HomeMy WebLinkAbout1984-04-30STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Planning and Zoning Commission of the City of Grapevine, Texas, met in Workshop Session, Monday, April 30, 1984, at 7 :00 PM in the Conference Room, 307 West Dallas Road, with the following persons present, to wit: Sharron Spencer Ron Cook Harlen Joyce Gerald Norman Shane Wilbanks Richard Atkins Peggy Engholm Chairman Vice Chairman Member Member Member Member Member constituting a quorum, with no one absent, and the following City Staff, to wit: James L. Hancock City Manager J.R.Baddaker, P.E. Director of Public Works John Boyle City Attorney H.T.(Tommy)Hardy Building Official Joy Welch Secretary and the following guests from the City Council, to wit: Ted Ware Mayor Pro -Tern Marion Brekken Councilwoman Egg ��N7 Chairman Spencer called the meeting to order at approximately 7:15 PM, and explained the purpose and procedures of such. Further she discussed post- public hearing procedures with City Attorney Boyle, who advised using any newly submitted data for further clarification on subject tracts if it not be a duplication. He advised members to use a consistent motion format when recommending that tracts be tabled for readvertisement, ie., that should the property owner not agree to the readvertisement, it would be recommended to the City Council as proposed and previously advertised. As a matter of record, Mr. Baddaker meeting procedure for taking action the "grid map." OLD BUSINESS WORKSHOP advised those present of the planned on the subject parcels, detailing The Planning and Zoning Commission was first to review, deliberate, and make a recommendation to the City Council relative to the City of Grapevine instituted zoning case to consider the adoption of a new zoning district map for the entire City pursuant to Comprehensive Zoning Ordinance No. 82 -73, as amended, and also to consider, review, and make a recommendation to the City Council relative to Zoning Application Z84 -09 submitted by Mr. Mark Tutun. In a general review of "Grid A ", properties discussed were the Jesse Woods tract, whereby it was noted that he requested "R -7.5" zoning in the public hearing and the Pickering property, advertised for "PRD -6 ". Generally, there was discussion relative to speakers relating to "Grid B" properties. Action was taken on parcels of land as follows: P &Z Meeting 4 -30 -84 Page 2 Parcel 1 The existing zoning on Corp of Engineers property, Parcel 1, is "R -1 ", residential, and the proposed zoning as advertised is "GU" Governmental Use. Following a brief discussion and Mr. Baddaker's briefing on the property location, Rick Atkins made a motion to so recommend to rezone Parcel 1, Corp of Engineers property, to "GU" Governmental Use, with the exception of the Jesse Woods tract (also Parcel 1) on which no action would be taken at present. The motion was duly seconded by Shane Wilbanks and prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parr -al 1 rd The existing zoning on property, legally described as Parcel 154, "R -1 ", Residential, is proposed as advertised as "R- 12.5 ", single - family for 12,500 square foot lots. Mr. Baddaker advised that the area was located in the vicinity of Kimball Road in northwest Grapevine. Then Shane Wilbanks made a motion to recommend that the City Council rezone Parcel 154 "R- 12.5" as advertised, and Peggy Engholm seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 6, Parcel 153 and Parcel 155 Parcels 6, 153 and 155 located in the area of Penn Drive, Redbird Lane from Kimball Road to east of Cross Creek, with 153 covering Lake Crest Addition, 155 Shoreview Estates abutting Kimball Road, advertised to rezone to "R -7.5 ", Single Family, were next discussed, following which Shane Wilbanks made a motion to recommend that the property covered by Parcels, 6, 153 and 155 be recommended for "R -7.5" zoning as advertised, and Rick Atkins seconded the motion. The prevailing vote was as follows: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parr-P-1 7 -A Next the Commission deliberated the merits of zoning a parcel known as the Pickering Park, Parcel 7 -A for "GU Governmental Use. The motion was made by Rick Atkins and seconded by Harlen Joyce to so recommend that the City Council designate Parcel 7 -A for "GU ", and the prevailing vote was as follows: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Pickering Property, Excluding the Park Property The property heard for hardship exemption case, WBP- 83 -09, with "PUD" zoning and granted the exception, north of Dove and east of Kimball owned by Joe Wright, was briefly discussed, after which Commissioner Atkins made a motion to recommend that no action be taken