PROJECT DESCRIPTION: CU22-27; Fresenius Kidney Care – submitted by
John Odom for property located at 300 South Park Boulevard and platted as
Block 1, Lot 6R, Park and Wall Office Park. The applicant is requesting a
conditional use permit to amend the previously approved site plan of CU20-03
(Ord.2020-15) for a planned commercial center, CU21-05 (SPRC) for the
development of a 11,500 sq. ft medical office building, specifically for the
addition of an exterior, screened standby emergency generator. The property is
currently zoned “CC” Community Commercial District and owned by The Makens
Company.

RECOMMENDATION
Staff recommends the Site Plan Review Committee (SPRC) consider the proposed
changes to conditional use request CU20-03 (Ord. 2020-15) to amend the previously
approved site plans, CU88-06 (Ord. 1988-74), CU90-10 (Ord. 1990-41), CU90-14 (Ord.
1990-76), CU91-20 (Ord. 1991-82), CU94-34 (Ord. 1994-108), CU95-09 (Ord. 1995-
24), CU96-11 (Ord. 1996-34), CU97-20 (Ord. 1997-54), CU98-11 (Ord. 1998-47),
CU98-46 (Ord. 1999-26), CU99-70 (Ord. 2000-15), CU06-17 (Ord. 2006-41), CU11-35
(Ord. 2012-03), CU14-39 (Ord. 2014-65), CU15-49 (Ord. 2016-06), and CU20-03 (Ord.
2020-16), specifically for the addition of an exterior enclosed standby emergency
generator. The property is zoned “CC”, Community Commercial District and is owned
by The Makens Company.
REQUEST
The applicant proposes the addition of a standby emergency generator and screening
enclosure to the southeast rear of a planned dialysis clinic. The proposed generator is 8
foot 5 inches in height and screening enclosure is 11 foot 4 inches in height.
BACKGROUND INFORMATION
On September 20, 1988 City Council approved CU88-06 (Ord. 1988-74) for
development of a planned commercial center, a 40-foot pole sign to be located at the
corner of Park Boulevard, State Highway 114 and Wall Street, and to allow the Tom
Thumb grocery store (Lot 4) off-premise alcoholic beverage sales. The property is
currently developed with a 1,260 square foot convenience store with four gasoline
pumps, two 20 foot tall pole signs, a 2,500 square foot dry cleaner, an 11,238 square
foot multi-tenant, single story office center, a 60,243 square foot Tom Thumb grocery
store, a 40-foot pole sign, and a 21,118 square foot multi-tenant shopping center.
The subject site was zoned “R-1”, Single Family District prior to the 1984 City-wide
rezoning at which time the subject site was rezoned to “PO”, Professional Office. The

subject property was rezoned to “CC”, Community Commercial with (Z87-02) on
October 17, 1995.
• On July 17, 1990, City Council approved CU90-10 (Ord. 1990-41) with
amendments to allow Tom Thumb on Lot 4 a 3,480 square foot addition to the
entry vestibule, amend the area for beer and wine storage, add temporary
promotional display areas for beer and wine, relocate both store entries and the
handicapped parking spaces to provide several cart storage areas in the parking
islands, and revise the exterior building facades.
• On November 20, 1990, City Council approved CU90-14 (Ord. 1990-76) to allow
gasoline sales, a convenience store with off-premise consumption of alcoholic
beverages, and a car wash at Chevron located on Lot 1.
• On November 19, 1991, City Council approved CU91-20 (Ord. 1991-82) to allow
Tom Thumb on Lot 4 to enlarge the vestibule area by 496 square foot.
• On December 20, 1994, City Council approved CU94-34 (Ord. 1994-108) to
allow on-premise consumption of alcoholic beverages in conjunction with Zuzu’s
Mexican Restaurant located on Lot 5.
• On April 4, 1995, City Council approved CU95-09 (Ord. 1995-24) to allow a
11,238 square foot strip office center on Lot 3.
• On May 21, 1996, City Council approved CU96-11 (Ord. 1996-34) to allow
outdoor storage of wood in conjunction with a restaurant, Sonny Bryans
Smokehouse on Lot 5.
• On June 3, 1997, City Council approved CU97-20 (Ord. 1997-54) to allow a
3,600 square foot building for personal service and retail development on Lot 2.
• On April 21, 1997, City Council approved CU98-11 (Ord. 1998-47) to reduce the
building area of the previously approved building on Lot 2.
• On February 16, 1999, City Council approved CU98-46 (Ord. 1999-26) to allow
for the addition of a 12,984 square foot retail space on Lot 6R.
• On February 15, 2000, City Council approved CU99-70 (Ord. 2000-15) to allow
for outside dining and alcoholic beverage consumption in conjunction with a
restaurant, Sonny Bryans Smokehouse on Lot 5.
• On June 20, 2006, City Council approved CU06-17 (Ord. 2006-41) to allow for
new office buildings on Lot 6R.
• On January 17, 2012, City Council approved CU11-35 (Ord. 2012-03) to allow for
the development of office condominiums on Lot 6R.
• On October 21, 2014, City Council approved CU14-39 (Ord. 2014-65) to allow for
on-premise consumption of alcoholic beverages (beer and wine only), outdoor
speakers, and outside dining in conjunction with Wise Guy’s Pizzeria restaurant
on Lot 5.
• On January 19, 2016, City Council approved CU15-49 (Ord. 2016-06) to allow for

off-premise consumption of beer only and on-premise consumption of beer and
wine in conjunction with a restaurant Wise Guy’s Pizzeria on Lot 5 (322 South
Park Boulevard).
• On May 17, 2016, City Council approved SU16-01 (Ord. 2016-38) to allow for
massage services on Lot 3R.
• On May 17, 2020, City Council approved CU20-03 (Ord. 2020-16) to allow for
rebranding of the existing Chevron gas station into a Tom Thumb convenience
store and to allow vehicular access between Lots 1 and 2 by creating two new
drive aisles.
