The Planning and Zoning Commission of the City of Grapevine, Texas met in Joint
Public Hearing with the City Council, on this the 21st day of March, 2006, in the City
Council Chambers, 200 South Main Street, 2nd Floor, Grapevine, Texas with the

Mayor Tate called the joint meeting to order at 7:36 p.m. and Chairman Oliver called the
Planning and Zoning Commission deliberation session to order at 8:09 p.m.

JOINT PUBLIC HEARINGS
ZONE CHANGE REQUEST Z06-04 PLANNED DEVELOPMENT OVERLAY PD06-02
GRAPEVINE LOFTS
First for the Commission to consider and make a recommendation to the City Council
was Zone Change Request Z06-04 and Planned Development Overlay PD06-02
submitted by the City of Grapevine for property located at 2301 West Grapevine Mills
Circle and proposed to be platted as Lots 1 R -4R, Block 1 R, Grapevine Lofts Addition.
The applicant was requesting a zone change to rezone 10.58 acres from "CC"
Community Commercial to "R -MF -2" Multifamily District and a planned development

overlay to include but not limited to deviation from maximum density, side yard
setbacks, buffer area, building height, building length, and building separation in
conjunction with a four phase, four tower, 12 stories per tower, 94 units per tower,
condominium project.
At the January 17, 2006 meeting the Planning and Zoning Commission recommended
and Council approved the request with the stipulation that Staff initiate a new zone
change request and planned development overlay to more closely relate the intended
residential use with a residential zoning category ("R -MF -2" Multifamily District) rather
than a commercial zoning category. The applicant was also required to dedicate the
appropriate easement necessary to enjoin this property into the City's existing hike and
bike trail network. At the February 21, 2006 meeting the new zone change request and
planned development overlay was tabled in order to give the applicant more time to
finalize the details of the abandonment of Anderson -Gibson Road with the Mills
Corporation and to amend the site plan to account for this abandonment.
Mr. Jon Koster, the developer, was available to answer questions.
Mr. Aaron New, a Grapevine resident, spoke in opposition of new development.
With no further questions, guests to speak, no letters or petitions, the public hearing
was closed.

request Z06-04, B J Wilson seconded the motion, which prevailed by the following vote:

Next for the Commission to consider and make a recommendation to the City Council
was the Statement of Findings and Final Plat Application of Lots 1R -4R, Block 1R,
Grapevine Lofts Addition, submitted by Link Equities, LLC. for property located west of
Grapevine Mills Mall. The applicant was final platting 10.58 acres for the development of
a high rise condominium project.

CONDITIONAL USE REQUEST CU06-05 AND SPECIAL USE REQUEST SU06-02 —
ENCHANTED WAY OFFICE CENTER
Next for the Commission to consider and make a recommendation to the City Council
was Conditional Use Request CU06-05 and Special Use Request SU06-02 submitted
by BGO Architects for property located at 1900 Enchanted Way and proposed to be
platted as Lots 3, 4 & 5, Block 2, Genesis Addition. The applicant was requesting a
conditional use permit to establish a planned office center and a special use permit to
allow for a church in the "CC" Community Commercial District.
Mr. Phil Morley, representing the applicant, was available for questions and requested
favorable consideration of the application. Mr. Morley stated that the church has a small
congregation and would be holding its services at different times from the Fellowship
Church in order to cut down on additional traffic. Discussion was held regarding the
amount of red cedar trees planned on site. Mr. Morley stated that the owners would
work with staff to mix in additional oak trees.
Mr. Aaron New, a Grapevine resident, spoke in opposition of new development.

was closed.
In the Commission's deliberation session, Chris Coy moved to approve conditional use
request CU06-05 with the condition that the landscape plan be modified to show less
than the majority of the trees to be red cedar. Becky St John seconded the motion,
which prevailed by the following vote:

CONDITIONAL USE REQUEST CU06-07 — BOB'S STEAK AND CHOP HOUSE
Next for the Commission to consider was Conditional Use Request CU06-07 submitted
by Ion Design Group LLC for property located at 1255 South Main Street and platted as

Lot 1, Block 1, Epicentre at Grapevine Addition. The applicant was requesting a
conditional use permit to amend the previously approved site plan of CU05-43 (Ord. 05-
56) for a proposed restaurant development specifically to allow the possession, storage,
retail sale, and on -premise consumption of alcoholic beverages (beer, wine, and mixed
beverages) in conjunction with a restaurant.

