Any application for a change in zoning or for an amendment to the zoning ordinance shall have, from the date of submittal, a period of four months to request and be scheduled on an agenda before the Planning and Zoning Commission and City Council. If after said period of four months an application has not been scheduled before the Commission and Council said application shall be considered withdrawn, with forfeiture of all filing fees. The application, along with the required filing fee may be resubmitted any time thereafter for reconsideration. Delays in scheduling applications before the Planning and Zoning Commission and City Council created by city staff shall not be considered a part of the four month period. The addition contains 34.52 acres and has approximately 1,465 feet of frontage along Texan Trail and 1,051 feet of frontage along Minters Chapel Road. REQUESTED CONDITIONAL USE AND COMMENTS: The applicant is requesting a conditional use permit to amend the previously approved site and allow for additional parking. Conditional use request CU09-43 was approved by Council at the December 15, 2009 meeting and established the Park Place Mercedes automotive dealership on a 20.4 acre site with one monument sign along Minters Chapel Road and a 20 foot pole sign along Texan Trail. With this request the applicant intends to establish a planned commercial center and incorporate an additional 14.07 acres immediately adjacent to the north into the existing 0:1ZW/CU13-15.4 1 July 10, 2013 (9:24AM) dealership to be used as a parking area for new vehicles for both the Park Place Mercedes and Park Place Lexus dealerships. This expansion area is proposed to be developed in three phases: Phase one will be comprised of 511 spaces to be utilized by both dealerships (232 spaces for Mercedes, 279 spaces for Lexus) with both areas separated internally by a six foot wood screening fence. Phase two will consist of a bridge to physically connect the parking expansion area to the Mercedes dealership. Phase three will consist of an additional 418 parking spaces. The expanded parking area will be protected by a pipe -rail perimeter fence similar to what already exists at the Park Place Mercedes dealership. One point of controlled access is provided to Minters Chapel Road. The applicant is also proposing one monument sign along Minters Chapel Road. PRESENT ZONING AND USE: The property is currently zoned "CC" Community Commercial District and is developed as the Park Place Mercedes automotive dealership. The portion of the property for the expanded parking area is also zoned "CC" Community Commercial District and is vacant undeveloped property. HISTORY OF TRACT AND SURROUNDING AREA: The subject site as well as the properties to the north and south were zoned 1-1" Light Industrial District prior to the 1984 City Rezoning. The property to the west of the subject site was zoned °L-1" Limited Industrial District prior to the 1984 City Rezoning atwhich time it was zoned to "PCD" Planned Commerce Development District. A conditional use permit (CU98-69) was approved on the property to the west in January, 1999 for an automotive dealership (Park Place Lexus). The housing is one-piece, diecast aluminum and mounts directly to a pole or wall without the need of a separate support arm. The multifaceted arc -image duplicating optical systems provide IES Types I, II, III, IV and V distributions. The door frame is single -piece diecast aluminum and retains an optically clear tempered flat glass Iens.The luminaire is completely sealed and gasketed preventing intrusion from moisture, dust and insects.The Gullwing luminaires are finished with a fade and abrasion resistantTGIC powdercoat. HOUSING: A one-piece die cast aluminum housing mounts directly to a pole or wall without the need for a support arm. The low profile rounded form reduces the effective projected area of the luminaire to only 1.2 fta/.11 me. LENS ASSEMBLY: A single -piece diecast aluminum lens frame hinges down from the housing and is secured by a stainless steel lanyard and hinge pin. An optically clear, heat and impact resistant tempered flat glass lens is mechanically secured with eight retainers. The electrical and optical chambers are thoroughly sealed with a one-piece memory retentive hollow -core EPDM gasket to prevent intrusion by moisture, dust, and insects. OPTICAL SYSTEMS: The segmented optical systems are manufactured from homogenous sheet aluminum which has been electrochemically brightened, anodized and sealed.The multifaceted arc image duplicating systems are designed to produce IES Types 1 (1), It (2XL), III (3XL), IV (4XL and BLC), and V (Q). With the 2XL, 3XL and 4XL luminaries, the reflector facets form a conical fan around the arc tube with each facet positioned to be precisely tangent to the top of the arc tube. The lampholder is glazed porcelain with a nickel plated screw shell. Position -oriented mogul base sockets to accept high output horizontal metal halide lamps are supplied standard. ELECTRICAL: All electrical components are UL recognized and factory tested. Electronic and magnetic HID ballasts are high power factor and mounted ona unitized tray with quick electrical disconnects. Magnetic HID ballasts are the separate component type. Electronic and magnetic HID ballasts are capable of providing reliable lamp starting down to -20°F / -29°C. Luminaires provided with the Cosmolsolis or MasterColor Elite high performance ceramic metal halide electronic systems include high power factor electronic ballasts, designed specifically for the system selected. FINISH: Each standard color luminaire receives a fade and abrasion resistant, electrostatically applied, thermally cured, triglycidal isocyanurate (TGIC) textured polyester powdercoat finish. Standard colors include bronze (BRP), black (BLP), white (WP), and natural aluminum (NP). Consult factory for specs on optional or custom colors.
