To Whom It May Concern,
This letter is to verify that your request for a conditional use permit located -at 1111 East State
Highway 114, platted Block 1, Lot 2R1, Wallcon Addition was approved by the Site Plan Review
Committee on August 18, 2022. A copy of the approved site plan is enclosed.
Any changes to a site plan approved with a conditional use or a special use (no matter how
minor or major) can only be approved by city council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.
The City Council may grant one additional extension not exceeding one (1) year, upon written
application, without notice or hearing. No additional extension shall be granted without complying
with the notice and hearing requirements for an initial application for a Conditional Use Permit.

PROJECT DESCRIPTION: CU22-36; Sewell Collision Center– submitted by Corbin Design Company for
property located at 1111 East State Highway 114 and platted as Block 1, Lot 2R1, Wallcon Addition. The
applicant is requesting a conditional use permit to amend the previously approved site plan of CU15-05
(Ord. 2015-16) for a planned commercial center with new car sales and service, a stand-alone car wash,
parking garage, a pre-owned building, and as additional 40-foot pole sign, specifically to allow an enclosed
paint booth within a parking garage and changes to the south building elevations. This property is
currently zoned “PCD”, Planned Commerce Development District and owned by UDM Company, LLC.
PLANNING SERVICES

Ensure that within the approval block (2nd example) that it reads, “Planning Services
Department.” The title block must be in the lower-right hand corner of the sheet. The approval

SUBJECT: CONDITIONAL USE REQUEST CU22-36; SEWELL COLLISION
CENTER
RECOMMENDATION
Staff recommends the Site Plan Review Committee (SPRC) consider the proposed
changes to Conditional Use Request CU15-05 (Ord. 2015-16) to amend the previously
approved site plan for a planned commercial center, specifically to allow for an enclosed
paint booth within an existing garage and changes to the south and west building
elevations. The property is zoned “PCD,” Planned Commerce Development District and
is owned by UDM Company, LLC.
REQUEST
The applicant is proposing the installation of an enclosed paint booth within the existing
garage. Changes to the south and west building elevation include a 31-foot-high paint
booth exhaust.
BACKGROUND INFORMATION
The subject site was zoned “I-1”, Light Industrial District prior to the 1984 City-wide
rezoning at which time the subject site was rezoned to “PCD”, Planned Commerce
Development District and “CC”, Community Commercial District.
The entire property is currently zoned “PCD”, Planned Commerce Development District
and is developed with automobile dealerships including Sewell BMW and Sewell
Cadillac.
• On December 17, 2002, City Council approved CU02-52 (Ord. 2002-98) to allow
the development of an automobile dealership (Cadillac) with sales and service of
new and used vehicles, a 20-foot pole sign, and a 26-foot pole sign.
• On June 25, 2003, the SPRC approved CU03-20 to allow changing the phase
lines to include the northern inventory storage area, originally designated as part

of Phase 2 with Phase 1, the relocation of the westernmost drive along State
Highway 114 further east to comply with TXDOT requirements, the relocation of
the northernmost drive along Minters Chapel Road to improve internal circulation,
and the addition of a covered display area on the west side of the building
(Cadillac dealership).
• On April 28, 2004, the SPRC approved CU04-16 to allow an increase in the size
of the pole sign designated for the Cadillac dealership from 20-feet to 29-feet and
an 8-foot chain link fence along the northern and eastern boundaries of the
secured inventory rather than the previously approved ornamental wrought-iron
fence on the subject site.
• On December 17, 2008, the SPRC approved CU08-32 to allow a 1,700 square
foot expansion to the detail shop for the existing Cadillac dealership.
• On April 21, 2015, City Council approved CU15-05/PD15-02/Z15-01 (Ord. 2015-
16) for development of new car sales and service (Sewell BMW), a standalone
car wash, parking building, a pre-owned building, and an additional 40-foot pylon
sign for Sewell BMW located at the subject site. With this request 1.492 acres of
the subject site was rezoned from “CC”, Community Commercial District to
“PCD”, Planned Commerce Development District, and the Planned Development
Overlay allowed for deviation from the height requirement.
