All Conditional Use and Special Use Applications are assumed to be complete when filed and
will be placed on the agenda for public hearing at the discretion of the staff. Based on the size
of the agenda, your application may be scheduled to a later date.
All public hearings will be opened and testimony given by applicants and interested citizenry.
Public hearings may be continued to the next public hearing. Public hearings will not be
tabled.
Any changes to a site plan (no matter how minor or major) approved with a conditional use or
a special use permit can only be approved by city council through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning ordinance shall
have, from the date of submittal, a period of four months to request and be scheduled on an
agenda before the Planning and Zoning Commission and City Council. If after said period of
four months an application has not been scheduled before the Commission and Council said
application shall be considered withdrawn, with forfeiture of all filing fees. The application,
along with the required filing fee may be resubmitted any time thereafter for reconsideration.
Delays in scheduling applications before the Planning and Zoning Commission and City
Council created by city staff shall not be considered a part of the four month period.

conditional use or special use permit and acknowledge that all requirements of this

On Tuesday evening, May 18, 2010 at 7:30 P.M. in the City Council Chambers, 2nd Floor,
200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following
items:
CU10-06 - RaceTrac - submitted by RaceTrac Petroleum for property located at 751 East
Northwest Highway and platted as Lot 5, Block 1, W R Boyd Center Addition. The
applicant is requesting a conditional use permit to allow gasoline service and off -premise
consumption of alcoholic beverages (beer and wine only) and a monument sign with
changeable copy in excess of 30 -percent in conjunction with a convenience store. The
property is currently zoned "CC" Community Commercial and is owned by Miles
Production, LP
CU10-08 - Hayley Addition - submitted by Ball Street Joint Venture for property located at
1303 and 1401 William D Tate Avenue and platted as Lot 2R, Block 1, Hayley Addition.
The applicant is requesting a conditional use permit to allow the development of a multi -
tenant retail building, a drive through restaurant and a 40 -foot pole sign. The property is
currently zoned "HC" Highway Commercial and is owned by Gartner Grapevine Ltd.
CU10-09 - Westgate Market - submitted by Ridgemont Commercial Construction for
property located at 2215 Westgate Plaza and platted as Lot 2, Block 2R, Westgate Plaza

storage and retail sales of off -premise consumption of alcoholic beverages (beer and wine
only) outside dining, and a 20 -foot pole sign in conjunction with the development of a
market/deli, carwash and two greenhouses. The property is currently zoned "CC"
Community Commercial and is owned by MidWest Commercial Realty, Inc.
CU10-10 and CU10-11- Hartnett's American Grill and Mexican Grill - submitted by ION
Design Group LLC for property located at 1265 and 1295 South Main Street and platted as
Lot 1, HCP Grapevine Condominium. The applicant is requesting a conditional use permit
to allow the possession, storage and retail sales of on -premise consumption of alcoholic
beverages (beer, wine and mixed drinks) outside speakers and outside dining in
conjunction with two restaurants. The property is currently zoned "PO" Professional Office
and is owned by Hartnett Commercial Properties, LP.
PD10-03 - Townhomes of Westgate - submitted by J R Rose Architecture for property
located at 2300 Westgate Plaza and platted as Lots 1-39, Block 1, Townhomes of

Westgate. The applicant is requesting a planned development overlay to allow the
development of 22 detached townhomes. The property is zoned "R-TH" Townhouse
District and is owned by KM/DC Westgate LP.

On June 15, 2010, the Planning and Zoning Commission recommended the City Council
approve the request.
Any changes to a site plan approved with a conditional use or a special use (no matter how
minor or major) can only be approved by city council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date
on which the City Council grants the Conditional Use, unless within such one (1) year
period: (1) a Building Permit is obtained and the erection or alteration of a structure is
started, or (2) an Occupancy Permit is obtained and a use commenced.
The City Council may grant one additional extension not exceeding one (1) year, upon
written application, without notice or hearing. No additional extension shall be granted
without complying with the notice and hearing requirements for an initial application for a
Conditional Use Permit.