ZONING ORDINANCE AMENDMENT AM06-02
Next for the Commission to consider and make a recommendation to the City Council
was amendments to Section 51, Requirements for Open Space and Recreational
Areas, Section 20, "R-TH" Townhouse District, and Section 60, Sign Standards.
Section 51 mandated that as new residential developments occurred within the City,
sufficient land was dedicated or set aside for usable open space and recreational space
for parks, playgrounds, picnic areas etc. All properties that fell within any of the single
family detached zoning districts (R-20, R-12.5, R-7.5 and R-5.0) were required to
dedicate 300 square feet per dwelling unit to this open space requirement. In certain
cases a fee was paid in lieu of the dedication. Based upon a request from the Director
of the Parks and Recreation, it was recommended that the "R-TH" Townhouse District
be added to the list of those zoning districts that require the separate dedication of
usable open space. Staff recommended utilizing the same open space fee as the "R-
5.0" zoning district, which is $1,416 per lot/unit. The "R-5.0" zoning district is the most
dense development district and is the closest to the "R-TH" Townhouse District. For
whatever reason yet undetermined, the "R-TH" Townhouse District was never included
in the list of districts requiring dedication of open space. It was the only remaining
individually platted residential zoning district not included in the list of districts requiring

open space dedication. Given the amount of interest the residential development
community is generating in proposing townhouse projects within the City.
Section 60, Sign Standards:
Section 60, Sign Standards made no special provision for a "roof sign," i.e. those signs
that are painted on the roof of a building which are primarily viewed from the air.
Specifically they have been prohibited since they were not allowed by ordinance. Staff
has increasingly been receiving requests to allow this type of sign and it has been
allowed in some special circumstances, e.g. Grapevine Mills Mall, Fellowship Church,
and some GCISD school buildings. Given that these types of signs are totally
unobtrusive except when viewed from above, Staff recommends they be exempt from
the standards set forth in Section 60 with the provision that the painted roof sign cannot
be viewed from the property line, right-of-way or public access easement and that a
permit be required for this type of signage.

Next for the Commission to consider was Conditional Use Request CU06-03 submitted
by Bury + Partners, DFW, Inc. for property located at 3450 Grapevine Mills Parkway
and platted as Lots 2R and 3, Block B, Grapevine Vineyard Addition. The applicant was
requesting a conditional use permit to establish a planned commercial center and to
allow for a 40 -foot pole sign.
At the February 21, 2006 meeting the Planning and Zoning Commission recommended
and the Council approved the conditional use request for the establishment of the
planned commercial center with the stipulation that the 40 -foot pole sign be reduced to
a monument sign. At Council's March 7, 2006 meeting Councilmember Darlene Freed
requested a reconsideration of CU06-03 relative to the 40 -foot pole sign request. An
additional motion was also approved by Council to send CU06-03 back to the Planning
and Zoning Commission for reconsideration. Given that no representative from LA -Z -
Boy was present at the February 21, 2006 meeting to speak in reference to their
particular signage needs and given the number of pole signs in the general vicinity that
have been approved reconsideration of the request relative to the pole sign was

In the Commissioner's deliberation session. Discussion was held with property owner
Lewis Brown regarding the pole sign's changeable copy. Chris Coy moved to deny
conditional use request CU06-03. Becky St John seconded the motion which failed by
the following vote:

After further discussion, Chris Coy moved to approve conditional use request CU06-03
with the condition that the changeable copy be eliminated from the 40 -foot pole sign.

After further discussion with the property owner, Chris Coy moved to approve
conditional use request CU06-03 with the condition that the changeable copy be
eliminated from the 40 -foot pole sign. Danette Murray seconded the motion which
prevailed by the following vote:

FINAL PLAT APPLICATION OF LOTS 3,4 & 5 BLOCK 2 GENESIS ADDITION
Next for the Commission to consider and make a recommendation to the City Council
was the Statement of Findings and Final Plat Application of Lots 3, 4 & 5, Block 2,
Genesis Addition, submitted by Alpha Land Surveying for property located north of Bass
Pro Drive along Enchanted Way. The applicant was final platting 6.238 acres for the
development of two office buildings and a church.
In the Commission's deliberation session Chris Coy moved to approve the Statement of
Findings and Final Plat Application of Lots 3, 4 & 5, Block 2, Genesis Addition, Danette
Murray seconded the motion, which prevailed by the following vote:

Next for the Commission to consider and make a recommendation to the City Council
was the Statement of Findings and Final Plat Application of Lot 1, Block 1, Double B
Ranch, submitted by Jeffery Avery property located at 3063 Parr Lane. The applicant
was final platting 2.1 acres for the development of a single-family residence.
In the Commission's deliberation session Chris Coy moved to approve the Statement of
Findings and Final Plat Application of Lot 1, Block 1, Double B Ranch, B J Wilson
seconded the motion, which prevailed by the following vote:

DISCUSSION RELATIVE TO SECTION 41, "PD" PLANNED DEVELOPMENT
OVERLAY
Next for the Commission to consider was amendments to Section 41, "PD" Planned
Development Overlay. Staff incorporated the comments and suggestions from the
Planning and Zoning Commission workshop held on February 28, 2006 into a new
document.
After a brief discussion, Chris Coy moved to set a public hearing on regarding Section
41, "PD" Planned Overlay Development, Becky St John seconded the motion, which
prevailed by the following vote:
Ayes: Oliver, Fry, Coy, Murray, Wilson, St John and Undersander
Nays: None
CONSIDERATION OF MINUTES

minutes of the February 16, 2006 Commission meeting.
