ACKNOWLEDGEMENT

the staff. Based on the size of the agenda, your application may be scheduled to a
later date.

interested citizenry. Public hearings may be continued to the next public hearing.

Any changes to a site plan (no matter how minor or major) approved with a
conditional use or a special use permit can only be approved by city council
through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning
ordinance shall have, from the date of submittal, a period of four months to
request and be scheduled on an agenda before the Planning and Zoning
Commission and City Council. If after said period of four months an application
has not been scheduled before the Commission and Council said application shall
be considered withdrawn, with forfeiture of all filing fees. The application, along
with the required filing fee may be resubmitted any time thereafter for
reconsideration. Delays in scheduling applications before the Planning and
Zoning Commission and City Council created by city staff shall not be considered
a part of the four month period.

2. For the purposes of the Conditional Use request, instead of the equipment
schedule floor plan, please provide a dimensioned seating/floor plan and
label the alcohol storage area(s), dining areas and point of sale
location(s).
3. Please add the following note to the site plan stating the purpose of the
conditional use request:
a) Conditional use request CU11-18 is a request to amend the
previously approved site plan of CU07-25 SPRC, CU02-38 (Ord.02-
72) for a planned commercial center with the possession, storage,
retail sale and on -premise consumption of alcoholic beverages
(beer, wine and mixed beverages) in conjunction with a restaurant,
specifically to revise the existing floor plan.
b) The entire site is the premises.
4. If the outdoor patio will be used please include that area in the
floor/seating plan. Please provide a speaker plan if any outdoor speakers
are proposed.
5. Please provide a seating chart, area calculation chart and occupancy
calculation.
6. Please submit a letter describing the proposed use and provide a menu.
7. Please provide a graphic scale in addition to the numeric scale.
8. Please provide a building elevation of the suite if exterior changes are
proposed.
9. The floor plan and text should be clearly legible on an 11" x 17" reduction.
10. For verification purposes please email a PDF of the final sheets
before the final copies are reproduced.
The above comments must be reflected in the revised submittal,
which is due by Wednesday, June 29th at 12:00 p.m. for the July 19th
joint public hearing. Please submit the revised documents to the
Department of Development Services at 200 South Main Street.
The revised submittal shall include:
one (1) Mylar of each sheet (minimum size 22" x 34")
two (2) folded blackline copies of each sheet, (minimum size 22" x 34")
forty (40) reduced sorted (collated sets) copies at 11" x 17" three hole
punched, stapled and z -folded (fold the right edge to the left edge
and then fold the right edge in half to form a z -fold).
one (1) colored version of the landscape plan that removes the
details/charts and contours.
If these revisions are made and submitted at the correct time, you will be
scheduled for the next available agenda.

On Tuesday evening, July 19, 2011 at 7:30 P.M. in the City Council Chambers, 2nd Floor,
200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following
items:
CU11-14 - Walgreens - submitted by Gardere Wynne Sewell LLP for property located at
912 West Northwest Highway and platted as Lot 1, Block1 Dean/Davis Addition. The
applicant is requesting a conditional use permit to amend the previously approved site
plan, specifically to allow the possession, storage, retail sale and off -premise consumption
of alcoholic beverages (beer and wine only) in conjunction with a retail store. The property

HL11-02 - 901 West Sunset Street - submitted by Justin Powers for property located at

requesting designation as a historical landmark sub -district. Such sub -district may include
buildings, land, areas, or districts or historical, architectural, archaeological or cultural
importance or value that merit protection, enhancement, and preservation in the interest of
the culture, prosperity, education, and welfare of the people. The property is owned by
Powers Distribution LLC.
AM11-04 AMENDMENTS TO COMPREHENSIVE ZONING ORDINANCE 82-73 - The City
Council and the Commission will consider amendments and changes to the
Comprehensive Zoning Ordinance, No. 82-73, same being Appendix D of the Code of
Ordinances as follows: Section 20, R-TH Townhouse District Regulations; Section 21, R-
MF -1 Multifamily District Regulations; Section 22, R -MF -2 Multifamily District Regulations;
Section 41, PD Planned Development Overlay; Section 45, Concept Plans; Section 47,
Site Plan Review; Section 54, Masonry Requirements and Section 60, Sign Standards
relative to multifamily zoning and any other additions, deletions, or changes to various
sections, articles and provisions contained in said Ordinance No. 82-73.
After all parties have been given an opportunity to speak, the public hearing will be closed
and the Commission and the City Council will deliberate the pending matters. Please

REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the previously approved site
plan of conditional use request CU02-38 (Ord. No. 02-72) for a planned commercial center
with the possession, storage, retail sale and on -premise consumption of alcoholic beverage
(beer, wine and mixed beverages) in conjunction with a restaurant, specifically to revise the
existing floor plan and allow outside speakers in conjunction with a restaurant.
The applicant intends to remodel the existing 3,565 -square foot lease space by modifying
the floor plan and seating configurations, relocating the main entry door and using two
speakers in the existing patio. The restaurant will seat a total of 158 patrons -98 seats
inside and 60 seats in an outdoor covered patio area, requiring 53 parking spaces; 230 are
provided. The Site Plan Review Committee meeting on August 27, 2007 amended a
conditional use permit to cover the existing patio within the lease space formerly occupied

PRESENT ZONING AND USE:
The property is currently zoned "CC", Community Commercial District with a Planned
Commercial Center designation and is developed as a neighborhood shopping center.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject property, the corner lot and the day care property have been zoned "CC"
Community Commercial District since the 1984 City Rezoning. Zoning Case Z94-11
rezoned the Delaney Vineyard from "HCO" Hotel/Corporate Office District to "GV"
Grapevine Vintage District. Zoning Case Z96-09 rezoned the property west of the Shadow
Glen subdivisions from "R -MF -1" Multifamily District to "GV" Grapevine Vintage District.
Conditional Use Permits CU94-27 and CU95-01 approved a convenience store with
gasoline and alcoholic beverage sales and a car wash on the corner lot. This retail center
was approved by conditional use permit CU97-12 (Ordinance 97-27). The retail sale and
off -premise consumption of alcoholic beverages in conjunction with the grocery store was
also approved with CU97-12. CU97-35 (Ordinance 97-87) was approved at the August 19,
1997 joint public hearing and allowed for various changes to the layout of the planned
commercial center. CU97-54 (Ordinance 97-136) was approved at the December 2, 1997
joint public hearing that allowed the development of a McDonald's restaurant on Lot 3.
CU97-74 (Ordinance 98-09) was approved at the January 20, 1998 joint public hearing for
Primacare Medical Center on Lot 6R. CU98-09 (Ordinance 98-66) was approved at the
June 2, 1998 joint public hearing which modified the previously approved master site plan
for Mulberry Square by realigning the drive at the southwest corner of Lot 5R and revising
the landscaping on Lots 5R and 8R. Parking was removed from Lot 5R in order to provide
more landscaping along W.D. Tate Avenue as well as from Lot 7R to provide more
landscaping along Champagne Boulevard. Landscaping was also provided to the north of
the building shown on Lot 9R. CU98-64 was approved in January 1999 allowing the
development of a 2,750 square foot, 66 seat restaurant with on -premise consumption of
alcoholic beverages (beer, wine and mixed drinks) within the retail area located on Lot 8R.
At the September 5, 2000 meeting, Council approved a conditional use permit (C000-47;
Ord. 00-88) for on -premise alcohol beverage sales and consumption for Suite 296, within
the Winn-Dixie shopping center (Mellanzanno's). At the September 17, 2002 meeting,
Council approved a conditional use permit CU02-38 (Ord. 02-72) for on -premise alcohol
beverage sales and consumption for Suite 296 (Mijo's), including minor modifications to the
floor plan plus an expansion for an outdoor patio. The Site Plan Review Committee at their
August 29, 2007 meeting approved CU07-25, which was a request for a patio cover for
Suite 296 (Bayley's).

applicant's proposal is in compliance with the Master Plan.
THOROUGHFARE PLAN APPLICATION:
The Thoroughfare Plan designates Glade Road as a Type B MajorArterial, with a minimum
80 -foot right-of-way developed as four lanes with a median.

This letter is to verify that your request for a conditional use permit located at 2030 Glade Road #296 and
platted as Lot 8R, Block 1, Mulberry Square Addition, to amend the previously approved site plan of
CU02-38 (Ord. 02-72) for a planned commercial center with the possession, storage, retail sale and on -
premise consumption of alcoholic beverage (beer, wine and mixed beverages) in conjunction with a
restaurant, specifically to revise the existing floor plan and allow outside speakers in conjunction with a
restaurant was approved by City Council on July 19, 2011 with the condition that the hours of operation
are limited to within 7:00 am to 10:00 pm Sunday through Thursday and 7:00 am to 11:00 pm on Friday
and Saturday. A copy of the approved site plan and Ordinance 2011-31 is enclosed.
On July 19, 2011, the Planning and Zoning Commission recommended the City Council approve the
request.
Any changes to a site plan approved with a conditional use or a special use (no matterhow minor
or major) can only be approved by city council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on which the
City Council grants the Conditional Use, unless within such one (1) year period: (1) a Building Permit is
obtained and the erection or alteration of a structure is started, or (2) an Occupancy Permit is obtained
and a use commenced.
The City Council may grant one additional extension not exceeding one (1) year, upon written application,
without notice or hearing. No additional extension shall be granted without complying with the notice and
hearing requirements for an initial application for a Conditional Use Permit.