Site Description - The 5.16 -acre site is bounded by Main Street, Hanover Drive,
Municipal Way and a public access easement. Note: Site improvements already
completed — this application is to construct restaurant on pad site
Legal Description — Lot 1, Block 1, Epicentre at Grapevine Addition
Proposal — The intent is to create a synergistic community of elegant and sophisticated
restaurants that share a park like common area with abundant landscaping and seating.
These restaurants will be complimentary to one another both in architectural integrity
and menu diversification. This clustering of fine restaurants around a park like social
gathering area is unique and fits in perfectly with the beautification of the Main Street of
Grapevine. We believe the high quality will be a wonderful amenity for business
meetings and celebratory family gatherings, attracting not only the Grapevine citizenry
but a draw to people from miles around. Upon completion of this project, there should be
no finer restaurant cluster any where in the Metroplex.
The first two restaurants, Bob's Chop & Steakhouse and Fireside Pies, have become
highly successful parts of the varied restaurant venue in Grapevine.
Proposed building —This restaurant, yet unnamed, is known as a Mexican Concept,
featuring fine Mexican cuisine. It will be a located in a 5,025 square foot building (plus
2258 square foot patio) with seating for 122 guests in the dining and bar area and 95 in
the patio area — for a total seating of 217 patrons. This restaurant will continue the level
of quality established at the EpiCentre - "the best of class" in each food category.
Special Requirements — The text in the Professional Office zone allows restaurants as
a conditional use, subject to the following: "Drive-in and drive-through restaurants shall
not be allowed". The planned restaurants will comply with this provision.
Impact of Granting Approval — The approval of this request will offer and elegant
restaurant venue for professionals to conduct their business, for area residents to enjoy
their leisure time with friends and neighbors, and for visitors who frequent the many local
attractions. The granting is not believed to have any negative impact on the area.

INTRODUCTION/PROJECT HISTORY
The land planning and conceptual layout effort for The EpiCentre at Grapevine began in early 2005. The
concept was to develop a vacant site on South Main Street into four unique dining experiences. The goal
was to create an innovative development that would attract the best of the best restaurants in the
Dallas/Fort Worth market. Over a period of months, a number of scenarios were created, reviewed and
revised.
The EpiCentre's selected concept develops the five -acre site as a single facility on which four separate
restaurant pad sites operated as a collective dining experience. The site, located just south of Grapevine's
Historic Downtown, is bounded by South Main Street, Municipal Drive, Capitol Street and Hanover
Drive. The restaurants are planned around a common amenity that serves as a focal point. The central
amenity contains enhanced paving, landscaping and lighting offering restaurant patrons with a pleasing
experience, before and after their dining event. Support elements such as parking, access and refuse are
located on the periphery.
The resulting layout took three-dimensional form and work began on the engineering design of the site.
In July 2005, the Plat and the first Conditional Use Permit were presented for public viewing and
approved by the Grapevine Planning & Zoning Commission and City Council.

OVERALL SITE LAYOUT
The EpiCentre's goal of creating a unique restaurant dining experience motivated site designers to
consider the entire site as a single facility. Care was taken to see that context -sensitive design resulted in
a superior experience for restaurant patrons.
Improved site logistics include:
■ A single entry point from South Main Street reduces congestion to/from the site;
■ A central drop-off ellipse lane provides improved pedestrian and vehicular safety;
■ Multiple access to adjoining streets reduces turning movement conflicts for vehicles;
■ A network of sidewalks lead from parking areas to the central plaza increasing pedestrian safety;
■ Central amenity plaza offers restaurant patrons a place to meet other guests before or after their
dining events;
■ Consolidated refuse and delivery locations improves site logistics; and,
■ Overflow parking is accommodated via off-site lease to the east.
Construction of improvements on the entire city block began in 2006. This included overall grading,
installation of water, sanitary sewer lines, storm drainage, paving and landscaping. The site would be
complete and ready for each subsequent restaurant construction.

Building on the reputation earned in the

significant part of the restaurant's
network of locations in San Francisco,
Tucson, Fort Worth and Piano. Bob's
has created a fine reputation by tightly
adhering to the high standards created at

Bob's Steak & Chop House specializes in traditional American prime
steakhouse, combining simple elegance, a lively atmosphere, and large cuts
of the finest prime steaks, chops and seafood. The mission statement for
Bob's Steak & Chop House is to provide the absolute highest quality of
meat and fish available anywhere.
The single story building includes a fine dining area and patron bar, private
dining and wine collection within an 8,511 square foot building. The
restaurant offers valet parking and a seating capacity of 276. Bob's Steak
& Chop House set the standard for the future development of the
EpiCentre.
FIRESIDE PIES — OPENED JANUARY 2008
The Fireside Pies restaurant joined the EpiCenter development in 2008. Fireside Pies offers patrons a
casual dining experience and a wide range of traditional Italian pie -making cuisine. Hand-crafted pies
with premium ingredients are baked in custom pecan wood fired oven. Guests enjoy comfortable seating
inside or at the bar experiencing firsthand the pie makers' craft, or outside on an all season patio.
Fireside Pies offers inside dining for 138 patrons
within the 4,524 square foot building at
traditional dining tables and booths or at the bar
area. Outside dining for 36 patrons is offered on
the 1400 square foot patio. Total available
seating at the restaurant is 174.

