REQUESTED ZONE CHANGE, CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the Previously approved site
plan of CU97 -31 (Ord. 97 -69) for a restaurant with the possession, storage, retail sale, and
on- premise consumption of alcoholic beverages (beer, wine and mixed beverages)
specifically to allow outside dining. The applicant is also requesting a zoning change to
rezone approximately 0.2 acres from "R -7.5" Single Family District to "CBD" Central
Business District to expand the restaurant site specifically to add more parkin.
At the July 19, 2011 meeting the applicant requested to allow outside dining for 80 patrons
along the front (north) and west side of the existing Esparza's restaurant. To
accommodate the additional parking required for the increased seating, the applicant
presented a parking plan that included on- street parking along both sides of East Worth
Street between Jenkins and Smith Streets (31 spaces) and 16 spaces in a lot at the

northeast corner of Jenkins and East Worth Streets that the applicant, Mr. Steve Brown
has under contract. Conversation centered on the possibility of Mr. Brown providing more
parking on the property he has under contract by demolishing the existing multi- tenant
building along with a proposal presented by Mr. Brown whereby he would rezone,
subdivide and replat the lot which he owns immediately adjacent to the restaurant to the
east to be used for on -site off - street parking. In order to pursue these options and to
prepare a new site plan, the request was tabled to the August 16, 2011 meeting.
Since that meeting a new proposal has been discussed in which the City would purchase
the lot at the northeast corner of Jenkins and East Worth Street and convert it to public
parking. With the removal of the existing structure, 36 parking spaces can be created for
use by visitors. In addition Mr. Brown proposes to rezone and replat 0.2 acres immediately
adjacent to the east to create an additional 20 on -site off - street parking spaces for use by
his patrons. He also intends to widen the drive that accesses the parking area from East
Worth Street to provide safer ingress /egress to the site. With these two parking options in
place, there is no need to consider on- street parking to meet the total parking requirement.
With this request the applicant proposes to allow outside dining at the front of the property
along Fast Worth Street and along the western property line. Total outdoor seating will
accommodate 80 patrons. No outside speakers are associated with this request and the
interior seating will remain unchanged at 211 seats. A total of 97 parking spaces are
required for the restaurant including both inside and outside dining (291 seats). On -site
the applicant has now provided 71 spaces. The applicant is also asking consideration for
the potential 36 off-street parking spaces at the northeast corner of Jenkins and East
Worth Street to be utilized by restaurant patrons and other visitors to the City that will be
created after the demolition of the existing structure and creation of the new parking lot.

spaces.

Subdividing and rezoning a portion of the lot immediately adjacent to the east that will
remain zoned as "R -7.5U Single Family District creates a slight nonconforming issue with an
encroachment into the front yard setback for the existing structure and buffer area
separation along the western property line which will require consideration by the Board of
Zoning Adjustment at their August 29, 2011 meeting; other than these existing issues, the
newly created lot is in complete conformance with the zoning ordinance.
Along with the request to allow for the outside dining, the applicant proposes to construct a
new drive at the southern end of the site to allow access to and from Franklin Street.

PRESENT ZONING AND USE:
The subject property is currently zoned "CBD" Central Business District and is developed
as a restaurant. The 0.2 acre parcel to be rezoned and reconfigured into the restaurant
site plan is currently zoned "R -7.5" Single Family District and is developed as a single
family residence.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject property was rezoned from "C -2" Community Business District to Specific Use
Permit for the possession, storage, retail sale, and on- premise consumption of alcoholic
beverages incidental to the operation of a restaurant in accordance with the approved site
plan (Ordinance 80 -69). The subject property was rezoned from the Specific Use Permit in
the 1984 City Rezoning to Central Business District. Conditional Use Permit CU89 -20
(Ordinance 90 -10) allowed for the sale, storage and on- premise consumption of alcoholic
beverages (beer, wine and mixed drinks only). Zone Change Request Z97 -14 and
Conditional Use Request CU97 -31 were considered at Council's July 1, 1997 meeting to
allow for a .44 acre lot immediately to the rear of the subject site zoned "R -7.5" Single
family District, to be utilized for parking for the existing restaurant and to allow for outside
dining at the front (north) and along the west side of the restaurant. The zone change
application was approved however, the conditional use application specifically relative to
the outside dining on the patio area to the west was denied. The Site Plan Review
Committee at their August 29, 2001 meeting approved a small modification to the existing
site plan for the subject site (CU01 -43) to accommodate upgrades to the kitchen area. The
Site Plan Review Committee at their April 24, 2002 meeting approved a conditional use
permit (CU02 -06) which amended the exterior elevations to the existing restaurant on the
subject site and the interior seating area but with no increase in seating. The Site Plan
Review Committee at their December 17, 2003 meeting approved a conditional use permit
(CU03 -49) that simply reconsidered the previous amendments associated with CU02 -06
that had expired with no action taken. No other changes were proposed. The properties
to the north, south and west were rezoned from "C -2" Community Business to "CBD"
Central Business District during the 1984 City Rezoning and are developed as commercial
uses. The properties to the east were rezoned from "R -1" Single Family District to "R -7.5"
Single Family District and are developed as residential uses.

