HomeMy WebLinkAbout1984-02-02STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Planning and Zoning Commission of the City of Grapevine, Texas, met in a workshop session on Thursday, February 2, 1984, at 7:30 PM in the Conference Room of the Police /Library facility located at 307 West Dallas Road, with the following members present, to wit: Sharron Spencer Ron Cook Harlan Joyce Tom Powers Gerald Norman Richard Atkins Chairman Vice Chairman Member Member Member Member constituting a quorum with Member Shane Wilbanks absent, and the following City Staff, to wit: James L. Hancock J.R.Baddaker, P.E. H.T. (Tommy Hardy) Steve Richardson Joy Welch CALL TO ORDER City Manager Director of Public Works Building Official City Planner Secretary Chairman Spencer called the meeting to order and explained the procedures and purposes. NEW BUSINESS FINAL PLAT OF THE CENTRAL BUSINESS PARK The first item of new business was for the Commission to consider the final plat of the Central Business Park and make a recommendation to the City Council. Mr. Baddaker then advised that this plat covers property located on the north side of Northwest Highway, immediately east of the Yamaha dealership and adjacent to Cluck Park. Further, he said that available utilities were adequate to serve the property, and that a sewer line crossing the property will be relocated at the developer's expense. Mr. Baddaker further advised that no problems with drainage or street layout anticipated. There was a brief discussion relative to drainage, followed by a motion from Vice Chairman Cook to reconuend that the Council approve the plat as submitted, and Member Harlen Joyce seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman and Atkins Nays: None Absent: Wilbanks & Powers (late arrival) N�: i�wrurr�r�r� ►•��rr_y�_��i���r�y�;����t���. ����ir�: ��= ����e�� The next item for consideration by the Commission to make a recommendation to the City Council was the preliminary plat and site plan of the Dove Crossings Subdivision. Mr. Baddaker advised that this plat and site plan cover the area which was recently rezoned by the Council on Dove Loop Road, immediately north of Marina Del Rey Apartments, and it incorporates most of the changes made by the Council after the public hearing. The City Engineer further discussed the present problems that will require work before final plat approval, ie., sewer lay -out, and drainage easements required on Willowbrook Court, Briarcrest Drive and the east end of Stoneway Drive. There was some discussion of the flood level; however, it is not recom- mended to accept the park dedication as the site plan would indicate. P &Z Meeting 2 -2 -84 Page 2 Note: Mr. Powers arrived during this deliberation. There were extensive questions from Commissioners relative to the flowage easement, the two flood plain lots, and a great deal of deliber- ation relative to the 7500 square foot lot requirements and the planned area for a park (which members agreed should be relocated due to close proximity to an through street.) Mr. Haynes, the applicant, responded to the questions indicating an open mind to making the suggested changes. Following the discussion Commissioner Joyce made a motion to recommend that the Council approve the plat as submitted. The motion failed for lack of a second. Vice Chairman Cook made a motion to table the plat, and Tom Powers seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Powers, Norman & Atkins Nays: Joyce Absent: Wilbanks OLD BUSINESS The Commission was then to conduct a workshop and review session relative to the proposed amendments to the Comprehensive Zoning Ordinance and zoning map and take any necessary action relative thereto. WORKSHOP The Commission was to make suggestions for changes relative to Sections 46 and 47 of the Grapevine Zoning Ordinance. The following changes were suggested for Section 46, the Site Plan District: A. APPLICABILITY (Several changes in wording resulted in the follow- ing wording- Site Plans, prepared and approved in accordance with the provisions of this section, shall be required to assist City officials in the review of certain applications and to assure compliance with all applicable requirements and standards of this Ordinance and in such other instances as may be required by the terms of this Ordinance. (here is clause was deleted) The City shall not issue any building permit until a Site Plan, which is in compliance with the applicable zoning district regulations, is approved as provided in this Section. B. AUTHORITY (Re- written as follows) Review and approval of Site Plans shall be accomplished as herein- after set forth: 1. The Director of Public Works may, subject to the procedures, standards and limitations as stated herein, review and approve site plans under the following conditions: a. The subject tract does not exceed 1/2 acre in size b. No more than 1 structure is proposed, and all regulations and area requirements of the zoning district in which it is being proposed are met. C. The site holds the correct zoning for the proposed use. d. Where applicable, no more than 4 dwelling units are proposed. e. All applicable ordinances and codes are met. P &Z Minutes 2 -2 -84 Page 3 f. Construction of a single family dwelling or any permitted accessory use to a single family dwelling on an existing or platted single family lot. g. Deposit and contouring of fill on land provided other regulations of the City of Grapevine are met. h. Additions to any building or uses, legally existing at the date of this Ordinance, when such addition does not exceed 200 square feet or one -third (1/3) of the gross floor area of the existing building or use, whichever is greater. i. Any permitted use of a temporary nature for a period not to exceed one (1) year. Any person aggrieved by any decisions of the Director of Public Works with respect to a site plan may, within ten (10) days of such decisions, appeal to and have a determination made on the matters in dispute by the Plan- ning and Zoning Commission by submitting to the City Secretary and the Director of Public Works, a written statement setting forth the statute, ordinance, standard or other requirement alleged to have been violated or improperly applied by the decisions of the Director of Public Works. Upon receipt of such request, the Director shall immediately refer the applicant and his report thereon to the Planning and Zoning Commission, which shall review and act upon the application in the same manner and subject to the same standards and limitations as those made applicable to the Director of Public Works except that the Commission shall have 30 days from the date of such referral within which to act. Any applicant or adjoining property owner, within 200 feet of th subject site, who is aggrieved by the deci- sion of the Planning and Zoning Commission may , within ten (10) days of such decisions, appeal to and have a determination made on the matters in dispute by the City Council. During the period of appeal, no building permit shall be issued. 