HomeMy WebLinkAboutORD 2000-049 ORDINANCE NO. 2000-49 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AMENDING THE GRAPEVINE CODE OF ORDINANCES, CHAPTER 7 BUILDING AND CONSTRUCTION, SECTION 7-3 RELATIVE TO THE 1994 UNIFORM BUILDING CODE, AS AMENDED, REPEALING CONFLICTING ORDINANCES, PROVIDING A PENALTY, NOT TO EXCEED TWO THOUSAND DOLLARS ($2,000.00) FOR EACH SEPARATE OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; PROVIDING A SEVERABILITY CLAUSE, DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Grapevine provides the minimum standards to safeguard persons and property from hazards arising from fire; and WHEREAS, the City of Grapevine currently has adopted the Uniform Building Code, 1994 Edition with certain deletions and amendments, which code is in the City of Grapevine Code of Ordinances; and WHEREAS, the International Conference of Building Officials, has promulgated the 1994 Edition of the Uniform Building Code relating to building and fire safety; and WHEREAS, Staff recommends that all hotels and motels regardless of height comply with Section 403 of the Uniform Building Code that the City of Grapevine currently mandates for hotels and motels over three (3) stories in height; WHEREAS, the City Council of the City of Grapevine, Texas hereby amends parts of the 1994 Uniform Building Code of the City of Grapevine Code of Ordinances as more fully described in Section 3, and the City Council finds that such amendments are in the best interest of the health, safety and welfare of the citizens of the City of Grapevine. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the preamble are found to be true and correct and are incorporated herein as if copied in their entirety. Section 2. That the City of Grapevine adopts the amendments to the Uniform Building Code, with regard to requiring all hotels and motels to meet specifications of Section 403 of the Uniform Building Code. Section 3. That Chapter 7, Building and Construction, Section 7-3 Amendments, Subsection 403.1(a) is hereby amended in its entirety to read as follows: "(a) Scope. This section applies to all Group B, Office Buildings and Group R, Division 1 Occupancies, each having floors used for human occupancy located more than 48 feet above the lowest level of fire department access or four (4) or more stories in height, whichever is more restrictive, and all Group R, Division 1, Hotel and Motel Occupancies regardless of height. Such buildings shall be of Type I or II construction and shall be provided with an approved automatic sprinkler system in accordance with Section 403.2." Section 4. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00) for each offense and a separate offense shall be deemed committed each day during or on which an offense occurs or continues. Section 5. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 6. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage, and it is accordingly so ordained.
