AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS, AMENDING THE GRAPEVINE
CODE OF ORDINANCES, CHAPTER 13 LIBRARY,
SECTION 13-3 LIBRARY FINES; PROVIDING FOR THE
REPEAL OF CONFLICTING ORDINANCES; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A PENALTY NOT
TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS
($500.00) AND A SEPARATE OFFENSE SHALL BE
DEEMED COMMITTED UPON EACH DAY DURING OR ON
WHICH A VIOLATION OCCURS; DECLARING AN
EMERGENCY AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE,
TEXAS:
Section 1. That the Grapevine Code of Ordinances is hereby amended by
amending Chapter 13, Section 13-3 in its entirety to read as follows:
" Sec. 13-3. Library Extended Use and Other Fees.
Library extended use and other fees for the Grapevine Public Library are hereby
set and established as follows:
(a) An extended use fee of $0.10 a day will be charged for each library item
not returned by the date it is due.
(b) A fee of$1.00 will be charged to replace lost library cards.
(c) An extended use fee of $1.00 a day will be charged for each piece of
equipment not returned by the date it is due.
(d) A fee of $25.00 per year per family is hereby established for library
patrons residing outside of Grapevine. All entities having a reciprocal or
interlocal agreement with Grapevine for library services, and Grapevine
city employees are exempt from said fee."
Section 2. That all ordinances or any parts thereof in conflict with the terms of
this ordinance shall be and hereby are deemed repealed and of no force and effect.
Section 3. If any section, article, paragraph, sentence, clause, phrase or word
in this ordinance, or application thereto to any person or circumstances is held invalid or
unconstitutional by a Court of competent jurisdiction, such holding shall not affect the
validity of the remaining portions of the ordinance; and the City council hereby declares
it would have passed such remaining portions of the ordinance despite such invalidity,
which remaining portions shall remain in full force and effect.
Section 4. Any person violating any of the provisions of this ordinance shall be
deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not
to exceed five hundred dollars ($500.00) for each offense and a separate offense shall
be deemed committed upon each day during or on which a violation occurs or continues
after the notice period provided herein has expired.
Section 5. The fact that the present ordinances of the City of Grapevine
establishing library fines and fees at the Grapevine Public Library do not adequately
protect the investment thereof creates an urgency and an emergency and in the
preservation of this public health, safety and welfare requires that this ordinance shall
take effect immediately from and after its passage and the publication of the caption as
the law and charter in such cases provides.
