placed on the agenda for public hearing at the discretion of the staff. Based on the size of the
agenda, your application may be scheduled to a later date.
All public hearings will be opened and testimony given by applicants and interested citizenry. Public
hearings may be continued to the next public hearing. Public hearings will not be tabled.
Any changes to a site plan (no matter how minor or major) approved with a conditional use or a
special use permit can only be approved by city council through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning ordinance shall have,
from the date of submittal, a period of four months to request and be scheduled on an agenda
before the Planning and Zoning Commission and City Council. If after said period of four months an
application has not been scheduled before the Commission and Council said application shall be
considered withdrawn, with forfeiture of all filing fees. The application, along with the required
filing fee may be resubmitted any time thereafter for reconsideration. Delays in scheduling
applications before the Planning and Zoning Commission and City Council created by city staff
shall not be considered a part of the four month period.

1. Please add case number CU10-30 to the signature block (provided
below) to all sheets. Each sheet needs to be sealed by a registered
surveyor, architect or engineer. Please add a graphic in addition to the
numeric scale to each sheet.
2. Please add the following notes to the sheets stating the purpose of the
conditional use request:
Conditional use request CU10-30 is a request to amend
the previously approved site plan of CU10-13 (Ord. 10-28)
for a planned commercial center with the possession,
storage, retail sale, and on -premise consumption of
alcoholic beverages (beer, wine, and mixed beverages) in
conjunction with a restaurant, specifically to allow outside
dining.
Outdoor speakers are not proposed.
3. Please include a dimensioned site plan/floor plan (including the
approved floor plan), label the uses, i.e. existing dining, existing alcohol
storage, existing kitchen, point of sale, including the proposed outdoor
dining area (showing the number of proposed seats on the patio). Please
dimension the distance of the proposed patio to the north property line and
provide a heavier line weight to distinguish Lot 7 and include the property
dimensions according to the plat.
4. Please include a revised seating count, area calculations, occupancy
calculations, parking calculations chart and the alcohol schematic
plan/legend.
5. Please show the location of the fire lane and provide an internal traffic
circulation plan on the site plan sheet. Please revise the rail elevation for
south to north.
6. Please label the existing monument sign(s) and revise the master site plan
because the location of the restaurant and patio is washed out.
7. Please insure the proposed decking does not inhibit ventilation and
provides accessibility for maintenance of the grease traps. Please
contact Don Ellison or Allen Hunt at 817.410.3165 for questions
regarding this requirement.
8. Please label the existing refuse storage area on the site plan and please
contact the refuse service provider to insure the proposed patio does not
inhibit access to the refuse storage area.
9. A patio cover will require sprinkling of the patio and entire building.
10. For verification purposes please email a PDF of the final site/floor
plan prior to producing the final copies.
11. Please add the following signature block, minimum size 3" x 4", to each
sheet.

The revised submittal shall include:
one (1) Mylar of each sheet (minimum size 22" x 34")
two (2) folded blackline copies of each sheet, (minimum size 22" x 34")
forty (40) reduced sorted (collated sets) copies at 11" x 17" three hole
punched, stapled and z -folded (fold the right edge to the left edge
and then fold the right edge in half to form a z -fold).
If these revisions are made and submitted at the correct time, you will be
scheduled for the next available agenda.

On Tuesday evening, December 21, 2010, at 7:30 P.M. in the City Council Chambers, 2nd
Floor, 200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following

applicant is requesting a conditional use permit to amend the previously approved site plan

CU10-30, Bottlecap Alley/icehouse Grill - submitted by Cencor Realty Services for
property located at 1469 West State Highway 114 #614 and platted as Lot 7, Block 1,
Town Center Addition. The applicant is requesting a conditional use permit to amend the
previously approved site plan to allow outside dining in conjunction with a restaurant. The
property is currently zoned "CC" Community Commercial and is owned by Grapevine Tate
Pad A LP.
PD1 0-05, Faith Christian High School - submitted by Peloton Land Solutions for property
located at 729 East Dallas Road and proposed to be platted as Lot 1A1, Block 1, Faith
Christian School. The applicant is requesting to amend the previously approved site plan
to allow additional acreage to the site. The property is currently zoned "LI" Light Industrial

REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the previously approved site
plan of CU10-13 (Ord. 2010-28) for a planned commercial center, with the possession
storage, retail sales and on -premise consumption of alcoholic beverages (beer, wine and
mixed beverages), specifically to allow outside dining_
With this request the applicant proposes to expand the dining area of the existing
restaurant by adding a 494 -square foot, 34 -seat uncovered outdoor patio adjacent to the
north side of the building. A three-foot wooden railing along with four -foot bollards will
provide separation and protection from the seating and vehicle use area. The subject site
has adequate parking to accommodate the 57 -parking spaces required for the 171 -seats.
No outdoor speakers are proposed.