on the subject tract. Commissioner Gerald Norman seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None P &Z Minutes 4 -30 -84 Page 3 Parcel 1 -A Parcel 1 -A, Corps of Engineers "island" was deliberated at length at which time, it was noted that the property owner had requested "C -2" zoning to coincide with existing usage. Commissioner WilbanksI subsequent motion was to recommend that the City Council zone the subject property "C -N ", neighborhood commercial as advertised, and Harlen Joyce seconded the motion, with the vote failing as follows: Ayes: Joyce, Wilbanks Nays: Spencer, Cook, Norman, Atkins & Engholm Then Commissioner Atkins made a motion to take no action on Parcel 1 -A, and Vice Chairman Cook seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Norman, Joyce, Atkins & Engholm Nays: Wilbanks Parcel 2 Next, the Commission considered Parcel 2 located on Dove Loop, west of Russwood and is owned by Mr. W. N. Ryder. The property was advertised to be zoned "R -7.5 ". Following a brief discussion, Member Joyce made a motion to readvertise the subject tract "C -1 ", Commercial,on easterly one -half of the property and that west of Dove Loop Road. The motion failed for lack of a second, after which Vice Chairman Cook made a motion to table action on the subject tract until the following workshop session, and Rick Atkins seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 4 The next parcel, #4, for the Commission to consider, located south of Dove Road, was discussed in the public hearing by Mrs. Pilney, James Mason, Barbara Nunn and Mr. Mitchell, property including the Marina Del Rey townhcmes, the mattress factory, advertised as "R- 12.5 ". Commissioner Wilbanks made a motion to recommend that it be rezoned as "R- -7.5 ", and Harlen Joyce seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 20 The next parcel, #20 which was recommended to be "GU ", Governmental Use, in the advertising was discussed, and Rick Atkins made a motion to recommend "GU" zoning for the parcel as advertised, and Harlen Joyce seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 5 Parcel 5, recommended for "R -7.5 ", Single Family, zoning was discussed by the Commission, after which Shane Wilbanks made a motion to zone Parcel 5 "R -7.5" as advertised, and Gerald Norman seconded the motion which prevailed by the following vote: P &Z Minutes April 30, 1984 Page 4 Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 18 The next tract for consideration by the Ccm-ission, 18, was discussed, and Vice Chairman Cook made a motion to recommend that the tract be zoned "C -N" Neighborhood Commercial. Commissioner Wilbanks seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 11 Following a brief discussion relative to nursing homes being included in "R -MF.2" zoning category, Vice Chairman Cook made a motion to recommend "R -7.5" zoning on Parcel 11, and Shane Wilbanks seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Norman, Wilbanks, Atkins & Engholm Nays: Joyce Parcel 3 The next parcel for consideration by the Commission was Parcel 3, and advertised as "R -7.5" Single Family, Mrs. Corbin's trailer park, was discussed. Mr. Hardy advised that it was annexed into the City and zoned single family; and as a request for an exception submitted to the Board of Zoning Adjustments failed a year ago, whereby a request for expansion was denied, the park would remain non - conforming with no growth allowed. A motion was made by Shane Wilbanks to recommend "R -7.5" Single Family zoning, and Vice Chairman Cook seconded the motion which prevailed by the following vote: Ayes: Cook, Joyce, Norman, Wilbanks, Atkins, & Engholm Nays: Spencer Parcel 22 The next item for consideration by the Commission was Parcel 22, property at the intersection of Dove Road and Dove Loop, advertised as "R -TH ". Mr. Mason who spoke on the property at the public hearings expressed a desire for sane commercial zoning on the subject property. Following a deliberation relative to the requested zoning, Vice Chairman Cook made a motion to recommend zoning the subject property "R -TH" as advertised and Chairman Spencer seconded the motion which failed by the following vote: Ayes: Spencer, Cook, & Wilbanks Nays: Norman, Joyce, Atkins & Engholm Then a motion was made by Richard Atkins to table consideration of Parcel 22, and it was seconded by Gerald Norman, and prevailed by the following vote: Ayes: Joyce, Norman, Wilbanks, Atkins & Engholm Nays: Spencer & Cook P &Z Minutes April 30, 1984 Page 5 Parcel 17 The next item for consideration by the Cmniission, advertised as "R -3.5" for duplexes. Discussion revealed the owner's request for a conmrcial designation for the