ACKNOWLEDGEMENT
All Conditional Use and Special Use Applications are assumed to be complete
when filed and will be placed on the agenda for public hearing at the discretion of
the staff. Based on the size of the agenda, your application may be scheduled to a
later date.
All public hearings will be opened and testimony given by applicants and
interested citizenry. Public hearings may be continued to the next public hearing.
Public hearings will not be tabled.
Any changes to a site plan (no matter how minor or major) approved with a
conditional use or a special use permit can only be approved by city council
through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning
ordinance shall have, from the date of submittal, a period of four months to
request and be scheduled on an agenda before the Planning and Zoning
Commission and City Council. If after said period of four months an application
has not been scheduled before the Commission and Council said application shall
be considered withdrawn, with forfeiture of all filing fees. The application, along
with the required filing fee may be resubmitted any time thereafter for
reconsideration. Delays in scheduling applications before the Planning and
Zoning Commission and City Council created by city staff shall not be considered
a part of the four month period.

Please add case number CU09-48 to the signature block (provided
below) to all sheets. Each sheet needs to be sealed by a registered
surveyor, architect or engineer. Please add a graphic in addition to the
numeric scale to each sheet.
2. Please add the following note to the site plan stating the purpose of the
conditional use request:
Conditional use request CU09-48 is a request to amend
the previously approved site plan of CU08-06 (Ord. 08-15)
to allow the possession, storage, retail sale, and on -
premise consumption of alcoholic beverages (beer, wine,
and mixed beverages) in conjunction with a restaurant,
specifically to allow outside dining in the Central
Business District.
3. Please include a dimensioned site plan/floor plan, label the uses, i.e.
dining, alcohol storage, kitchen, point of sale, including proposed outdoor
dining area. Please provide the foot print and elevation for the existing
walk in cooler on the site/floor plans. Please include all the dining on the
mezzanine level. Also please dimension the parking lot.
4. Please revise the railing including elimination of the gate and provide a 12 -
foot wide entry based upon the approval from the Historic Preservation
Commission. Please dimension the distance of the railing to the curbs
adjacent to Main Street and Worth Street.
5. Please revise the site plan as follows: provide a site date table which
includes (Lot size, building foot print, ground/mezzanine, building
height, building stories, total impervious area, landscape area, total
parking provided, current zoning, seating existing/proposed, parking
required based upon 1 seat / 3 persons). Please provide a traffic
circulation plan for the parking lot.
6. Please label the existing and proposed awning color, label the existing
exterior material for the restaurant and include the existing signage.
7. For verification purposes please email a PDF of the final site/floor
plan prior to producing the final copies.
8. Please add the following signature block, minimum size 3" x 4", to each
sheet.

On Tuesday evening, March 16, 2010 at 7:30 P.M. in the City Council Chambers, 2nd
Floor, 200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following

CU09-48 — DINO'S STEAK AND CLAW HOUSE - submitted Dino's Steak and Claw house
for property located at 342 South Main Street and platted as Lots 6A and 6C1, Block 2,
City of Grapevine Addition. The applicant is requesting a conditional use permit to amend
the previously approved site plan to allow outside dining in conjunction with a restaurant.
The property is zoned "CBD" Central Business District and is owned by Izak and Joe
Gregory.
CU10-02 — PALIO'S PIZZA CAFE - submitted Palio's Pizza Cafe for property located at
1000 Texan Trail #100 and platted as Lot 1, Block 1, Grapevine Corner Addition. The
applicant is requesting a conditional use permit to amend the previously approved site plan
to allow outside dining in conjunction with a restaurant. The property is zoned "CC"
Community Commercial District and is owned by Grapevine Station LLC.
CU10-03 — PAPPADEAUX SEAFOOD KITCHEN - submitted by Pappas Restaurants, Inc.
located at 600 West State Highway 114 and is proposed to be platted as Lot 6, Block 1,
Hayley Addition. The applicant is requesting a conditional use permit to amend the
previously approved site plan for a planned commercial center to allow the possession,
storage, retail sale and on -premise consumption of alcoholic beverages, (beer, wine and