AIRPORT IMPACT:
The subject tract is located within "Zone A" zone of minimal effect as defined on the
"Aircraft Sound Exposure: Dallas /Fort Worth Regional Airport Environs" map. Few
activities will be affected by aircraft sounds in Zone A, except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal
is an appropriate use in this noise zone.
MASTER PLAN APPLICATION:
The Master Plan designates the existing portion of the subject property as a Central
Business District land use which is in compliance with the Master Plan. The Master Plan
designates that portion of the request associated with the rezoning of 0.2 acres from "R-
7.5" Single Family District to "CBD" Central Business District as a Low - Density Residential
land use which is not in compliance with the Master Plan.

DESCRIPTION OF PROPOSED CONDITIONAL USE I SITE PLAN
APPROVAL REQUEST
We respectfiilly request approval of our Conditional Use / Site Plan Submittal as it relates to
Esparza's Restaurant and as delineated on our development site plan package.
INTENT:
It is the intent of this conditional use I site plan submittal to request approval for the use of
existing and available off site parking spaces by Esparza's Restaurant. This request also includes
approval for a portion of said existing off site parking spaces to be counted towards the needed
additional Esparza's Restaurant needs. Said additional parking spaces would be required to
allow Esparza's Restaurant to provide outside Patio Dining and Beverage Waiter Services, at
their existing patio seating area. The existing outside Patio Seating Area is delineated on the
attached Esparza's Restaurant Site Plan.
This Conditional Use I Site Plan submittal approval request is based on the following proposed
improvements and existing conditions, thus providing a solution to the existing seating /parking
ratio issues. For the sake of clarity we have identified each property area by a letter assignment
and provided basic description of their proposed contributions to a positive parking issue
solution.

The above stipulated existing seating / parking ratio illustrates the need for an additional 46
parking spaces, inorder to not only comply with the City Ordinances, but to also provide
adequate restaurant customer services. Based on this information, we propose the following Site
Parking options. Said proposed options would provide a positive and orderly solution for both
the City of Grapevine and Esparza's Restaurant.
II AREA "A" — ESPARZA'S RESTAURANT —124 E. WORTH STREET:
The existing Seating 1 Parking Ratio has been described above under (Existing Site Date), and
based on said scenario, we provide the following improvements to said site.
We propose that a new concrete drive approach be allowed to be constructed on the
South Property onto Franklin Street. This improvement would accomplishes the
following:
• Provide needed access onto the restaurant property during the upcoming
reconstruction/improvements to E. Worth Street, thus facilitating scheduled
Public Works Scope of Work.
• Would provide an alternative route for emergency response vehicles and greatly
improve site access from two City Streets.
• Contribute to creating a positive on site traffic flow and onto City Streets.
2. The proposed new site driveway approach would not negatively impact the continuity
of sense of community in the City or surrounding areas.
3. This solution would improve the existing entry driveway off E. Worth Street and
contribute to the ongoing enjoyment of the City of Grapevine Down Town District.
Based on the positive information provided above, we request approval of said proposed new
Franklin Street Driveway Approach.
III AREA "B" — 204 E. WORTH STREET:
In an effort to reduce the on street parking along E. Worth Street, we request that the additional
parking area illustrated as Area "B" be allowed. This effort would contribute an additional 20
parking spaces, thus resulting in a new combined onsite parking of 71 spaces. This opportunity
would result in the following improvement:
The above noted option would be accomplished by allowing the property located at 204
E. Worth Street to be sub - divided into (2) two lots as illustrated on Sheet # SP1.2.