zoning. Therefore, following a brief discussion, Vice Chairman Cook made a motion to table consideration of the subject tract, and a second was offered by Shane Wilbanks and prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks,_Atkins & Engholm Nays: None Parcel 19 The next item for consideration was Parcel 19, located at Dove and Park. Following a brief discussion, Shane Wilbanks made a motion to table consideration of the subject tract, and Gerald Norman seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 170 The next parcel, 170, advertised "PRD -6 ", owned by Ron Haynes, proposed for "0" Lot Line homes, was discussed briefly, after which Richard Atkins made a motion to take no action on the subject tract, and Gerald Norman seconded the motion, with the prevailing vote as follows: Ayes: Spencer, Cook, Norman, Wilbanks, Atkins, & Engholm Nays: Joyce PnrrPl 171 The next parcel for the Commission to consider, 171, known as Criswell townhomes, advertised to be rezoned "R -MF -1" for condos was briefly discussed. The current zoning on the subject tract is "SP" Specific Use. Richard Atkins made a motion to table consideration of Parcel 171, and following further discussion relative to this property's need to remain at the current zoning, Vice Chairman Cook made a motion to take no action on the Parcel 171, and Shane Wilbanks seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Then, following further discussion, Vice Chairman Cook made a motion to rescind his motion and table recommendation until Tuesday evening's workshop; and Shane Wilbanks offered a second, resulting in the prevailing vote as follows: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 164 Parcel 164 was then to be considered by the Commission with current zoning being "R -3" and the proposed zoning which was advertised for the tract being "PRD -6 ". It was noted that Mr. Joe Wright had requested that the item be tabled; therefore, Gerald Norman so moved to table the item for later consideration, and Shane Wilbanks seconded the motion which prevailed by the following vote: P &Z Minutes April 30, 1984 Page 6 Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 13 Parcel 13 is a portion of the Cluck property on North Main Street with the south boundary line being Wildwood, excluding the steakhouse and non- conforming mobile home park, but including the cemetery. Richard Atkins made a motion to recommend that Parcel 13 be advertised for "R -7.5 ", Single- family, and Harlen Joyce seconded the motion, which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 16 The next parcel, 16 is Hampton Road, west of Dove, presently duplex and townhomes, and advertised for "R -TH ". There being little discussion, a motion was made by Richard Atkins and seconded by Gerald Norman to recommend that the City Council zone the property as advertised, "R -TH" for townhomes. The prevailing vote was as follows: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 175 The next parcel discussed, 175, which is the airport project at the southwest corner of Autumn and Dove, presently "R -3" advertised for "R- MF -2 ". It was noted that no one commented on the tract during the public hearing. Gerald Norman made a motion which was seconded by Harlen Joyce to zone the subject property, Parcel 175, to "R- MF -2 ", and the prevailing vote was as follows: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 152 Parcel 152, presently zoned "R -1" Single - family, proposed for "R -20" was briefly discussed, after which Member Wilbanks made a motion to recommend that the motion be as advertised, "R -20" residential, and Member Norman offered the second, which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins, & Engholm Nays: None Parcel 14 Next to consider was Parcel 14, the Claude Miller property, fronting Northwest Highway, for a proposed hotel, including the Tillery property fronting Dove Road. The subject parcel advertised "P -O ". There was some discussion relative to possible readvertising for part of the property; however, Vice Chairman Cook made a motion to recommend "PO ", Professional Office as advertised, and Commissioner Wilbanks seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins, & Engholm Nays: None P &Z Minutes April 30, 1984 Page 7 Parcel 31 Next to consider, the Commission noted that Parcel 31, included Fox Rental at Dove and Northwest Highway as well as the PDQ, carwash, and gas station at Lucas and Northwest Highway. The property was advertised as "HC" Highway Commercial. First Richard Atkins made a motion to recommend the subject property be rezoned as advertised. The motion, seconded by Harlen Joyce, prevailed by the following vote: Ayes: Cook, Joyce, Atkins, & Norman