Any application for a change in zoning or for an amendment to the zoning ordinance shall
have, from the date of submittal, a period of four months to request and be scheduled on an
agenda before the Planning and Zoning Commission and City Council, If after said period of
four months an application has not been scheduled before the Commission and Council said
application shall be considered withdrawn, with forfeiture of all filing fees. The application,
along with the required filing fee may be resubmitted any time thereafter for reconsideration.
Delays in scheduling applications before the Planning and Zoning Commission and City
Council created by city staff shall not be considered a part of the four month period.

2. CU -02 U -Haul — No comments
3. CU -03 King Arthur's — Please include the building construction type on the site plan. Building comments
have already been forwarded to the project architect.
4. CU -04 — Richardson Golf Carts,— Please include the building construction type on the site plan. Any walls
closer than 20 feet to the property lines must be of one-hour fire -resistive construction. Openings are
not permitted closer than 5 feet to the property line. Openings must be protected with a forty-five
minute fire -rating if closer than 10 feet to a property line. A C/O inspection will be made prior to
occupancy to determine if the building needs repair to be brought up to current code standards.
5. CU01-05 — Opryland — No comments per JSW.
6. CU01-06 —Corvette World —Please list the building construction type on the site plan. The north wall
must be one hour fire resistive construction with unprotected openings. All exterior doors must swing
out. Two exit stairs are required from 2000 square foot upper storage room.
7. Grandy's — Please list the building construction type on the site plan. A grease interceptor and a Type I
hood will be required. Will a four inch building sewer carry all the plumbing fixture units?

of CU91-16 (Ord. No. 91-68) for building supplies with outside storage, specifically to
allow the retail sales and service of golf carts, located at 515 East Northwest Highway)

3. A copy of the final plat that is to be approved by City Council must be submitted in
conjunction with this conditional use application. Final plats are required with all
conditional uses. The preliminary plat is not acceptable. Please note that this request
cannot be scheduled for a public hearing until the final plat application has be received
by the Public Works Department.

6. Add the following to the landscape maintenance note shown on the site plan:

Please include elevations of any proposed signage. The elevations should include
dimensions of height, width, depth and total square footage. Please note that the sign
regulations do not allow flashing signs, rotating or moving signs, animated signs, signs
with moving lights, or signs that create the illusion of movements shall be permitted.
A sign on which the current time and/ or temperature as indicated by intermittent
lighting shall not be deemed to be a flashing sign if the lighting changes are limited to
numerals indicating the time temperature or message and do not change more
frequently than every 15 seconds.
Building Inspection Comments

Thursday, February 1. 2001 at 12:00 p.m. Please submit the revised documents to the
Department of Development Services at 200 South Main Street.
The revised submittal shall include:
one (1) mylar of each sheet (minimum size 22" x 34")
two (2) folded blueline copies of each sheet
forty (40) reduced, sorted, and collated copies at 11" x 17" three hole punched,
stapled, and z -folded (fold the right edge to the left edge and then fold the
right edge in half to form a z -fold).
If the correct revisions and appropriate submittals are received by the Department of
Development Services by the due date, you will be tentatively scheduled for the February
20, 2001 joint public hearing at 7:30 p.m.

The following are comments associated with the initial review of the above referenced
site plan. Future plan submittals are subject to further review and therefore may result
in additional comments. The applicant will need to complete the following:
Site Plan:
• The parking layout in the two plans that were submitted differs. The applicant
should clarify the proposed parking layout.
• Drive aisles need to be a minimum of 24 feet. The drive aisles shown on the
plans range from 14 feet to 19 feet.
• A combination of parallel and head -end parking results in poor circulation. The
parallel parking spaces need to be removed.
• On one of the plans, the disabled parking space is aligned with the driveway.
Vehicles backing out of the parking space, will have difficulty seeing vehicles
entering the site through this driveway. Either the drive should be closed or the
parking space moved to a different location.
Miscellaneous:
• The Public Works Department needs a preliminary and final plat.

