HomeMy WebLinkAbout1984-02-22STATE OF TEAS COUNTY OF TARRANI' CITY OF GRAPEVINE The Planning and Zoning Commission of the City of Grapevine, Texas, met in a workshop session on Wednesday, February 22, 1984, in the Conference Room, 307 West Dallas Road, with the following members present, to wit: Sharron Spencer Chairman Ron Cook Vice Chairman Harlen Joyce Member Tom Powers Mie nber Shane Wilbanks Member Rick Atkins Member with Member Gerald Norman absent, and the following City Staff, to wit: J.R. Baddaker, P.E. H.T. (Tommy) Hardy Steve Richardson Jov Welch CALL TO ORDER Director of Public Works Building Official City Planner Secretary Chairman Spencer called the meeting to order at 7 PM. OLD BUSINESS Chairman Spencer updated members on the Council Meeting of the previous evening, Tuesday, February 21, 1984, relevant to a workshop session to be held by the City Council on Tuesday, February 28, 1984. She advised that it is not to be a joint workshop; however it would be fine for any member to attend should he so desire. Further Mrs. Spencer advised that hopefully, a recommendation would be available from the Commission fol- lowing their meeting Monday, February 27. Site Plan Review & Approval The primary agenda item for the evening was for the Planning and Zoning Commission to review the revised Site Plan District and to make any corrections, additions or further revisions necessary prior to making a recommendation on such to the City Council. There was a lengthy deliberation relative to reducing the many steps presently required in the platting process; however, the general consensus was ultimately that the the present process is necessary and in the future will likely be expanded rather than reduced due to the City rezoning process. The rezoning will especially increase the necessity of reviewing many more site plans than at present. It was suggested that, while proofing the "Site Plan District ", notations should be made when inclusion is desired in the "Concept Plan" then the Commission, added the words "and Approval" to the title, Section 47, Site Plan, to read "SITE PLAN REVIaV AND APPROVAL ". In A.Applicability, the wording was altered and one clause deleted to read as follows: Site Plans, prepared and approved in accordance with the provisions of this section, shall be required to assist City Officials in the review of certain applications and to assure compliance with all applicable requirements and standards of this Ordinance, and in such other instances as may be required by the terms of this Ordinance. The City shall not issue any building permit until a Site Plan, which is in compliance with the applicable zoning district regulations, is approved as provided in this Section. B. - AUTHORITY should be completely rewritten as follows: P &Z Minutes 2 -22 Page 2 1. The Director of Public Works may, subject to the procedures standards and limitations as stated herein, review and approve residential site plans which meet the following conditions: a. The subject tract does not exceed z acre in size. b. No more than 1 structure is proposed, and all regula- tions and area requirements of the zoning district in which it is being proposed are met. C. The site holds the correct zoning for the proposed use. d. Where applicable, no more than 4 dwelling units are proposed. e. All applicable ordinances and codes are met. f. Additions to any buildings or uses, legally existing at the date of this Ordinance, when such addition does not exceed 200 square feet or one -third (1/3) of the gross floor area of the existing building or use, which- ever is greater. g. Any permitted use of a temporary nature for a period not to exceed one (1) year. The City Secretary and Director of Public Works would be the persons to whom a grievance should be submitted. 2. (Should read, with changes) For all Site Plans not included in B -1, the Planning and Zoning Commission shall review and recommend to the City Council, and approval by City Council shall be required for the following: a. (deleted completely) b. (becomes a) The word above is deleted at end of sentence. C. (becomes b) Should read: Any development or redevelopment within the airport Noise Overlay Districts. d. (Becomes c) Unchanged The sentence beginning The Planning ... and ending... zoning districts, should be deleted and the final sentence of the paragraph should be retained to read: Any Site Plan submitted in connection with a planned development district must be in conformance with the approved Master Development Plan for that district. The final paragraph beginning "Any person aggrieved ... and ending decision of the Planning and Zoning Commission" should be deleted entirely. C. CONTENTS OF SITE PLAN. (This section is a revised version of the old Preliminary and Final Site Plan sections, old pages 5 -10. 9. Phrase "flood plain area" should replace the phrase "existing soil conditions" 10. Delete "number of bedrooms in residential uses" 11. Delete "where relevant and add following the word "structure" "on the site or within 200 feet" 14. Delete the word "dimensions" and replace with "quantity" 17. Delete and replace with "elevation of proposed typical structures" 19. Should read 1" = 200' 23. Delete P &Z Minutes 2 -22 -84 Page 3 D. PROCEDURE FOR PROCESSING SITE PLANS (The g was changed to D) 4. Action by Director of Public Works was worded as follows: Within thirty (30) days following certification by the Director of Public Works of a completed application, or such long time as may be agreed to in writing by the applicant, the Director shall cause such application and the attached site plan to be scheduled for review by the authorized body as established by Section 47 -B. The reviewing body shall then either: (1) approve the appli- cation; (2) approve it subject to the applicant obtaining further specified approvals pursuant to the provisions of this Ordinance; (3) on the basis of written findings in accordance with Section 26, 5F, below, approve it subject to specific modifications; or (4) on the basis of such findings decline to approve the application. Immediately upon conclud- ing the review, the Director of Public Works shall return one copy of the applicant's plans to him marked to show either approval, approval subject to further specified approvals, lack of approval, or approval subject to modifications, which modification shall be clearly and permanently marked on such plans. H. (Changed to "E") 1. Standards (wording altered) Plans submitted pursuant to this section shall not be "denied" (rather than disap- proved) except on the basis of specific written findings dealing with one of more of the following standards.... h. (delete entirely as per Marlin Smith) 2. Alternative Approaches. - Should read as follows: In citing any of the foregoing standards, other than those of subparagraph 1(a), as the basis for declining to approve or for disapproving a site plan, the Director of Public Works, and /or City Council and /or Planning and Zoning Commission shall suggest alternate site plan approaches which could be utilized to avoid the specified deficiency or shall state the reasons why such deficiency cannot be avoided consistent erith the applicant's objectives. (Spelling of "approaches" was corrected) F. Effect of Site Plan Approval - Following "Director of Public Works add "or City Council "; correct spelling of "its" (should be "it ") .G. Limitations on Site Plan Approval - Should read as follows: No site plan approval shall be valid for a period longer than one year from the date such approval is granted unless con- struction is actually begun within that one -year period, and is thereafter diligently pursued to completion or an occupancy permit is obtained and a use commenced within that one -year period. Note: Beginning with Page 6, relettering (G -H) was inserted. There was no further discussion relative to the Site Plan District. P &Z Minutes 2 -22 -84 Page 4 MISCELLANEOUS DISCUSSION & /OR REPORTS Mr. Baddaker advised those present that in a discussion with the City Attorney, Mr. Boyle emphasized the need to advertise and notify property owners with proposed changes conforming to the Master Plan as nearly as possible, and if any changes are necessary, these can be accomplished after the public hearings. In a discussion with Mr. Smith it was noted that "Heavy" Commercial was undesirable as a zoning category and "Highway" Commercial was preferred as originally suggested. There being no further business to come before the Cconission, Chairman Spencer declared that the meeting should be adjourn ed.
