improvements.

SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA22-10
1039 EAST DALLAS ROAD
MEETING DATE: MONDAY, AUGUST 1, 2022
BACKGROUND INFORMATION:
The City Council at their July 19, 2022 meeting approved on the first reading of an ordinance,
conditional use permit CU22-30 on the subject site to allow a construction trade office with
storage yard. The application was submitted by Dunaway Associates, LLC on behalf of property
owners, H.A.W Development, LLC.
REQUEST:
The applicant intends to redevelop the subject site by demolishing a former single-family
residence that operated as a construction trade office and construct a new 5,460 square-foot
office on the same property. As part of the redevelopment the applicant proposes to leave and
improve the appearance of an existing 5,057 square foot metal building located at the northwest
corner of the property. The subject site does not meet the following requirements:
• The required side-yard setback for “LI”, Light Industrial District is 15 feet, the existing
metal building encroaches 5 feet within the required west side yard setback.
• The required landscape buffer adjacent to residentially zoned properties for “LI”, Light
Industrial District is 25 feet, the existing metal building encroaches 15 feet within the
required west landscape buffer.
• The required rear-yard setback for “LI”, Light Industrial District is 30 feet, the existing
metal building encroaches 16 feet within the required north rear yard setback.
• The required distance between buildings or structures on adjacent lots for “LI”, Light
Industrial District is 30 feet, the existing metal building does not meet this requirement.
The current proposal desires to stay within the existing side-yard setback adjacent to the west
property line, and the existing rear-yard setback adjacent to the north property line. Furthermore,
the current proposal desires to stay within the existing landscaped buffer zone adjacent to the
residentially zoned properties to the west and maintain the current distance between buildings
on adjacent lots.
The following special exception is requested:
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use.
The applicant is requesting a special exception to allow the existing metal building to
remain as developed within the west side yard and north rear yard as shown on the plot
plan.

SPECIAL CONDITION:
Staff finds that a special condition exists for the requested special exception. Specifically,
the existing non-residential structure on the subject lot was built in 1948 prior to the
rezoning of the subject site in the 1984 City Rezoning to the “LI”, Light Industrial District.
RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment approve a special exception to the
Grapevine Comprehensive Zoning Ordinance 82-73, Section 43.E.3, Nonconforming Uses
and Structures to allow for the existing metal building to remain along with the development
of a proposed 5,460 square-foot office building as shown on the plot plan.