2. A Joint Public Hearing before the Planning and Zoning Commission and the City Council for Site Plan Review and approval shall be required for the following developments and /or uses: a. All zoning change requests. Such requests shall be accompanied by a site plan meting all criteria set out in this Section 47 except for zoning change requests to the R -20.0, R -12.5 or R -7.5, PID and PCD zoning districts. b. Any development, redevelopment or other alter- ations on property on which the appropriate zoning is already in place, unless said property satisfies all criteria as set out in subparagraph B -1 above. C. Any development or redevelopment within the Airport Noise Overlay Districts. d. Any development or redevelopment involving the construction of any building to be constructed P &Z Minutes 2 -2 -84 Page 4 owned, leased or operated by any unit of the national, state or local government, or the use or development of any land to be owned leased or operated by any such unit of govern- ment. 3. The Planning and Zoning Commission shall, subject to the procedures, standards and limitations here- inafter set forth, review and approve Site Plans for PRD -6, PRD -12, PCD and PID zoning districts. Any site plan issued in connection with a planned development district must be in conformance with the approved Master Development Plan for that district. Any person aggrieved by an decision of the Planning and Zoning Commission with respect to a site plan may, within (10) days of such decision, appeal to, and have a determination made on the matters in dispute by the City Council by submitting to the City Secretary and the Director of Public Works, a written statement setting forth the statute, ord- inance, standard of other requirement alleged to have been violated or improperly applied by the decision of the Planning and Zoning Commission. During the period of appeal, no building permit shall be issued. C. CONTENTS OF SITE PLAN (This subsection is a revised version of the original Preliminary and Final site plan sections, (old pages 5 -10), which reads as follows: The application for site plan approval shall include the following information and material: 1. Legal description, a survey certified by a registered land surveyor, showing property boundary lines and dimensions easements, roadways, rail lines and public rights -of -way crossing and adjacent to the subject property. 2. The applicant's name, address and phone number, and his legal interest in the subject property. 3. The owner's name, address and phone number, if different than the applicant, and the owner's signed consent to the fitting of the application. 4. Street address (or common description) of the property. 5. The present zoning classification and present use of the subject property. 6. The Comprehensive Master Plan land use recommendation for the property. 7. The proposed use or uses and a general description of the proposed development. 8. If the property is subject to a Master Development Plan, the date such plan was approved and a statement showing that the proposed use substantially conforms to the Master Development Plan. Any proposed grading or re- grading of the subject property; any significant natural, topographical or physical features of the property, including at least, flood plain area, water, courses, marshes, trees in excess of 4 inches in diameter, rock out- croppings and existing contours in excess of 2 feet in 100 feet. 10. Map (s) showing the location, size, use and arrange- ment of all proposed buildings by type of structure and computations showing height in stories and feet, floor area, total square feet of ground area coverage of proposed and existing buildings which will remain, if any, number and size of dwelling units, number of bedrooms in residential uses, and building separations. 11. Spell application correctly; add the words "in writing" following the words "...agreed to "; insert the phrase "scheduled for review by the authorized body as established by Section 47 -B. (and) The reviewing body" following "...attached site plan to be "; substitute "the" for "his" following "Immediately upon concluding "; P &Z riinutes 2 -2 -84 Page 6 Delete the last sentence ( #4) 5. Add "except on zoning cases at the end of this number. 6. Delete entirely H. STANDARDS FOR SITE PLAN REVIEW 1. Delete first phrase "The through disapprove" and "shall not be disapproved before the word "except ". (No changes on 1-(a) through (g) (h) Delete completely 2. Insert "and /or Planning and Zoning Commission" following "Public Works ". I. EFFECT OF SITE PLAN APPROVAL. Insert "or Planning & Zoning Commission or City Council as appropriate" following "Public Works." J. Standards for Site Plan Review 1. Should read the Director of Public Works shall not refuse to approve, and /or the Planning and Zoning Commission shall not fail to take some action on site plans submitted pursuant to this Section except on the basis of specific written findings dealing with one or more of the following standards. Ask Mr. Smith about (d) and (e) as to their compliance with Texas Statutes. 2. Add" and Planning and Zoning Commission" after "Public Works Director" I. Effect of Site Plan Approval - Add "and" after Director of Public Works" and "and /or City Council" after "Planning and Zoning Commission "; also, "at the end of the year, another site plan must be approved."