You received this notice because you are a property owner within 200 feet of the subject
tract of land as shown by the most recent City -approved tax rolls. If you can not or do not
wish to attend the hearing, the attached form is provided for your convenience.
If owners of more than 20% of the property within 200 feet of the subject tract object to the
case, a 3/4 vote of the City Council is required to approve the request. To be considered a
part of the area property owners that object, the attached form, or a written response must
be returned to the Department of Development Services no later that 5:00 p.m. on the day
preceding the public hearing.
You may appear in person during the public hearing to state your opinion concerning the
request in lieu of a written response however, your in-person protest of the referenced case
will not be considered when calculating the percentage of property necessary to require a

Purpose of Request:
The public hearing is to consider an application submitted by Jason Richardson for
property located at 515 East Northwest Highway, and proposed to be platted as Lot 1,
Block 1, Enway Addition. The applicant is requesting approval of an amendment of CU91-
16 (Ord. No. 91-68) for building supplies with outside storage, specifically to allow the retail
sales and service of golf carts. The property is zoned "CC" Community Commercial District,

REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the approved site plan of
of CU91-16 (Ord. No. 91-68). specifically to allow for the retail sales and service of golf
carts.
The site has been developed since the late 1970's. Although several non -conformities
exist on this site, Case No. BZA91-21 was approved in September 1991, authorizing the
site to exist as developed. It should be noted that the applicant is attempting to meet the
intent of the Landscape ordinance by installing landscaping along the front of the building
and in the southeast corner of the site along Northwest Highway and planting ivy along the
eastern wall of the facility.

PRESENT ZONING AND USE:
The property is currently zoned "CC", Community Commercial District and is the site of J's
Closeouts and Bargains.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject property and areas to the north, east and west were rezoned in the 1984 City
Rezoning from "C-2", Community Business District to "CC" Community Commercial District.
Areas to the south were rezoned in the 1984 City Rezoning from "C-2", Community
Business District to "HC", Highway Commercial District. CU87-08 for an automotive body
repair and paint shop, proposed for the subject site, was denied in November 1987. CU91-
16 (Ord. No. 91-58) for a building materials and sprinkler supplies with outside storage was
approved on September 17, 1991. BZA91-21, approved in September 3, 1991, allowed for
the continuation of the nonconforming status of the subject site. CU85-02 (Ord. No. 85-
66), for the Fina gasoline station located to the south of the site, was approved in October
1985, allowing for the retail sale and storage and off -premise consumption of alcoholic
beverages (beer only) in conjunction with a convenience store. CU89-06 was approved
for the same site in May 1986, allowing for modification of the landscape plan. The
property to the west was developed as a gasoline station with auto repair in the early
1980's. CU92-04 (Ord. No. 92-36 was approved in July 1992 allowing for the possession,
storage and retail sale and off -premise consumption of alcoholic beverages (beer only) in
conjunction with a convenience store.
SURROUNDING ZONING AND EXISTING LAND USE:
NORTH: "CC", Community Commercial District — Conseco Warehouse and
Storage
SOUTH: "CC", Community Commercial District — Fina gasoline station and
convenience store and Jiffy Lube
EAST: "CC", Community Commercial District - Vacant
WEST: "CC", Community Commercial District — Texaco gasoline station and
convenience store
AIRPORT IMPACT:
The subject tract is located within "Zone A" Zone of Minimal Effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" Map. Few
activities will be affected by aircraft sounds in "Zone A" except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal

is an appropriate use in this noise zone.
MASTER PLAN APPLICATION:
The Master Plan designates the subject property as Commercial. The proposed golf cart
sales and service facility complies with this designation.
THOROUGHFARE PLAN APPLICATION:
The Thoroughfare Plan designates Northwest Highway as a Type C Minor Arterial with a
minimum 80 -foot right-of-way developed as 4 lanes and turn lane.

This is an existing building on an existing developed lot which fronts West Northwest Highwa?LAN N I NG
near the intersection of Dooley. The owner wishes to lease the building for the sale and
maintenance of golf carts. All work will be performed within the building although there will most
likely be limited storage of carts behind the building.
It is anticipated that there will be no more than three owner/employees and three to four
customers at the store at any one time.
Although the onsite maneuvering of vehicles is very tight it can be done as drawn.
Two oak trees are shown in the Right of Way since this is the only place to plant a tree. A small
planting of Bufford holly at the street is possible, as is ivy along the east side of the building, and
existing plants in the front planter will be maintained. Hand watering is adequate.
No change of zoning is required. Conditional Use Permit is required. The lot is not plated but
described by metes and bounds.
