ACKNOWLEDGEMENT
All Conditional Use and Special Use Applications are assumed to be complete
when filed and will be placed on the agenda for public hearing at the discretion of
the staff. Based on the size of the agenda, your application may be scheduled to a
later date.
All public hearings will be opened and testimony given by applicants and
interested citizenry. Public hearings may be continued to the next public hearing.
Public hearings will not be tabled.
Any changes to a site plan (no matter how minor or major) approved with a
conditional use or a special use permit can only be approved by city council
through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning
ordinance shall have, from the date of submittal, a period of four months to
request and be scheduled on an agenda before the Planning and Zoning
Commission and City Council. If after said period of four months an application
has not been scheduled before the Commission and Council said application shall
be considered withdrawn, with forfeiture of all filing fees. The application, along
with the required filing fee may be resubmitted any time thereafter for
reconsideration. Delays in scheduling applications before the Planning and
Zoning Commission and City Council created by city staff shall not be considered
a part of the four month period.

On Tuesday evening, September 15, 2009 at 7:30 P.M. in the City Council Chambers, 2nd
Floor, 200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following
items:
Z09-05 - WORLD VILLAGES OF GRAPEVINE - submitted by SREIC International located
at 3509 North Grapevine Mills Boulevard, proposed to be platted as Lot 1, Block 1, Lot 1,
Block 2, Lot 1, Block 3, World Villages of Grapevine Addition. The applicant is requesting
to rezone 16.06 acres from "CC Community Commercial to "MXU" Mixed Use
Development for the development of three apartment buildings on two lots and office/retail
building on third lot. The property is owned by Gardens of Grapevine.
CU09-24 - LOVE AND WAR IN TEXAS - submitted by Love and War in Texas located at
2505 East Grapevine Mills Circle, Lot 1 R, Block 3, Grapevine Mills Addition Phase 1. The
applicant is requesting a conditional use permit to allow outside dining with outdoor
speakers for live music performances. The property is currently "CC" Community
Commercial and is owned by Cary & Janice Kopczynski.
CU09-28 - RAINBOW PLANTS - submitted by Rainbow Plants located at 3000 Grapevine
Mills Parkway #700, Lot 1 R, Block 1, Grapevine Mills Addition Phase 1. The applicant is
requesting a conditional use permit to allow a outdoor farmers market located in the
parking lot. The property is zoned "CC" Community Commercial and is owned by Simon
Property Group.
CU09-29 - GRAPEVINE FORD - submitted by Van Tuyl Group located at 801 East State
Highway 114, proposed to be platted as Lot 2, Block A, VT G Grapevine Addition. The
applicant is requesting a conditional use permit to enlarge the overall square footage of the
property, enlarge the new car showroom, service drive and service department. The
property is zoned "PCD" Planned Commerce Development and is owned by AIGTLP-Texas
LP.
CU09-30 - TEXAS TOYOTA - submitted by Van Tuyl Group located at 701 East State
Highway 114, proposed to be platted as Lot 1, Block A, VTG Grapevine Addition. The
applicant is requesting a conditional use permit to reduce the overall square footage of the
property. The property is zoned "PCD" Planned Commerce Development and is owned by
NSHE-TX Gatesville, LLC.
CU09-32 - COURTYARD BY MARRIOTT - submitted by Huitt Zollars located on 2100

Bass Pro Court, proposed to be platted as Lot 1, Block 1, Silver Lake Crossing Addition.
The applicant is requesting a conditional use permit to allow a hotel with the possession,
storage, retail sale and on -premise consumption of alcoholic beverages (beer, wine and
mixed beverages) in conjunction with a restaurant, outdoor speakers, increase in height
and a pole sign. The property is owned by Grapevine Equity Partners LLC.
SU09-06 — CHESAPEAKE ENERGY - submitted by Chesapeake Operating, Inc. for
property located at 2720 North Grapevine Mills Boulevard, proposed to be platted as Lot 1,
Block 1, Grapevine Mills Wells Addition. The applicant is requesting a special use permit
to allow gas well drilling and production in a nonresidential district. The property is
currently zoned "HCO" Hotel and Corporate Office and is owned by Chesapeake Land
Development Company, LLC.
After all parties have been given an opportunity to speak, the public hearing will be closed
and the Commission and the City Council will deliberate the pending matters. Please

PLANNING AND ZONING COMMISSION
Because you are a property owner within 200 feet of the subject tract of land as
shown by the last City -approved tax rolls, you received this notice. If you cannot or
do not wish to attend the hearing, the attached form is provided for your
convenience. If owners of more than 20% of the property within 200 feet of the
subject tract object to the case, a 3/4 vote of the City Council is required to approve
the request.
Purpose of Request:
The public hearing is to consider an application submitted by Van Tuyl Group located at
801 East State Highway 114 (former Texas Toyota property), proposed to be platted as Lot
2, Block A, VTG Grapevine Addition. The applicant is requesting a conditional use permit
to amend the previously approved site plan to establish a planned commercial center for
an automobile dealership with sales and service of new and used vehicles along with two
pole signs. The property is zoned "PCD" Planned Commerce Development and is owned
by AIGTLP-Texas LP. A copy of the concept plan is on file with the Department of
Development Services.