PRESENT ZONING AND USE:
The property is currently zoned "CC" Community Commercial District with a Planned
Commercial Center designation.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject property was zoned "C-2" Community Business District prior to the 1984 City
Rezoning. The tract was platted as the Towne Center Addition in 1986. The addition was
replatted twice in 1989. Conditional Use Permit CU89-15 for a Planned Commercial
Center to be developed as four lots with three restaurants (Luby's, Arby's and International
House of Pancakes) and one retail center was approved in 1989. A one-year extension of
CU99-15 was approved in December 1990. CU91-19 for both a Jack in the Box
Restaurant and an amendment to the approved site plan of Luby's Cafeteria was approved
in 1991. CU93-05, approved in 1993, again amended the approved site plan and sign for
Luby's Cafeteria. CU95-02 (Ord. No. 95-10) was approved in February, 1995, allowing the
possession, storage, retail sale and on -premise consumption of alcoholic beverages (beer
and wine only) in conjunction with an existing restaurant for Jason's Deli.
The Towne Center Addition II which contains 62.47 acres, was rezoned in 1992 (Z92-09
and CU92-23) from "PCD" Planned Commerce Development District to "CC" Community
Commercial District with a conditional use permit for a planned commercial center which
brought forward the development of the Target store. In 1994, the site plan was amended
to include Ross Dress for Less, Barnes and Noble, Famous Footwear, and Showcase
Hallmark (CU94-31, Ord. No. 94-100). In 1995 the master site plan was amended again to
allow for the development of Linens N' Things on Lot 4R-1 with Mattress Giant and
Chesapeake Bagel on Lot 5 (CU95-16). In 1996, the site plan was modified to develop
retail space for Barbecue's Galore and Coleman Spas on Lot 9 (CU96-20), Office Depot
and Cost Plus on Lot 6R (CU96-29), and a 20,000 square foot retail building on Lot 7 that
houses Chuck's Hamburgers, Haltom's Jewelers, and Busybody Home Fitness (CU96-36).
CU99-06 allowed the development of a 6,581 square foot restaurant (Mimi's Cafe) with the
possession, storage, retail sale, and on -premise consumption of alcoholic beverages (beer,
wine, and mixed drinks) along with an attached 3,295 square foot retail building. CU99-57
was approved in November 1999, allowing outdoor seating at Jason's Deli. Conditional
Use Request C000-11 (Ord. 00-34) was approved at the March 28, 2000 meeting which
allowed for a bank with drive-through service. In addition a 50 -foot landscape buffer was
approved with the request around the remainder of the undeveloped portion of the Towne
Center Addition including the bank site to bring the entire planned commercial center into
compliance with the landscaping requirements. The Site Plan Review Committee approved
CU03-01 in March 2003, allowing the placement of a pole sign for Haltom's Jewelers. The
Site Plan Review Committee also approved CU03-02 in March 2003, permitting a revision
of the Luby's Restaurant pole sign. At the August 19, 2003 meeting, Council approved a
conditional use request (CU03-26) for modifications to the site plan for the Target retail
store. Conditional Use Request CU04-24 was approved at the August 17, 2004 meeting
with allowed for a 132 bed skilled nursing facility within the Towne Center Addition
accessed from Ira E. Woods Avenue. At the October 17, 2006 meeting Council approved

an amendment to site plan for the planned commercial center (CU06-39) to allow the
development of two medical office buildings totaling 6,595 square feet. At the November
20, 2007 meeting Council approved an amendment to site plan for the planned commercial
center (CU07-35) to allow the development of two medical office buildings totaling 9,456
square feet. Conditional Use Request CU08-29 (Ord. 08-71) was approved at the
November 18, 2008 meeting to allow a 25 -foot landscape setback for all parcels adjacent
to Ira E. Woods Avenue and William D. Tate Avenue. Conditional Use Request CU09-03
(Ord. 98-07) was approved at the March 24, 2009 meeting to allow gasoline sales and
alcohol sales for off -premise consumption (beer and wine) and two monument signs in
conjunction with a 4,902 square foot convenience store. At the June 15, 2010 meeting
conditional use permit CU09-16 (Ord. 2010-28) for a monument sign and to allow the
possession, storage, retail sales and on -premise consumption of alcoholic beverages
(beer, wine and mixed beverages) along with SU10-05 (Ord. 2010-29) to allow for the use
of one billiard table in conjunction with a restaurant were both approved.

Worth Regional Airport Environs" Map. Few activities will be affected by aircraft sounds in
Zone A, except for sound sensitive activities such as auditoriums, churches, schools,
hospitals, and theaters. The applicant's proposal is an appropriate use in this noise zone.

