman Cook made a motion to recommend that the parcel be rezoned with "CN" designation, and Gerald Norman seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Norman, Wilbanks, Atkins & Engholm Nays: Joyce Parcel 68 Advertised "R -7.5" and presently zoned "R -3" and some "C -2" and "C -1 ", Peggy Engholm made a motion to zone the subject parcel "R -7.5" as advertised, and Harlen Joyce seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Norman, Wilbanks, Atkins & Engholm Nays: Joyce Parcel 91 There was no discussion of this parcel being the teamster' hall and condos facing Wall Street, presently zoned "R -3 ". P &Z Minutes May 1, 1984 Page 8 Parcels 7 & 9 Next, the Ccmission discussed Parcels 7 & 9 with "I -1" and "R -2" zoning and advertised for "LI ". Shane Wilbanks made a motion to rezone both "LI" as advertised, and Richard Atkins seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Pa rr_e 1 7()-A With existing zoning being "I -1" and advertised for "LI ", Gerald Norman made a motion to rezoned the parcel as advertised, "LI ", and Harlen Joyce seconded the motion which prevailed by the following vote. Gerald Norman made a motion to rezone the subject parcel to "LI" as advertised, and Harlen Joyce seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Next John Boyle, Tony Wiles and Marlin Smith discussed at length the rezoning processes and problem tracts that will possibly need more time and property owner consent for readvertising for districts other than advertised for this go- round. RECESS Next Chairman Spencer advised the Ccnuission should recess the meeting at approximately 12:30 to reconvene the following evening, Wednesday, May 2, at 6:30 PM. Richard Atkins so moved to recess, and Harlen Joyce seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None PASSED AND APPROVED BY THE PLANNING AND ZONIN COMMISSION OF THE CITY OF GRAPEVINE, TEXAS ON THIS THE /y4 DAY OF , 1984. or. � �_/