The restaurant building is a single
story 8,578 square foot building,
with an additional 973 square feet of "porch" area. The "outdoor" dining experience is located under
roof of the main restaurant's dining structure, but with open air walls that offer patrons a near -outdoor
experience.
Hartnett's American Grill adjoins the landscaped outdoor plaza centerpiece amenity. A portion of the
plaza area (763 sf) is reserved for outdoor beverage service for American Grill patrons with decorative
fencing controlling access to the outdoor service area.
A portion of the restaurant area will offer flex -space to accommodate small group events. Seating in the
bar and dining areas will total 207, with an additional 36 seats in the porch area. The outdoor plaza area
will offer 29 seats for beverage service, for a total of 272 seats. Hartnett's American Grill continues the
high level of quality established at the EpiCentre — "the best of class" in each food category.

The restaurant will offer casual dining for individuals and small groups. Restaurant patrons will be able
to choose from inside and outdoor seating. The entire east elevation of the building is a floor -to -ceiling
glass wall that unites the indoor and outdoor dining experiences. The outdoor dining patio adjoins the
east side of the building (between the Mexican Grill and the present Fireside Pies restaurant).
The indoor seating capacity of the main dining area and bar will be 122. Seating on the patio area will
offer space for an additional 90 patrons, for an overall seating capacity of 212. The Mexican Grill
continues the high level of quality established at the EpiCentre — "the best of class" in each food category.

PROVISION OF OFF-STREET PARKING
The EpiCentre has enjoyed considerable success with its first two restaurants, Bob's Steak & Chop
House and Fireside Pies. The attention to quality and customer service is expected to result in equal
success with the next two restaurants, Hartnett's American Grill and Mexican Grill.
The provision of off-street parking to support the restaurant uses is compliant with the City's
requirements, as is indicated on the Site Plan which accompanies the Conditional Use Permit
applications. The Zoning Ordinance requires one off-street parking space for each three restaurant seats.

Easement Agreement with Grapevine Office
One, LP, on October 5, 2007 and later
amended it on January 5, 2009. This is the
office development currently occupied by
United Development Funding - located
immediately east of the EpiCentre across
Municipal Way.
The agreement grants the EpiCentre the
right to use 69 parking spaces of the office
building parking on a daily basis from 6:00
p.m. to 3:00 a.m. for the purposes of
EpiCentre agents, employees, invitees,
guests, successors and assigns. The
duration of the Agreement is perpetual.
Thus, the provision of 69 additional spaces
increases the number of available spaces to
397 parking spaces, or 27% more than the
City's required off-site parking.

The Central Plaza is situated in the
center of the four restaurants, and
serves as a "commons" for use by all
restaurant patrons. This space includes
a combination of hardscape, landscape,
lighting and sound to provide a unique
experience for all.
Landscaping was selected for its ability
to soften the appearance of the spaces,
provide buffers between areas, and
provide annual color in planting beds.
Lighting is provided for the safety of
patrons, but will be subdued to
minimize light trespass beyond the
restaurant building area.
Speakers, which provide ambient -
background music, are placed in
optimal locations to minimize the
trespass of music beyond the restaurant
building areas. The level of sound from
the speakers is planned to blend
harmoniously with restaurant patrons'
voice levels. The nearest single family
residence is over 500 feet to the west of
the Central Plaza, beyond an office
center which buffers the residences.
Lighting, landscaping and ambient
level music are a package of amenities
to make this an enjoyable experience
for all.
CONCLUDING STATEMENT
The EpiCentre has strived to create a context -sensitive design for its restaurants - for the enjoyment of
restaurant patrons and to be a good neighbor to nearby land uses. Shielded patio areas, a heavily
landscaped -buffered central plaza, subdued lighting and limited ambient music all work in tandem to
eliminate potential impacts beyond the EpiCenter site.