Airport staff has reviewed the proposed application submitted by Van Tuyl
Group located at 801 East State Highway 114 (former Texas Toyota property),
proposed to be platted as Lot 2, Block A, VTG Grapevine Addition. The applicant is
requesting a conditional use permit to amend the previously approved site plan to
establish a planned commercial center for an automobile dealership with sales and
service of new and used vehicles along with two pole signs. The property is zoned
"PCD" Planned Commerce Development and is owned by AIGTLP-Texas LP.
This request remains compatible with airport and aviation activities, however
we highly recommend that the Federal Aviation Administration (FAA) be given an
opportunity to review the proposed site plan amendment.

The subject property is located at 801 State Highway
114 East and is proposed to be platted as Lot 2,
Block 1, VTG Grapevine Addition. The addition
contains 11.84 acres and has 531 feet of frontage
along State Highway 114 westbound service road
and 314 feet of frontage along Hanover Drive.
REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to establish a planned commercial
center for an automobile dealership with sales and service of new and used vehicles along
with a 40 -foot pole sign and two monument signs.
The subject site is the current location of the Texas Toyota automotive dealership. This
dealership and the adjacent Grapevine Ford automotive dealership to the west are held
under the same ownership. It is the applicant's intent to switch dealership locations, i.e.
the Toyota dealership will relocate to the existing Ford location, and the Ford dealership will
relocate to the existing Toyota location. Specifically this request is associated with
Grapevine Ford dealership. The applicant is also proposing a 1,146 square foot addition to
the front of the dealership for an expansion to the new car showroom, and a 25,240 square
foot expansion for a new service department area. There will also be a 5,786 square foot
service drive area expansion for pick up and drop off of vehicles needing service and

repair. In addition, the Grapevine Ford dealership will also be relocating both their 35 -foot
pole sign and 24 -foot pole sign to new locations along the State Highway 114 service road
at the new dealership location.
PRESENT ZONING AND USE:
The property is currently zoned "PCD" Planned Commerce Development District and is
developed as Toyota automotive dealership.
+11STORY OF TRACT AND SURROUNDING AREA:
The subject and surrounding properties were rezoned in the 1984 City Rezoning from "LI"
Limited Industrial to "PCD" Planned Commerce Development District. No development
has occurred adjacent to this site, to date, except for the platting of the Trinity Addition for
public rights-of-way. Conditional Use Request CU97-32 was approved by Council at the
August 19, 1997 meeting and allowed for a planned commercial center with sales and
services of new and used automobiles. Another conditional use request was considered
and approved on this site (CU98-66) at the December 15, 1998 meeting which allowed for
the addition of two shade structures to the rear of the Parts and Service building. At
Council's July 15, 2003 meeting conditional use regt.west CU03-22 was approved which
allowed for two temporary move -in buildings to be utilized for temporary sales offices for a
period of 18 -months while new permanent sales office area is under construction. The Site
Plan Review Committee at their January 26, 2005 meeting approved conditional use
request CU05-02 for an enclosure of a patio area near the southwest corner of the existing
sales office for use as additional office space for the sales staff. A five -bay lube center
was also added to the site. Conditional use request CU05-58 was approved by the Site
Plan Review Committee at the December 14, 2005 meeting which allowed for the addition
of a single bay automated car wash to the site and a reduction in height from 40 -feet to 35 -
feet for an existing pole sign and an increase from 20 -feet to 24 -feet for an existing pole
sign. The Site Plan Review Committee approved CU06 292 at their June 28, 2006 meeting
which allowed for a detached car wash and detail area at the rear of the service area.
Conditional use request ^U06-59 was approved by the Site Plan Review Committee at
their December 21, 200`'6 meeting which reduced the size of the detail/car wash area.

The subject tract is located within "Zone A" Minimal Zone of Effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. Few
activities will be affected by aircraft sounds in Zone A, except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal
is an appropriate use in this noise zone.
MASTER PLAN APPLICATION:
The Master Plan designates the subject property as a Commercial land use. The
applicant's ,proposal is in compliance with the Master Plan.
THOROUGHFARE PLAN APPLICATION:
The Thoroughfare Pian designates Hanover Drive as a Type E Collector with a minimum
75 -foot right-of-way developed as four lanes.

This letter is to verify that your request for a conditional use permit to establish a planned
commercial center for an automobile dealership with sales and service of new of new and
used vehicles along with a 40 -foot pole sign and two monument signs on property located
at 801 East State Highway 114 and platted as Lot 2, Block 1, VTG Grapevine Addition was
approved by City Council on September 15, 2009.
On September 15, 2009, the Planning and Zoning Commission recommended the City
Council approve the request.
A waiting period of one (1) year between the date an application for amendment to the
zoning ordinance, or a requested change in zoning, is denied by the City Council and a
new application for such a change or amendment is accepted, is hereby established. The
one-year waiting period shall be applicable to all requested amendments and changes for
the same zoning district, or districts, on all or any portion of the property previously
considered for amendment or change in zoning; provided, however, said one-year waiting
period shall not be applicable to any proposed amendment or change instituted by the City
Council or Planning and Zoning Commission or to any proposed amendment or change
denied by the City Council without prejudice.