Nays: Spencer, Wilbanks & Engholm Following further discussion, Gerald Norman made a motion that the previous motion be rescinded, and Shane Wilbanks seconded the motion, which prevailed by the following vote: Ayes: Spencer, Norman, Wilbanks, Atkins & Engholm Nays: Cook & Joyce Then Member Joyce made a motion to recommend "HC" Highway Commercial zoning, and Vice Chairman Cook seconded the motion, but it failed by the following vote: Ayes: Cook, Joyce & Wilbanks Nays: Spencer, Norman, Atkins, Engholm Another attempt at reaching a recommendation for the subject Parcel 31, was made by Mr. Wilbanks who suggested readvertisement to "C -N" Neigh- borhood Commercial, and following further discussion, Mr. Wilbanks withdrew his motion, and Vice Chairman Cook made a motion to table the recommendation, and a second was offered by Shane Wilbanks. The prevailing vote was as follows: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 30 Parcel 30, advertised for "CN" Neighborhood Commercial and including property on both sides of Lucas going to Worthington, was discussed, and Chairman Spencer advised new members of background relative to the Master Plan. City Attorney, John Boyle, advised that limited areas could be readvertised if property owners would sign a written consent to extension of the public hearing. Then, Richard Atkins made a motion to table recommendations relative to Parcel 30, and Shane Wilbanks seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Norman, Wilbanks, Atkins, & Engholm Nays: None Abstain: Joyce Parcel 12 The next consideration was given to Parcel 12, advertised for "R -7.5" Single Family zoning, including Brookhollow Estates to Lucas and including the church property around the existing mobile home park and Lake Forest Addition. It was noted that Joe Wright spoke in the public hearings relative to the "R -3" zoned property. Shane Wilbanks made a motion to recommend "R -7.5" zoning, and Gerald Norman seconded the motion, which prevailed by the following vote: Ayes: Spencer, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: Cook P &Z Minutes April 30, 1984 Page 8 Parcel 32 In discussing Parcel 32, it was noted that it was located immediately west of the previously discussed tract, Parcel 12, along Northwest Highway, running from the rear of lots from Lucas to North Main around the North Main Shopping Center and includes the tile warehouse. Then Richard Atkins made a motion to recommend that the subject parcel, 32, be recommended to have "CC" Community Commercial zoning, and the second was made by Harlen Joyce with the prevailing vote as follows: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Ehgholm Nays: None Parcel 29 Next for consideration by the Ccm-nission, Parcel 29, property located behind the old Gibson store, advertised "R- MF -2 ", owned by Jackie Davis and including Hilltop Apartments was previously zoned "SP" which was granted in 1971. Commissioner Joyce made a motion to recommend that the property be zoned as advertised, "R -MF -2" Multi- family, but the motion failed for lack of a second. Then Commissioner Wilbanks made a motion to table the recommendation on the subject tract, and Vice Chairman Cook seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks & Engholm Nays: Atkins Parcel 28 Parcel 28, presently zoned under the 1971 ordinance with proposed zoning advertised for "PRD -12 ", for planned residential development with a density of 12. Speakers in the public hearing requested "R -7.5" zoning. A petition with 175 signatures was also received. Following a deliberation relative to the subject rezoning, Shane Wilbanks made a motion to recommend "PRD -12" zoning as advertised, and Harlen Joyce offered the second, but following further discussion, Commissioner Joyce withdrew the motion and Shane Wilbanks withdrew the second. Then, following further discussion, Member Harlen Joyce made a motion to zone a portion of the property "PRD -12" and the remainder to "R-NF-2", with a second offered from Gerald Norman and the vote prevailing as follows: Ayes: Cook, Joyce, Atkins, Wilbanks & Ehgholm Nays: Spencer and Norman Parcel 160 Parcel 160, presently Specific Use, advertised to rezone "R -3.5" for three and four plexes, was briefly discussed, following which Harlen Joyce made a motion which was seconded by Shane Wilbanks to recommend that the Council designate the subject parcel for "R -3.5 ". The prevailing vote was as follows: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 161 Parcel 161 located on the east side of Meadowbrook Drive, presently zoned "R -3" and advertised for "R -3.5" Duplex, was briefly discussed, followed by a motion from Vice Chairman Cook and a second from