Any application for a change in zoning or for an amendment to the zoning
ordinance shall have, from the date of submittal, a period of four months to
request and be scheduled on an agenda before the Planning and Zoning
Commission and City Council. If after said period of four months an application
has not been scheduled before the Commission and Council said application shall
be considered withdrawn, with forfeiture of all filing fees. The application, along
with the required filing fee may be resubmitted any time thereafter for
reconsideration. Delays In scheduling applications before the Planning and
Zoning Commission and City Council created by city staff shall not be considered
a part of the four month period.

On Tuesday evening, September 15, 2009 at 7:30 P.M. in the City Council Chambers, 2nd
Floor, 200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following
items:
209-05 - WORLD VILLAGES OF GRAPEVINE - submitted by SREIC International located
at 3509 North Grapevine Mills Boulevard, proposed to be platted as Lot 1, Block 1, Lot 1,
Block 2, Lot 1, Block 3, World Villages of Grapevine Addition. The applicant is requesting
to rezone 16.06 acres from "CC" Community Commercial to "MXU" Mixed Use
Development for the development of three apartment buildings on two lots and office/retail
building on third lot. The property is owned by Gardens of Grapevine.
CU09-24 - LOVE AND WAR IN TEXAS- submitted by Love and War in Texas located at
2505 East Grapevine Mills Circle, Lot 1 R, Block 3, Grapevine Mills Addition Phase 1. The
applicant is requesting a conditional use permit to allow outside dining with outdoor
speakers for live music performances. The property is currently "CC" Community

CU0929 - GRAPEVINE FORD - submitted by Van Tuyl Group located at 801 East State

CU09-30 - TEXAS TOYOTA - submitted by Van Tuyl Group located at 701 East State

CU09-32 - COURTYARD BY MARRIOTT - submitted by Huitt Zollars located on 2100

Bass Pro Court, proposed to be platted as Lot 1, Block 1, Silver Lake Crossing Addition.
The applicant is requesting a conditional use permit to allow a hotel with the possession,
storage, retail sale and on -premise consumption of alcoholic beverages (beer, wine and
mixed beverages) in conjunction with a restaurant, outdoor speakers, increase in height
and a pole sign. The property is owned by Grapevine Equity Partners LLC.
SU09-06 — CHESAPEAKE ENERGY - submitted by Chesapeake Operating, Inc. for
property located at 2720 North Grapevine Mills Boulevard, proposed to be platted as Lot 1,
Block 1, Grapevine Mills Wells Addition. The applicant is requesting a special use permit
to allow gas well drilling and production in a nonresidential district. The property is
currently zoned "HCO" Hotel and Corporate Office and is owned by Chesapeake Land
Development Company, LLC.
After all parties have been given an opportunity to speak, the public hearing will be closed
and the Commission and the City Council will deliberate the pending matters. Please

Because you are a property owner within 200 feet of the subject tract of land as
shown by the last City -approved tax rolls, you received this notice. If you cannot or

Airport staff has reviewed the proposed application submitted by Huitt-Zollaz
for property located at 2100 Bass Pro Court and proposed to be platted as Lot 1, Block
1, Silver Lake Crossing Addition. The applicant is requesting a conditional use permit
to allow a hotel development with possession, storage, retail sale, and on -premise
consumption of alcoholic beverages (beer, wine, and mixed beverages) in conjunction
with a restaurant, outdoor speaker, increase in height and a pole sign. The property is
zoned "CC" Community Commercial District and is owned by Grapevine Equity

This request remains compatible with airport and aviation activities, however we
highly recommend that the Federal Aviation Administration (FAA) be given an
opportunity to review the proposed site plan amendment.

The subject property is located at 2100 Bass Pro
Court and proposed to be platted as Lot 1, Block 1,

approximately 7.67 acres and has 410 feet of
frontage along Bass Pro Court.
REQUESTED ZONE CHANGE, CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to allow a hotel development with the
possession, storage, retail sale and on -premise consumption of alcoholic beverages (beer,
wine and mixed beverages) in conjunction with a restaurant, increase in height and a 20
foot pole sign.
The Courtyard by Marriott Hotel is a seven story structure (approximately 95 -feet) with 301
rooms, a full service restaurant, 10,200 square feet of meeting space, and a 3,000 square
feet swimming pool.
PRESENT ZONING AND USE:
The property is currently zoned "CC" Community Commercial District and is undeveloped.

HISTORY OF TRACT AND SURROUNDING AREA:
The subject and surrounding property was zoned "SP" Specific Use Permit Zoning and 1-1"
Light Industrial District prior to the 1984 City Rezoning. Portions of the subject property
were once part of the Austin Ranch which received approval from Council (Z77-18 and
Z81-44) for on -premise consumption of alcoholic beverages. At Council's September 21,
1999 meeting the subject and surrounding property (52.8 acres) was rezoned from "PID"
Planned Industrial Development District to "CC" Community Commercial District (Z99-13)
for a mixture of uses to include retail, hotel, and restaurant development. At the May 15,
2001 meeting Council approved a conditional use permit (CU01-22) for a restaurant with
on -premise alcohol beverages sales and consumption and outside dining however the
restaurant was never developed.
SURROUNDING ZONING AND EXISTING LAND USE:
NORTH: "HCO" Hotel/Corporate Office District—D/FW Hilton Hotel
SOUTH: "GU" Governmental Use District—D/FW International Airport
EAST: "CC" Community Commercial District—vacant property
WEST: "GU" Governmental Use District—Corps of Engineers/Grapevine
Lake, Cowboy's golf course
AIRPORT IMPACT:
The subject tract is located within "Zone C" Zone of Greatest Effect, as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. In "Zone C,"
industrial and commercial uses that can tolerate a high level of sound exposure are
acceptable. With appropriate sound attenuation for the "MXU" Mixed Use project, the
applicant's proposal is an appropriate use in these noise zones.
MASTER PLAN APPLICATION:
The Master Plan designates the subject property as a Commercial Land Use. The
applicant's proposal is in compliance with the Master Plan.

alcoholic beverages (beer, wine and mixed beverages) in conjunction with a restaurant,
increase in height and a 20 foot pole sign on property located at 2100 Bass Pro Court and
platted as Lot 1, Block 1, Silver Lake Crossing Addition was approved by City Council on
September 15, 2009.
On September 15, 2009, the Planning and Zoning Commission recommended the City
Council approve the request.
A waiting period of one (1) year between the date an application for amendment to the
zoning ordinance, or a requested change in zoning, is denied by the City Council and a
new application for such a change or amendment is accepted, is hereby established. The
one-year waiting period shall be applicable to all requested amendments and changes for
the same zoning district, or districts, on all or any portion of the property previously
considered for amendment or change in zoning; provided, however, said one-year waiting
period shall not be applicable to any proposed amendment or change instituted by the City
Council or Planning and Zoning Commission or to any proposed amendment or change
denied by the City Council without prejudice.

This letter is to meet the requirements set fourth in the CUP site plan application for Silverlake Crossing.
A CUP site plan is required for alcoholic beverage sales for the proposed Hotel site. This should have no
affect on the adjoining property owners. Adjoining the site is the existing Hilton Hotel site and the
Cowboys golf course both of which have alcohol sales. DFW Airport also adjoins the site. Their master
land use plan is compatible with alcohol sales.
