request will change the zoning to "CC" Community Commercial District and establish consistent zoning throughout the site. Two parcels will be reconfigured into one lot which will enable the applicant to re- establish the location of the automobile tube center onto the portion of the reconfigured lot which is currently undeveloped. An existing monument sign will be removed upon commencement of the road widening and a 20 -foot, 98.77 square foot pole sign is proposed on the subject site as a replacement sign. Please see the attached letters. If approved this will be the first reading of an ordinance given the subject site requires approval of four variances relative to the minimum open space and maximum impervious area for the reconfigured lot and a front and side yard setback encroachment for the existing structure (automobile tube center) before the Board of Zoning Adjustment at their November 2, 2009 meeting. If approved by the Board the second reading will occur at the Council's November 17, 2009 meeting. PRESENT ZONING AND USE: The property is currently zoned "LI" Light Industrial District and "CC" Community Commercial District. A portion of the site is developed with a car wash and automobile lube center and the remainder of the site is undeveloped. The subject property was rezoned from "C -W" Commercial Warehouse to "LI" Light Industrial District in the 1984 Citywide Rezoning. Service Station permit (SS94 -02) was approved by City Council on July 19, 1994 for the car wash and oil change facility. At the February 26, 1996 meeting, the vacant portion of the subject site was rezoned from "LI" Light Industrial District to "CC" Community Commercial District with Zone Change Request Z95 -20 (Ord. 96 -11). Conditional Use Request CU01 -15 was approved at the March 22, 2001 Site Plan Review Committee meeting which allowed for replacement of a monument sign with a new monument sign. The property to the north was rezoned in the 1984 City Rezoning from 1 -1" Light Industrial district to "LI ", Light Industrial District. The western portion of the property to the north was rezoned from "1 -2 ", Heavy Industrial District to "LI ", Light Industrial District at that time. SU97 -03 approved the installation of a 35 -foot telecommunications tower with the accompanying equipment cabinet in February 1997. It was not installed and the special use permit expired. The property tax & improvements will decline from the proposed $56,895 to approximately $19,113 a decline of $42,931. The sales tax generated will cease to exist which is an additional decline of approximately $70,000 annually. With Variance approval, property tax & improvements will increase from $19,113 to $62,044 an increase of $42,931. Action Plan Initiated: Mr. Warden & Mr. Hodge discussed the purchase of the vacant land adjacent to the car wash. The plan is to re -build the lube center and to re- develop the lot so the car wash can maintain its operations. The points of concern requiring exception discussed with Mr. Hodge with regards to the development of the new site are listed below. Mr. Hodge agreed with the overall logic and supported this endeavor. 1. Landscape set back requirement in front on both properties. Without an exception the car wash is inoperable. There isn't enough room from the new right of way line "ROW" to manage cars exiting the car wash tunnel. 2. Rear cross access. This can only be achieved through an exception to build up to the rear property line. Mr. Warden had numerous meetings and conversations over many months with Mr. Scott Hall the right of way coordinator "TxDOT ", Curtis Loftis the design engineer "TxDOT" in addition to Mr. Jerry Hodge Director of Transportation Projects with the City of Grapevine with regard to all of these challenges. With verbal agreement by all that the plans, suggestions and needs were all reasonable and viable Mr. Warden moved forward with the acquisition of Mustang Elite Car Wash & Lube Center along with the acquisition and development of the adjacent property. Conclusion: Mr. Warden is requesting approval of the Conditional Use Plan(CU09 -34), re- zoning(Z09- 06), plat, and the necessary variances that will be presented to the Board of Zoning Adjustments . Once approved Mr. Warden will begin the construction process to relocate the tube center on the acquired property along with the development of the access to entry/exit for the combined car wash & lube center. This will allow service to be continuous for customers at today's standards with as little disruption as possible during the Highway project.