Gerald Norman to recommend that the City Council zone the subject parcel "R -3.5 ". The prevailing vote was as follows: P &Z Minutes April 30, 1984 Page 9 Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 33 Parcel 33, including two Mobile Home Parks located at Scribner and Peach Street, advertised for "R -TH" and previously zoned "R -3" and "MH" were discussed by the Commission. Then Commissioner Joyce made a motion to recommend that the City Council zone the parcel "R -TH" as advertised, and Vice Chairman Cook seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 34 Parcel 34, previously zoned "R -1 ", "R -2, "R -3 ", "C -211, "PUD ", and Site Plan, located north and south of Peach, Scribner to Main, including the Rowbotham parcel (3/4 vote required). The advertised zoning designation was for neighborhood commercial. It was noted that no matter what zoning designation is assigned to the subject parcel, there will be some non - conforming uses. Then Vice Chairman Cook made a motion to recommend "R- 3.75" zoning; however, he withdrew the motion subsequent to further discussion. Then Commissioner Joyce made a motion to rezone everything east of Scribner to "R- 3.75" and everything west of Scribner ... at which point, Mr. Joyce withdrew his motion, to restate the motion to table the recommendation on Parcel 34 for further study. The motion was duly seconded by Commissioner Wilbanks and prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parr-.al 1 ti9 Parcel 169 was discussed having recently been zoned "R- 3.75" with frontage on North Main and Hall Street. Advertisement was for "R -3.5 ". Richard Atkins made a motion to recommend that the Council approve the "R- 3.75" zoning as advertised, and Harlen Joyce seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 37 Parcel 37, located at North Main, north of Safeway and including the nursing home, previously zoned "R -1 ", "R -3" and "C -2 ". Advertised zoning to comply with the recommended usage of the Master Plan was "CN ". Shane Wilbanks made a motion to recommend that the property be recommended for zoning to "CN" Neighborhood Commercial, as advertised, and Richard Atkins seconded the motion which prevailed by the following vote: Ayes: Cook, Joyce, Wilbanks, Atkins & Engho]n Nays: Spencer & Norman Parcel 35 The next parcel considered by the Comnission was #35, the Cluck property, south of Wildwood from North Main and Dooley, presently vacant P &Z Minutes 4 -30 -84 Page 10 and presently "R -1" zoning with medium density recommended for the area, and the advertised zoning being "R -TH" for townhomes. Subsequently, Commissioner Joyce made a motion to recommend "R -TH" as advertised, and Richard Atkins offered the second; however, the motion failed by the following vote: Ayes: Norman, Atkins & Joyce Nays: Spencer, Cook, Norman & Wilbanks Then, Commissioner Wilbanks made a motion to table the recomiendation on the subject Parcel 35 for consideration at a later meeting, and Peggy Engholm seconded the motion which prevailed by the following vote: Ayes: Spencer, Cook, Norman, Wilbanks, Joyce & Engholm Nays: Atkins At approximately 10 PM, Chairman Spencer declared a recess. Following the reconvene, there was an extensive discussion relative to expediting the voting by considering non - controversial tracts first. Parcel 36 It was noted that Parcel 36 includes Cluck Park, the east side of Starnes Street, covering a section running to Dooley. Also it includes the housing authority property. The parcel was advertised for proposed "R-MF -1" zoning. A motion from Richard Atkins to table the recommendation failed for lack of a second; then Chairman Spencer made a motion to table the recommendation until a later meeting, and Richard Atkins then offered a second. The motion prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins, & Engholm Nays: None Parcel 38 Next for the Commission's consideration, a parcel located from north of Northwest Highway to Dooley, south of North Main, including the Yamaha dealership was previously zoned "R -2 "for duplexes and "C -2 "for commercial and the proposed zoning was "HC" Highway Commercial. Following a brief discussion, Vice Chairman Cook made a motion to rec- commend that the Council zone the property "C -C" Community Commercial, and Richard Atkins seconded the motion, which prevailed by the following vote: Ayes: Spencer, Cook, Joyce, Norman, Wilbanks, Atkins & Engholm Nays: None Parcel 48 The next parcel discussed was #48, proposed to rezone "HCO" for Hotel - Corporate Office and advertised as such. The existing zoning was "C -2" for commercial uses, and the property includes the Boyd Center on Northwest Highway to Turner and Dooley to Ruth Wall.