During the public hearing on December 21, 2010, discussion centered on the

appropriateness of outdoor seating at a location where outdoor seating was not originally
intended. Specific comments were made relative to the view of the outdoor dining area
from Ira. E. Woods Avenue, the placement of landscaping and the type of seating fixtures
proposed. Subsequently, the request was tabled to the January 18, 2011 public hearing.
The applicant in concert with the property management proposes to install permanent
landscaping including a raised curb, ground cover and trees. In addition the applicant has
provided an illustration of the proposed seating and dining fixtures planned for the patio.

House of Pancakes) and one retail center was approved in 1989. A one-year extension of
CU99-15 was approved in December 1990. CU91-19 for both a Jack in the Box
Restaurant and an amendment to the approved site plan of Luby's Cafeteria was approved
in 1991. CU93-05, approved in 1993, again amended the approved site plan and sign for
Luby's Cafeteria. CU95-02 (Ord. No. 95-10) was approved in February, 1995, allowing the
possession, storage, retail sale and on -premise consumption of alcoholic beverages (beer
and wine only) in conjunction with an existing restaurant for Jason's Deli.
The Towne Center Addition II which contains 62.47 acres, was rezoned in 1992 (Z92-09
and CU92-23) from "PCD" Planned Commerce Development District to "CC" Community
Commercial District with a conditional use permit for a planned commercial center which
brought forward the development of the Target store. In 1994, the site plan was amended
to include Ross Dress for Less, Barnes and Noble, Famous Footwear, and Showcase
Hallmark (CU94-31, Ord. No. 94-100). In 1995 the master site plan was amended again to
allow for the development of Linens N' Things on Lot 4R-1 with Mattress Giant and
Chesapeake Bagel on Lot 5 (CU95-16). In 1996, the site plan was modified to develop
retail space for Barbecue's Galore and Coleman Spas on Lot 9 (CU96-20), Office Depot
and Cost Plus on Lot 6R (CU96-29), and a 20,000 square foot retail building on Lot 7 that
houses Chuck's Hamburgers, Haltom's Jewelers, and Busybody Home Fitness (CU96-36).
CU99-06 allowed the development of a 6,581 square foot restaurant (Mimi's Cafe) with the
possession, storage, retail sale, and on -premise consumption of alcoholic beverages (beer,
wine, and mixed drinks) along with an attached 3,295 square foot retail building. CU99-57
was approved in November 1999, allowing outdoor seating at Jason's Deli. Conditional
Use Request C000-11 (Ord. 00-34) was approved at the March 28, 2000 meeting which
allowed for a bank with drive-through service. In addition a 50 -foot landscape buffer was
approved with the request around the remainder of the undeveloped portion of the Towne
Center Addition including the bank site to bring the entire planned commercial center into

compliance with the landscaping requirements. The Site Plan Review Committee approved
CU03-01 in March 2003, allowing the placement of a pole sign for Haltom's Jewelers. The
Site Plan Review Committee also approved CU03-02 in March 2003, permitting a revision
of the Luby's Restaurant pole sign. At the August 19, 2003 meeting, Council approved a
conditional use request (CU03-26) for modifications to the site plan for the Target retail
store. Conditional Use Request CU04-24 was approved at the August 17, 2004 meeting
with allowed for a 132 bed skilled nursing facility within the Towne Center Addition
accessed from Ira E. Woods Avenue. At the October 17, 2006 meeting Council approved
an amendment to site plan for the planned commercial center (CU06-39) to allow the
development of two medical office buildings totaling 6,595 square feet. At the November
20, 2007 meeting Council approved an amendment to site plan for the planned commercial
center (CU07-35) to allow the development of two medical office buildings totaling 9,456
square feet. Conditional Use Request CU08-29 (Ord. 08-71) was approved at the
November 18, 2008 meeting to allow a 25 -foot landscape setback for all parcels adjacent
to Ira E. Woods Avenue and William D. Tate Avenue. Conditional Use Request CU09-03
(Ord. 98-07) was approved at the March 24, 2009 meeting to allow gasoline sales and
alcohol sales for off -premise consumption (beer and wine) and two monument signs in
conjunction with a 4,902 square foot convenience store. At the June 15, 2010 meeting
conditional use permit CU10-13 (Ord. 2010-28) for a monument sign and to allow the
possession, storage, retail sales and on -premise consumption of alcoholic beverages
(beer, wine and mixed beverages) along with SU 10-05 (Ord. 2010-29) to allow for the use
of one billiard table in conjunction with a restaurant were both approved.

Greg, I have received your message and I believe that we can meet your
schedule, However could you please verify with the City if they require
a true mylar of the 22x34 size or if the bond that we have used to this
point is acceptable. If they truly require a mylar, we will need to
allow a little extra time for this process since we will have to send
that to a reproduction company to plot. One last item regarding item
#5, is that we don't anticipate any code related issues but we will not
know this for sure until we go through the area calculation process for
each area.