SU10-01 — CLEAR WIRELESS - submitted by Clear LLC located at 1900 Minters Chapel
Road and described as Tract 6H, Abstract 131, William Bradford Survey. The applicant is
requesting a special use permit to establish a ground lease and allow the collocation of
cellular antennas and microwave equipment. The property is zoned "LI" Light Industrial
District and is owned by The City of Grapevine.
HL10-03 - 316 South Barton Street - submitted by Don Gerschick for property located at
316 South Barton Street and platted as Blk 1 Lot 24 & E Pt 23. The applicant is requesting
designation as a historical landmark sub -district. Such sub -district may include buildings,
land, areas, or districts or historical, architectural, archaeological or cultural importance or

Because you are a property owner within 200 feet of the subject tract of land as
shown by the last City -approved tax rolls, you received this notice. If you cannot or

REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the previously approved site
plan of CU08-06 (Ord. 2008-15) to allow the possession, storage, retail sale, and on -
premise consumption of alcoholic beverages (beer, wine, and mixed beverages) in
conjunction with a restaurant, specifically to allow outside dining.
With this request the applicant intends to establish a 670 -square foot outdoor dining area
adjacent to the front of the restaurant to accommodate seating for 24 patrons. A three-foot
wrought iron fence will provide separation from the seating and sidewalk. Total indoor/
outdoor seating will accommodate 96 patrons. Parking to accommodate the outdoor dining
includes 53 spaces available west of the subject site the majority of which are within a
parking lot available to patrons of the restaurant and visitors to the downtown area.

The Historic Preservation Commission, at their December 16, 2009 meeting, approved
changes to the subject site to accommodate the outdoor dining area including, installation
of the three foot wrought iron fence, relocation of the existing entrance of the adjacent
building from the south side to the front side facing Main Street and installation of a window
in the former door location.
PRESENT ZONING AND USE:
The subject property is currently zoned "CBD" Central Business District and is occupied by
a restaurant.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject and surrounding properties were zoned "C-2" Community Business District
prior to the 1984 City Rezoning at which time they were rezoned to "CBD" Central Business
District.
SURROUNDING ZONING AND EXISTING LAND USE:
NORTH: The subject property and the property immediately to the north is
zoned "CBD" Central Business District and is occupied by Main Street
Barbers; for the property addressed at 210 West Worth Street the
property immediately to the north is zoned "R-7.5" Single Family
District and is occupied by the DFW Church of Christ.
SOUTH: The property to the south across Worth Street is zoned "CBD" Central
Business District and is occupied by Bermuda Gold.
EAST: The property immediately to the east across South Main Street is
zoned "CBD" Central Business District and is occupied by a variety of
retail businesses.
WEST: The property west of subject site across Barton Street is zoned "CBD"
Central Business District and is a parking lot.
AIRPORT IMPACT:
The subject site is located partially within "Zone A" Zone of Minimal Effect as defined on
the "Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" Map. In "Zone
A," few activities will be affected by aircraft sounds except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal
is an appropriate use in this noise zone.

The Master Plan designates the subject property as a Central Business District use and the
applicant's request complies with the Master Plan.
THOROUGHFARE PLAN APPLICATION:

This letter is to verify that your request for a conditional use permit to amend the previously
approved site plan of CU08-06 (Ord. 2008-15) to allow the possession, storage, retail sale,
and on -premise consumption of alcoholic beverages (beer, wine, and mixed beverages) in
conjunction with a restaurant, specifically to allow outside dining on property located at 342
South Main Street and platted as Lot 6A and 6C1, Block 2, City of Grapevine Addition was
approved by City Council on March 16, 2010. A copy of the approved site plan and
Ordinance 2010-08 are enclosed.
On March 16, 2010, the Planning and Zoning Commission recommended the City Council
approve the request.
Any changes to a site plan approved with a conditional use or a special use (no matter how
minor or major) can only be approved by city council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date
on which the City Council grants the Conditional Use, unless within such one (1) year
period: (1) a Building Permit is obtained and the erection or alteration of a structure is
started, or (2) an Occupancy Permit is obtained and a use commenced.
The City Council may grant one additional extension not exceeding one (1) year, upon
written application, without notice or hearing. No additional extension shall be granted
without complying with the notice and hearing requirements for an initial application for a
Conditional Use Permit.
