PUBLIC HEARING BOARD OF ZONING ADJUSTMENT CASE BZA15-03, NEAL COOPER, 526 EAST WORTH STREET The first item for the Board of Zoning Adjustment to consider was BZA15-03 submitted by Neal Cooper representing property owner Marty Watkins for property located at 526 East Worth Street, platted as Lot 7, Block 110, College Heights Addition. Section 15.F.2., "R-7.5" Single Family District, Density Requirements, requires a minimum lot area of 7,500 square feet. The applicant requested a variance of 500- sqaure feet allowing a lot area of 7,000 square feet for an existing lot. Section 15.G.4., "R-7.5" Single Family District, Area Regulations, requires a minimum lot width of 65 -feet. The applicant requested a variance of fifteen -feet (15') allowing a lot width of fifty (50') feet for an existing lot. Section 15.G.1, "R-7.5" Single Family District, Area Regulations requires a minimum front yard setback of 30 -feet. The applicant requested a variance of eight feet (8'), allowing a front yard setback along the north property line of 22 -feet. Mr. Triplett explained that Staff found a special condition existed for the requested variances to lot area and lot width. Specifically, the subject site was originally platted in 1921 predating the City's first zoning ordinance adopted in 1955. Developed and platted property and right-of-way existed adjacent to the subject site, on the west, east, south and north property lines respectively, eliminating the possibility to expand the site to meet the area and width requirements. Staff found no special condition for the requested variance to encroach into the required front yard setback. Mr. Triplett went on to explain that the subject site was unimproved and the applicant intended to build an approximate 2,796 square foot single story dwelling as shown on the plot plan. A Certificate of Appropriateness (CA15-14) had been approved by the Historic Preservation Commission on February 25, 2015. With no questions for Mr. Triplett, Neil Cooper, representing property owner Marty Watkins of 613 East Texas Street, Grapevine, Texas, took the Oath of Truth; he gave a brief presentation to the Board and requested favorable consideration of his request and offered to answer any questions of the Board. Chairman Holt announced that two (2) letter of opposition had been received. With no questions for Mr. Cooper and no additional speakers, Robert Rainwater made a motion to close the public hearing. Ken White seconded the motion which prevailed by the following vote: Ayes: Holt, Rainwater, White, Morris Nays: None Absent: Dalton, Bentley Ken White made a motion that a special condition existed for the variances requested with regards to lot area and lot width. LIMITATION OF USES: No more than three (3) persons unrelated by blood or marriage may occupy residences within an R-7.5 Single Family District. 2. BACKGROUND: Certificate of Appropriateness application #CA15-14 was submitted on February 11, 2015 by Neal Cooper to construct a new Cameron -style house following the City of Grapevine Design Guidelines for Historic Residential Structures. The house has been designed to adhere to the additional provisions of the Grapevine Historic Preservation ordinance that were adopted in June 2013. This lot is located within the boundary of the College Heights Addition that is listed on the National Register of Historic Places. It is included in the Original Grapevine Township boundary to of the City of Grapevine. This area encompasses some of the most concentrated and intact collections of late nineteenth and early twentieth century houses in the city of Grapevine. The surrounding contributing sites with structures erected between ca. 1889 and ca. 1950, represent the efforts of many of Grapevine's leading merchants and professionals, as well as farmers and wage earners during the period of significance. This area provides some of the city's best examples of buildings associated with people and events that made significant contributions to the history of Grapevine. The reason I am opposed to the City of Grapevine granting any variance to the building of a new home requiring several lot size/home size variances is due to the impact this new home construction might have on the homes which would border this new construction. I am living the problems which new home construction creates on existing homes. A home was built on a vacant lot which is behind my home. At the time, several variances were granted due to lot size and home size. The home built which is located directly behind my property line and was granted with several variances has created flooding issues for me. My home was built 70 years ago. My garage has a dirt/rock floor. The drainage from the home behind me floods into back yard and garage when it rains. I am sure there was planning during the construction of this new home, but until we experience weather conditions (Rain/Snow/Ice) in real life, the planning of new construction is just that.... Planning. I have brought in over 500lbs. of top soil to help prevent the flooding in the back yard and garage, and am still experiencing the flooding problem. The City has put in place building regulations, which should be observed and enforced. I would assume these regulations are designed to prevent damages and problems such as flooding and other unforeseen problems. Problems and issues that can only be experienced in "Real Life" conditions such as a rain shower, thunder storm, snow/ice melt off. Due to the drought N. Texas was experiencing during construction, these problems did not occur, it has only been in the last 6-8 months where these problems have surfaced due to near normal rain/snow fall. I am opposed to any variance for new home construction in the historic district. The regulations put in place by the City are/should be designed to protect and maintain the integrity, safety and wellbeing of the existing historic homes built 50, 60 & 70 years ago.