2. The front portion of said lot would retain the existing SF -7.5 Zoning, while the rear
portion would be changed to a CBD Zoning and become part of the existing Esparza's lot
area.
By allowing the zoning change, the new combined onsite parking calculation would
result in an increase from 51 to 71 parking spaces.
4. Another positive result of this effort is that it would provide the opportunity to enlarge
the existing driveway from 14 feet wide to approximately 26 feet wide. This would allow
a safer ingress / egress to the existing restaurant site off E. Worth Street.
Based on the information provided above we request approval of said zoning change and
amended plat submittal as illustrated on our Sheet #SP1.2
IV AREA "C" — EXISTING PUBLIC PARKING LOT:
Due to the close proximity of the existing public parking lot to Esparza's Restaurant, we propose
that the existing parking spaces be counted towards the additional required parking. Based on
this information we offer the following solution:
1. This Public Lot contains 70 parking spaces, for use by the general public in support of
other existing Downtown Business, with Esparza's Restaurant being one major player.
Based on this information, we request approval for the allowance for the use of available parking
Spaces, to be counted and contribute towards the additional needed parking by Esparza's
Restaurant.
IV AREA "D"— SINGLE STORY OFFICE BLDG. —115 E. WORTH STREET:
As discussed during our meeting, it is our understanding that the City intends to enter into a
property purchase agreement for said property. This purchase agreement by the City would
make provisions for additional public parking spaces, which could be used by Esparza's
Restaurant Customers. Based on the preliminary site design information received from Public
Works, the following stipulates the overall site improvements to be developed, as illustrated on
Sheet SP1.1. creating the following benefits.
1. The overall existing site would be improved as follows:
• Per discussion with City Public Works the existing building structure would be
removed and the overall site improved as follows:
• The City desire to have a more controlled access onto the site, a new curb drive

• As part of said street re- construction, it is our understanding that new concrete side
walks would also be installed as illustrated on site plan.
• The above stipulated new driveway approaches would eliminate the existing
continuous curb cuts and create an organized and positive traffic circulation
flow on and off said streets.
• This solution would provide public access from the existing Public Parking Lot Area
"C ", and also to E. Worth Street / Esparza's Restaurant, in a safe and orderly manner.
2. Based on our Area "D" Site Plan delineation, we have calculated a contribution of 36
available additional parking spaces, to be used as general public parking.
VI PARKING CALCULATION SUMMARY:
With the combination of the various available options, we believe that these proposed solutions
would benefit not only Esparza's Restaurant, but also the city of Grapevine. The following
illustrates the combined proposed parking calculations, which reflects the opportunity of
achieving a positive solution towards the additional parking needs.

As previously noted under "Existing Site Data", Esparza's Restaurant parking count illustrates a
deficiency of 46 spaces. The parking calculations described above, present an opportunity to not
only meet said needs but exceed the required number and still provide 80 available general
public parking spaces beyond the Esparza's Restaurant required needs.

Our proposed Site Plan and Conditional Use request provides the following substantial

continuity or sense of community in the City of Grapevine. We have an opportunity to not only
provide the necessary additional parking spaces to Esparza's Restaurant, but to also service the
many visitors to the City of Grapevine, and at the end, it's a win solution for both.

Based on said information, we feel that our proposed Site Plan / Conditional Use request
provides a sound solution and identifies various options available to resolve the existing parking
situation. The above noted solutions protect the general provisions of the Zoning / Development
Ordinances, which provides for the orderly, safe and healthful development within the City. Our
proposal does not disregard, but supports the health, safety and general welfare of the entire
community and its visitors.
We request that our Site Plan / Conditional Use Submittal request — allowing the proposed off

WHEREAS, the City Council of the City of Grapevine, Texas at a public hearing
called by the City Council of the City of Grapevine, Texas did consider the following factors
in making a determination as to whether this requested change should be granted or
denied; effect on the congestion of the streets, the fire hazards, panics and other dangers
possibly present in the securing of safety from same, the effect on the promotion of health
and the general welfare, the effect on adequate light and air, the effect on the

a public necessity for the zoning change, that the public demands it, that the public interest
clearly requires the amendment, that the zoning changes do not unreasonably invade the
